Authority to Stop Work. The Project Inspector shall have the authority to issue a Stop Work Order if the Project Inspector determines that Design Build Entity’s work violates the Construction Documents, any Applicable Code Requirements, any orders issued by Judicial Council, Judicial Council Representative, or Authority(ies) Having Jurisdiction, or any other provisions of the Contract Documents. The failure of the Project Inspector to issue a Stop Work Order does not excuse Design Build Entity from complying with the Construction Documents for that Construction Work, nor does it relieve Design Build Entity from the responsibility to correct the Work. 10.2.1.1. Upon issuing a Stop Work Order, the Project Inspector shall notify Judicial Council Representative who, along with the Project Inspector, shall review the Construction Work to determine whether it deviates from, or does not conform with, the Construction Documents or constitutes Defective Work. If Judicial determines the Construction Work deviates from, or does not conform with, the Construction Documents or constitutes Defective Work, Design Build Entity shall comply with any instructions of Judicial Council (including any made through the Project Inspector and/or Judicial Council Representative) regarding work necessary to cure the deviation, nonconformance or Defective Work. Once the deviation, nonconformance or Defective Work is fixed, Design Build Entity may resume stopped Work. Design Build Entity shall not be entitled to an extension of the Contract Time or an increase in the Total Contract Amount arising hereunder, if Judicial Council, in its sole and absolute discretion, determines that reasonable facts support the issuance of the Stop Work Order.
Authority to Stop Work. The Consultant is hereby authorized to stop work on all or part of the project for up to twenty-four hours, without prior consultation with the City and for any reason which the professional judgment of the Consultant requires such stoppage. Upon issuing such stop work order, the Consultant shall immediately consult with the City to resolve the problem which led to the stop work order. Section 1. 203 Additional Services The following shall constitute Additional Services: A. Performing work not described under Basic Services requested and authorized in writing by the City's Authorized Agent including, but not limited to the following: o Special travel. o Property surveys, and preparation of plots and legal descriptions. o Serving as an Expert Witness on behalf of the City o Materials testing other than that performed by a testing laboratory on contract with the City unless specifically included as a basic service reimbursable expense. o Televised inspection of sewers, unless specifically included as a basic service reimbursable expense.
Authority to Stop Work. If at any time the City or other agency or authority of competent jurisdiction determines that any Work being done in the Right-of-Way by Franchisee or its Contractors or Users presents a danger to the public health, safety or welfare, the City may require Franchisee to cease and desist all Work until Franchisee and/or its Contractors or Users, at its or their own expense, take the necessary corrective action. Should the City have to correct any condition, the City shall bill the Franchisee for the cost of such correction and the Franchisee shall promptly reimburse the City as provided in Sections 4.3 (Reimbursement of Costs) and 7.3 (Permit Fees). If the Franchisee fails to promptly reimburse the City, the City may take whatever actions necessary to enforce this Agreement, including revoking Franchisee’s Franchise.‌
Authority to Stop Work. 90.4.1 Where a workplace is unsafe, a Certified Society and Management member of the local JHSC can jointly prevent the start of the work or stop the work. 90.4.2 Where there is a disagreement between the Certified Society or Certified Management member of the local JHSC that the workplace is unsafe, the issue shall be immediately presented to the local JHSC for review and resolution. 90.4.3 Where an employee's health or safety is in immediate danger, a Certified Society or Management member of the local JHSC can stop the work. After calling the work stoppage, the Certified Society or Management member must contact the respective counterpart immediately and seek to obtain joint agreement on the stoppage as soon as possible. If joint agreement cannot be reached, the issue shall be presented to the local JHSC for review and resolution. 90.4.4 In cases where the JHSC cannot resolve issues arising from 2 or 3 above, the Ministry of Labour Inspector or the Atomic Energy Control Board shall be called in for resolution.
Authority to Stop Work. ‌ The Construction Quality Management Plan shall identify at least one qualified person, nominated from the Design-Builder’s site crew or Quality Team, who will be on Site at all times during Construction who has the authority to immediately stop any work or activity which is not being performed or carried out in accordance with the Project Requirements, the Final Designs or any applicable Quality Documentation.
