Your General Responsibilities. 5.1. You agree to input current, complete and accurate information into the Organisation Portal. 5.2. You are responsible for protecting the confidentiality of all the information You input into the Organisation Portal and for complying with all guidelines issued by the Chief Executive from time to time in order to prevent unauthorised access to the Organisation Portal. You agree to immediately notify the Learning Records Service Business Team, The Skills Funding Agency, Cheylesmore House, Xxxxxxx Road, Coventry, CV1 2WT should You become aware of any unauthorised use of Your Organisation Reference Number or any other unauthorised use of the Organisation Portal. 5.3. You shall not provide any inaccurate, misleading or false information to the Chief Executive either in any communication or when you register for access to the Organisation Portal. 5.4. You shall notify the Chief Executive of the name and contact details of the Super- User as soon as practicable after signing this Agreement. You shall promptly inform the Chief Executive of any changes to Your Super-Users (e.g. change to contact details or contact representative). 5.5. You shall control the access by maintenance staff and visitors to the physical area(s) within Your organisation where the Organisation Portal is accessed and You must implement measures to prevent theft of property from such areas. 5.6. You shall use reasonable endeavours to ensure that Authorised Users only Access the Personal Learning Record, on a Learner’s behalf, once the Learner’s identity has been verified and the Learner has received the Privacy Notice. 5.7. The Chief Executive, Awarding Organisations, Learning Providers and other third parties may not use achievement data or other information obtained from the Organisation Portal for commercial gain. 5.8. You shall not use mobile devices to store or access personal data from the Organisation Portal except in accordance with guidance on the use of mobile devices published on the website. xxx.xxxxxxxxxxxxxxxxxxxxxx.xxx.xx 5.9. Your General Responsibilities. 4.1 You will: (a) deal with us at all times openly and in good faith; (b) honestly, diligently and professionally carry out the responsibilities of your role and any related responsibilities; (c) attend meetings and training sessions as required; (d) at all times be caring and sensitive to the needs of our patients; (e) act in a way that promotes and protects our business, reputation and relationships; (f) be aware of and work within your scope of practice under the Health Practitioners Competence Assurance Xxx 0000; (g) comply with the New Zealand Medical Association’s Code of Ethics; (h) take all reasonable precautions while at work to ensure your own safety and the safety of your colleagues, our patients and other visitors to the practice; (i) comply with all security requirements, including those relating to the security of drugs on the premises; (j) comply with our reasonable requests and directions; and (k) comply with our policies and procedures, which may be amended from time to time. 4.2 You will also maintain your practising certificate and registration, and will advise us immediately if: (a) either the registration or certificate ceases to be current or the certificate is suspended; (b) you are the subject of disciplinary proceedings or an investigation by the Medical Council, Health Practitioners Disciplinary Tribunal, Health and Disability Commissioner or any health service provider; or (c) you receive a complaint from any of our patients.
Your General Responsibilities. You will: a. take all reasonable precautions and implement all related procedures for the purpose of providing the Services described herein from access by unauthorised personnel when requesting a resource(s) from 31G; b. provide the tools, infrastructure, insurance, indemnity and other necessary resources and support to 31G resource(s) during the performance of these Services; c. make appropriate personnel available to assist 31G in the performance of 31G’s responsibilities; d. obtain all authorisations for us and our subcontractors to access, use and modify non-31G products or information, necessary for us to fulfil our obligations under this Agreement, without violating any third party rights. For greater certainty, we are relieved of any obligations adversely affected by your failure to do this; e. provide suitable office space, supplies, furniture, high speed connectivity to the Internet, and other facilities for 31G’s personnel while working on your premises or equivalent remote access as required, unless otherwise specified; f. ensure that current maintenance and license agreements are in place with applicable vendors for those products and services upon which 31G is relying to provide the Services described herein; g. be responsible for the content of any database, the selection and implementation of controls on its access and use, backup and recovery and the security of the stored data. This security will also include any procedures necessary to safeguard the integrity and security of software and data used in the Services from access by unauthorised personnel; and h. be responsible for the identification and interpretation of any applicable laws, insurances, regulations, and statutes that affect your existing application systems or programs that 31G will have access to during the Services. It is your responsibility to assure that the systems and programs meet the requirements of those applicable laws, regulations and statutes.

The SFA, Awarding Organisations, Learning Providers and other third parties may not use achievement data or other information obtained from the Organisation Portal for commercial gain. 5.8. Mobile devices shall not be used to store, transmit or access any personal data on the Organisation Portal unless the device has been certified to FIPS 140-2 or is CAPS approved, or has been secured using a product which has successfully undergone one of these evaluations. 5.9. Where You require Authorised Users to use Mobile Devices to store, access or transmit LRS data, the Learning Records Service Helpdesk must be informed of the proposed devices and the controls to be put in place around their usage.

Mobile devices shall not be used to store transmit or access any personal data or document marked PROTECT unless the device has been certified to FIPS 140-2, is CAPS approved or has been secured using a product which has successfully undergone one of these evaluations.
