Agency Personnel. Services shall be performed only by Agency personnel who have been adequately trained and certified by Agency to provide Services in conformance with the terms of this Agreement, including but not limited to training on all Collection Laws, Client’s Performance Standards, and the Agency’s Policies and Procedures for the Services (each, an “Agent” and collectively, the “Agents”). The Agents shall perform the Services under the direction, supervision and control of Agency management subject to Client’s oversight consistent with its third party vendor management responsibilities. Additionally, Agency shall provide from time to time, upon reasonable request of Client, certification records of Agency personnel in accordance with this Section 3D.

Agency Personnel. The Employer may employ agency personnel to fulfill its staffing requirements only after it has satisfied its obligations under subparagraphs (a) and (b) herein.
Agency Personnel. 34.01 If due to unforeseen circumstances the Company is unable to meet temporary staffing needs through the use of its full-time and temporary employees, and it uses personnel provided by an outside agency, such personnel shall have no rights under the Collective Agreement. The Company shall pay union dues in respect of such personnel and shall provide a monthly statement of the names of such personnel used and the dates and hours worked by such person. Such personnel shall not be used to avoid the use of full-time or temporary employees, including those on layoff.
Agency Personnel. 7.8.1 The Parties acknowledge that the use of agency personnel can impact on the employer-employee relationship. Accordingly: (a) Australia Post will ensure that the overall pay and conditions of remuneration paid to agency personnel will not be less than the overall pay and conditions of remuneration provided to comparable Australia Post employees by the Agreement and the Australia Post Enterprise Award 2015. Australia Post will ensure that agency personnel will observe the same on the job working arrangements as apply to the comparable Australia Post employees under the Agreement; and (b) where agency personnel are engaged they will be utilised to cover casual and fixed term needs within the same parameters as defined in clauses 7.5 and 7.6, provided that fixed term agency personnel can only be employed in non-operational roles. 7.8.2 Australia Post will provide the Union with information on how agency personnel have been used and will also consult on the operations of these arrangements. Information will be provided nationally to the Union on a quarterly basis. This clause does not require Australia Post to provide information about individual employees to the Union.

Agency Personnel. The Company will make use of Agency personnel on a one-to- one basis to replace full time employees who are on vacation, absent, on an authorized leave, or modified work. In addition, the company will utilize Agency personnel for volume/process related fluctuations that increase labour requirements, the use of agency individuals will be limited to the extent necessary to maintain a sufficient work force as determined by the Company to meet the customer needs, as they may fluctuate from time to time. Agency personnel will therefore be utilized in cases of illness, vacation, workers compensation leaves, pregnancy and parental leave, personal leaves of absence including Union leaves, or short-term extenuating circumstances resulting as follows:

Agency Personnel a) The Agency shall, as outlined in this Clause: i) Employ persons knowledgeable about the applicable codes, standards and regulations, relative to the Services it provides; ii) Employ or engage Safety Codes Officers (SCOs) who are certified and designated to provide compliance monitoring relative to the Services the Agency provides; and iii) Maintain a registry of all SCOs they employ, and their level(s) of certification, and designation of powers; iv) Provide on a yearly basis copies of the certifications of all SCOs being employed for the purpose of this contract.
