Transfer to Other Duties. Where an employee is transferred due to a redundancy, the employee shall be entitled to the same period of notice of transfer as he/she would have been entitled to if his/her employment had been terminated, and the employee shall be entitled to income maintenance at the level of ordinary time earnings to which he/she was paid for a period until the ordinary time earnings of the position to which the employee was transferred exceeds that amount. Ordinary earnings as expressed in this clause shall include annualised allowances and shift loadings averaged over the preceding twelve months.

Transfer to Other Duties. If incapacitated for the employee's regular assignment, the employee may be given other duties with the County government for the period of recuperation. Unwillingness to accept such assignment as directed by the employee's department head or the County Administrative Officer will make the employee ineligible for leave under this regulation during the time involved.

Before you are transferred, the alleged issue concerning your performance will be discussed between you, your supervisor, and your Department Manager. The General Manager will either approve or reject the recommendation of your supervisor concerning the transfer. You will not be transferred until it has been sanctioned by the General Manager after a consideration of your response. In the event that there is a dispute over the application of this clause, the Resolution of Workplace Disputes Clause (clause 30) will apply.
