WARRANTY TERMS AND CONDITIONS. The following terms and conditions (the “Warranty Terms and Conditions”) apply to the warranty made by Xxxxxxxx & Company (“Xxxxxxxx”) for Xxxxxxxx Non-Reactive Standard Adhesive for use with modular carpet. These Warranty Terms and Conditions and related warranty do not apply to non-commercial installations. The warranty provided herein is in lieu of any and all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. The warranty is subject to the limitations and exclusions set forth in these Warranty Terms and Conditions and in the individual warranty. The warranty only applies to use of the Xxxxxxxx Non-Reactive Standard Adhesive product in carpet installations when bond testing, substrate preparation, adhesive application and carpet installation have all been performed in accordance with the requirements and instructions set forth on the product label, the product specification sheet, Xxxxxxxx’x then current published instructions for installation of modular carpet (which are specific for each carpet product), and the then current Carpet and Rug Institute publication CRI 104 (collectively, the “Documentation”). Furthermore, the carpet installation must be in an indoor commercial environment. The warranty shall not apply (i) to installations on substrates that were not prepared and tested, when applicable, as instructed in the Documentation; (ii) to substrates that are not free of silicate penetrating curing compounds and other topical or integral treatments that violate ASTM F710; (iii) to installations over substrates where hydrostatic pressure exists; (iv) where the claimant does not have written and photographic documentation of the bond testing conducted prior to the installation; (v) to installation failures due to outside sources of water, such as where outside grade is above substrate, sprinklers soaking ground at the building foundation, overflow drains not directed away from the foundation, flooding or other natural disasters or weather conditions; (vi) to installations taken up or replaced prior to inspection by authorized Xxxxxxxx personnel; (vii) to installations with chemically cleaned substrates, where improper cleaning methods have been used, or where adhesive removers have been applied; (viii) to installations using incompatible curing compounds, mold release agents, or non-Portland cement based leveling or patch compounds; (ix) to failure of leveling...
WARRANTY TERMS AND CONDITIONS. 1.1 The Seller guarantees sold goods against any manufacturing defects for twelve months from the purchasing date. This warranty only covers hardware product components and only applies to hardware products manufactured by or on behalf of the Seller and that can be identified through the mark, the trade name or the “Gilbarco” logo on them, or anyway equipped with the relevant sale invoice. The software (by the Seller or by third parties) is subject to licence contracts with the final user or to distinct warranty conditions.
1.2 Should any manufacturing defects be detected within the warranty period, the Seller or one of its authorised service shops shall repair/replace defective goods within the terms and under the conditions stated below, without any charge to the Buyer for the labour costs incurred to repair and/or replace the goods.
1.3 Replacement under warranty conditions shall only be performed if the defect is notified to the Seller within the warranty period. Procedures to request interventions under warranty conditions are subject to the following rules. In the event of an obvious defectiveness or incompleteness of the service or the supply, we are to be notified thereof in writing without delay, but at the latest within 8 days after receipt of the supply or service, and in the event of hidden deficiencies without delay but at the latest within two weeks after detection of the defect, including a precise description of the defect. At our request the defective goods are to be returned to us. Claims of the Customer on account of defectiveness or incompleteness of the delivery or service are excluded if it fails to comply with this obligation. Apart from that, German law sec. 377 HGB shall apply. Before requesting an intervention under warranty conditions the Seller encourages the user to thoroughly read the relevant operating instructions. This warranty shall not be applicable if the model indication or the serial number on the product have been modified, deleted, removed or made unreadable.
WARRANTY TERMS AND CONDITIONS. THE OBLIGATIONS OF WOODLINE SHADE SOLUTIONS HEREUNDER ARE LIMITED TO REPAIR OR REPLACEMENT OF PARTS OF THE PRODUCT FOUND TO BE DEFECTIVE UNDER THIS LIMITED WARRANTY. IN NO EVENT SHALL WOODLINE SHADE SOLUTIONS BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO TIME, WAGES OR LOST PROFITS, OF ANY NATURE OR KIND OR FOR DAMAGES TO OR LOSS OF PROPERTY. In addition, Woodline Shade Solutions reserves the right to modify, refine, or improve its products and parts including making substitutions, without incurring any responsibility to modify, exchange, replace or repair any parts or products to meet prior specifications.

WARRANTY TERMS AND CONDITIONS. 1.1 This Warranty is provided by Gilbarco Xxxxxx-Xxxx (hereinafter "GVR" or "Seller") and shall apply between GVR and a customer who has purchased a Product directly from GVR or from an authorized GVR sales partner.
1.2 This Warranty is limited to these terms and conditions. In addition, the products supplied are guaranteed to be compliant to the GVR specifications. In the event a authorized GVR sales partner provides a warranty that is more extensive that this Warranty, GVR shall not, under any circumstances, be liable for any rights, obligations, actions or omissions that are more extensive than provided under this Warranty or any features, defects, errors or failures not covered by this Warranty.
1.3 GVR warrants that its Products are free from defects in materials and workmanship under normal use for the Warranty period. GVR warrants that the products sold are compliant with the Laws, the Certifications and the Regulations of the countries where the product will be sell.

8.2 This warranty is exclusive and supersedes any other quality and performance warranties, whether written, verbal or implicit. Any other warranties, including any implied warranties of merchantability or fitness for purpose, are hereby specifically excluded by GVR to the extent legally possible.

WARRANTY TERMS AND CONDITIONS. Upon examination, if Seller determines the Product is defective, Seller will elect, in its sole discretion, to repair the Product or replace the Product. If the Seller chooses to replace the Product and is not able to do so because it has been discontinued or is not available, Seller may replace it with comparable product. This limited warranty only applies when the product has been properly wired, installed, and operated within the electrical values, operating range, and environmental conditions provided in the installation instruction. This limited warranty does not apply to loss or damage to the Product caused by, but not limited to: negligence; abuse; misuse; mishandling; improper installation, storage, or maintenance; damage due to fire or acts of God; vandalism; civil disturbances; power surges; improper power supply; electrical current fluctuations; corrosive environment installations; induced vibration; harmonic oscillation or resonance associated with movement of air currents around the Product; alteration; accident; failure to follow installation, operating, maintenance or environmental instructions prescribed by Seller or its authorized service provider; void label inside the Product is not in its original place or the void label is damaged. This limited warranty excludes field labor and service charges related to the repair or replacement of the Product. THIS LIMITED WARRANTY IS VOID IF THE PRODUCT IS NOT USED FOR THE PURPOSE FOR WHICH IT IS DESIGNED or if it is used in violation of any applicable standard, code or instructions for use, including those in the Standards for Safety of Underwriters Laboratory, Inc. (UL), and the Canadian Standards Association (CSA). Seller reserves the right to utilize new, reconditioned, refurbished, repaired or manufactured products or parts in the warranty repair or replacement process. Such products and parts will be comparable in function and performance to an original product or part, as determined by Seller in its sole discretion, and warranted for the remainder of the original warranty period.
