Architect’s Additional Services. The Architect may provide Additional Services after execution of this Agreement without invalidating the Agreement. Should the Owner request services that the Architect believes to be outside the scope of Basic Services, the Architect shall, before performing those services, inform the Owner in writing of the Architect’s belief that the services requested are Additional Services, and shall provide an estimate in writing to the Owner of the probable total of the Additional Service Fees to be incurred in performing the purported additional services. Except for services required due to the fault of the Architect, any Additional Services provided in accordance with this Section 4.2 shall entitle the Architect to compensation pursuant to Section 11.3 and an appropriate adjustment in the Architect’s schedule. Notwithstanding anything to the contrary in this Agreement, Owner shall not be responsible to pay, and the Architect shall not be entitled to receive compensation for, any Additional Services to the extent such services are required due to the fault or negligence of the Architect or the Architect's failure to perform in accordance with the terms of this Agreement. The Architect shall immediately proceed to perform any Additional Services in accordance with any written direction from the Owner directing such Additional Services, pending resolution of any issue as to payment or time for such services. Except as otherwise provided herein, prior written authorization by the Owner in the form of an approved Additional Services Proposal is required before the Architect may perform Additional Services. The prior written authorization is a condition to both invoicing and payment for any Additional Services.

Unless otherwise provided herein or in the Architect Contract, the following services are not included in Basic Services: .1 Revisions to previously prepared Instruments of Service necessitated by Owner requests that are inconsistent with prior instructions or approvals of the Owner, including material change(s) in the Project’s size, quality, or complexity, the Owner’s schedule, or the budget for Cost of the Work, or procurement or delivery method, but not including changes incorporated to bring the Project within budget;

If any of these services are authorized in advance by the Owner they shall be paid for by the Owner as set forth in Section 2.2 of this Agreement. 4.1 Making planning surveys and special analysis of the Owner’s need to clarify requirements of any School Project, but excluding services in the development of Program and General Requirements and services to provide for a reasonable number of alternate bids. 4.2 Revising previously approved drawings or specifications to accomplish changes, except as provided in Articles 3 and 7 of this Agreement. 4.3 Consultation concerning replacement of any construction work damaged by fire or other cause during construction and furnishing professional services of the types set forth in Article 3 above as may be required in connection with the replacement of such work. 4.4 Preparing ancillary documents for supplemental work requested by the Owner which work and/or compensation for such work is not otherwise addressed under this Agreement, unless such work is required as a result of the omission, fault or negligence on the part of the Architect. 4.5 Arranging for the work to proceed should the XXXX default due to delinquency or insolvency. 4.6 Providing extended Construction Phase services should the contract date of Substantial Completion for any each School Project, as established and as may be amended in accordance with the XXXX Agreement, be exceeded by more than ninety (90) calendar days due to no fault or partial fault of the Architect. However, the Architect shall not receive additional compensation under this section for preexisting Basic Services, including but not limited to a) close-out related services necessary for School Project Final Completion and b) assisting the Owner in the preparation of a Final Certificate and Release to be executed by the XXXX. In addition to the requirements set forth in Article 2, prior to commencing any services under this Article, the Architect shall provide the Owner with a reasonably detailed written description of its estimation of the remaining Basic Services to be provided. In its sole discretion, the Owner may direct the Architect to suspend some or all of its Construction Phase services for a period of time not to exceed a total of ninety (90) calendar days to minimize or avoid a request for additional services.
