Vacation Rights in Case of Separation. Any employee who is separated from employment from the City for any reason other than for just cause shall be paid for any unused vacation and unused compensatory time at the time of separation. In the event of a death of an employee while in the employment of the City, the provisions of this section shall be paid to the estate of the employee.

Vacation Rights in Case of Separation. Any employee who is retired or separated from the service of the employer for any reason prior to taking his/her vacation shall be compensated at the time of separation for any accumulated unused vacation.
Vacation Rights in Case of Separation. When an employee retires, resigns or is terminated without having taken all accrued vacation time, the monetary equivalent of all accrued vacation hours shall be paid to the employee as part of their final compensation at their current rate of pay upon separation. Should an employee use more vacation than what was accrued at the time of separation for any of the foregoing reasons, the employee will have the monetary equivalent at their current rate of pay deducted from their final paycheck. Should the employee’s final paycheck not have sufficient funds to cover that cost, the employee will be billed for the amount owed.

Should the employee’s vacation balance, following proration, be less than zero, the employee will be financially responsible for the deficit balance, including reduction of other appropriate leave banks. Section 8 Pro-rated Vacation for Regular Part-time and Part-time/Extra Employees Regular part-time and Part-time/Extra Employees are eligible for pro-rated vacation based on the number of hours paid during the employee’s preceding anniversary year. However Part Time Transit Operators shall not receive vacation, prorated or otherwise.
