Care, Use and Maintenance. Lessee will maintain the Equipment in good operating order and appearance, protect the Equipment from deterioration, other than normal wear and tear, and will not use the Equipment for any purpose other than that for which it was designed. If commercially available and considered common business practice for each item of Equipment, Lessee will maintain in force a standard maintenance contract with the manufacturer of the Equipment, or another party acceptable to Lessor, and will provide Lessor with a complete copy of that contract. If Lessee has the Equipment maintained by a party other than the manufacturer or self maintains, Lessee agrees to pay any costs necessary for the manufacturer to bring the Equipment to then current release, revision and engineering change levels, and to re-certify the Equipment as eligible for manufacturer's maintenance at the expiration of the lease term, provided re-certification is available and is required by Lessor. The lease term will continue upon the same terms and conditions until recertification has been obtained.

Lessee agrees to pay any costs necessary for the manufacturer to bring the Equipment to the equipment specifications as of the Commencement Date, and to re-certify the Equipment as eligible for manufacturer's maintenance by termination of the applicable Schedule whether by expiration or otherwise. Lessee agrees to accept and install all routine engineering updates made available by the manufacturer so as to insure the Equipment is at the current release. The rental term will continue upon the same terms and conditions until recertification has been obtained.
Care, Use and Maintenance. State Entity shall protect the equipment from deterioration, other than normal wear and tear, and will not use the equipment for any purpose other than that for which it was designed. Contractor shall maintain the equipment in good working order and will make all necessary adjustments and repairs. The Contractor shall have full and free access to the equipment for the purpose of maintenance and repairs during the State Entity's normal business hours and subject to the State Entity's operational guidelines, including security regulations. The charge for such maintenance is included in the Response and any final pricing documents as incorporated into the State Entity Standard Contract Form.
Care, Use and Maintenance. Lessee shall, at its sole expense, at all times during the term of each Equipment Schedule, maintain the Equipment in good operating order, repair, condition and appearance and protect the Equipment from deterioration, other than normal wear and tear. Lessee shall not use the Equipment for any purpose other than that for which it was designed. Lessee shall, at its sole expense, enter into and maintain in force, for the term of each Equipment Schedule, an appropriate maintenance contract with the manufacturer of the Equipment, or such other party as shall be acceptable to Lessor, and shall provide Lessor with a copy of such contract and all supplements thereto which are applicable to the Equipment. If Lessee has the Equipment maintained by a party other than the manufacturer, Lessee shall assume any costs necessary to have the manufacturer recertify the Equipment upon the expiration of the Initial Term or any extension thereof, and further, said Equipment will remain on lease pursuant to the applicable Equipment Schedule until such Equipment shall be recertified. For the purposes of this Section, any reference to "Equipment" shall include any software included in any such Equipment Schedule and any reference to "manufacturer" shall mean the Licensor thereof.

Care, Use and Maintenance. During the periods in which the Company has owned or operated the Aircraft, it shall have (a) maintained, serviced, repaired, overhauled and tested; or caused the same to be done to, the Aircraft so as to keep the Aircraft in good operating condition, state of repair and appearance, ordinary wear and tear excepted, and in such condition as to required to enable the Airworthiness Certificate of the Aircraft to be maintained in good standing at all times under Title 49 with the FAA or as required by any other applicable government authority; (b) maintained all records, logs, manuals and other material required by the FAA and Title 49 to be maintained in respect of the Aircraft; (c) promptly furnished its lenders, lessors and others such information as may be required to file any reports required to be filed by the Lessor (or the owner, if other than the Company) of the Aircraft with any governmental authority (d) maintained the engines of the Aircraft in accordance with all maintenance service plans and lender or lessor requirements and maintain the Aircraft, the engines and the main components in accordance with a manufacturer's approved maintenance program or other such program to ensure the Aircraft's eligibility to be placed on another operator's maintenance program; (e) installed all applicable vendor's and manufacturer's service bulletin kits received by the Company that are required for the Aircraft, and incorporated all airworthiness directives; (f) notified all appropriate parties of any notices or similar documents which the Company received from the manufacturer or any governmental agency concerning the maintenance, service, repair, overhaul, testing or use of the Aircraft; and (g) properly maintained the Aircraft in accordance with generally accepted customs and practice.

Upon return of the Equipment, Lessee will provide a letter from the manufacturer certifying that the Equipment meets all current specifications of the manufacturer, is in compliance with all pertinent governmental or regulatory rules, laws or guidelines for its operation or use, is qualified for the manufacturer's maintenance contract and is at then current release, revisions and engineering change levels. If Lessee has the Equipment maintained by a party other than the manufacturer. Lessee agrees to pay any costs necessary for the manufacturer to bring the Equipment to then current release, revision and engineering change levels, and to identify the Equipment as eligible for manufacturer's maintenance at the expiration of the lease term. The lease term will continue upon the same terms and conditions until rectification, has been obtained.

(b) Lessee shall not use the Equipment for any purpose other than that for which it was designated Lessee covenants that the Equipment will at all times be used and operated in accordance with the Manufacturer's instructions and in compliance with any restriction contained in the Manufacturer's warranties regarding the Equipment and with any and all statutes, laws, ordinances and regulations of any government agency applicable to the Equipment Lessee will ensure, by contract or otherwise, that any Equipment affixed to real property does not become the property of the real property owner or any party holding a security interest therein, without the prior written consent of Lessor, and any such Equipment that is so affixed will be affixed subject to such reasonable conditions as Lessor may impose for its protection, and Lessee will provide Lessor with such landlord's and mortgagee's waivers as Lessor may request in connection therewith
