Proportionate Leave on Termination. Where an employee has given five working days' or more continuous service, inclusive of any day off as prescribed by Clause 11(1) - Hour or 16(4) - Shift Work (exclusive of overtime), and he/she either leaves his/her employment of his/her employment is terminated by the employer he/she shall be paid a twelfth of a week's wages for each completed five working days of continuous service with his/her current employer for which leave has not been granted or paid for in accordance with this award.

An employee on weekly hiring who leaves the employment of the employer or his/her employment is terminated by the employer for any reason, shall be paid for 2.769 hours for each 36 ordinary hours worked and in respect of which leave had not been granted under this clause at the appropriate rate of wage calculated in accordance with 18.10.

(a) If after one week's continuous Service in any qualifying 12 monthly period, an employee lawfully leaves their employment or their employment is terminated by the employer through no fault of the employee, the employee shall be paid at the appropriate rate of wage prescribed in clause 5.4 (Employees Wages) for 2.923 hours for each completed week of continuous Service. Continuous Service is as defined in clause 7.1.8 Provided that continuous shift workers shall be paid for 3.654 hours for each completed week of continuous Service.

(a) If after one months continuous service in any qualifying 12 month period an employee leaves the employer’s employment or such employee’s employment is terminated, the employee will be paid pro rata leave at the rate of 1/12 of the annual leave for which such employee would be eligible for each completed month of service in respect of which such employee has not been granted annual leave.
