Board Recognition. The Board agrees not to recognize or negotiate with any employee organization, other than the Association, claiming to represent licensed staff covered by this Agreement.

Board Recognition. The B.E.A. recognizes the Board as the locally elected body legally charged with the establishment of policies for public education in the school district and as the employer of all teachers in the school system, and that the Board has the right to manage the schools.
Board Recognition. The Board recognizes teaching as a profession and the Association as the organization which represents the bargaining unit staff. This does not eliminate the right of other groups or individuals to be heard by the Board.

The Association further recognizes that the Board has the sole responsibility for the management and control of all the public schools of whatever name or character in the District and is specifically delegated with the responsibility of making the rules and regulations by which the District will be governed as provided by Sections 3313.20 and 3313.47 and Chapter 4117 of the Ohio Revised Code, except as modified by this contract.

Board Recognition. Except as otherwise provided in this Agreement, the management of the work force and of the methods of operation is vested exclusively in the Board. Subject to the grievance procedures the Union recognizes the right of the School Board to operate and manage the business of the School District in all respects, in accordance with its commitments and responsibilities, and to alter from time to time, as the necessity arises, rules and regulations to be observed by the employees. Such rules and regulations shall not be inconsistent with the provisions of this Agreement, and shall be communicated to the Union in writing, as will amendments thereto. The selection of the supervisory staff excluded from the bargaining unit, shall be entirely a matter for the Board’s decision.

Board Recognition. For the purpose of determining this bargaining unit only, a Bay de Noc Community College instructor shall be defined as an instructor assigned an average of fifteen (15) or more contact hours per week for a semester, or holds a full-time appointment to the College as an instructor. An instructor, who uses the Summer 1 and/or Summer 2 Semesters to receive credit toward his/her maximum annual load, as provided in the master agreement, continues to be included in the bargaining unit. Instructors electing the off-schedule faculty option will continue to be members of the bargaining unit. Individuals who are employed exclusively 0007 Board Recognition (continued) to staff projects that are primarily funded by state, federal or private sources or contracted vocational classes are not included in this bargaining unit. Individuals who are hired for one semester or less to teach technical classroom-laboratory courses which have a total of fifteen (15) contact hours or less are excluded from the bargaining unit. Individuals who are hired as substitutes for instructors on sick leave, long- term disability, leave-of-absence or emergency leave are excluded from the bargaining unit. Instructors hired for one semester to teach fifteen (15) or more credits under a waiver due to special circumstances are excluded from the bargaining unit.
