Charter Assignments. (a) Dedicated charter drivers have first priority for all charter assignments.
(b) Charter work will then be assigned to qualified drivers on a rotating basis, whenever possible, based on proximity, route timing, vehicle type and seniority. There will be no rotation for year round weekend contract charters (ex. church charter). Initial assignment will be by seniority.
(c) The Company will advise the assigned driver of the details relating to the charter. The driver will be responsible to obtain the charter paperwork which will be made available by the Company. After a driver completes an assigned charter, he/she cannot obtain another charter until the next rotation.
(d) Every effort will be made to follow the rotation to accommodate last minute requests for emergency field trips and charters. Due to unforeseen circumstances, if it is not possible to follow the rotation, the Company may assign a driver at its discretion.
(e) Drivers with assigned routes may not be eligible to be selected for a charter if their assigned route times conflict with charter departure or return time.
(f) In order to allow for fair distribution of charters, drivers are expected to cover both long and short charters.
(g) A driver may be assigned a charter out of rotation if requested by the customer. The Company will document the details of the request and will provide a copy to the Union Chairperson. In this case the driver will be passed when his/her turn in the rotation arrives. Customer requests may be denied if the request results in increased charter/field trip run time.
(h) It is expected that dedicated charter drivers may be assigned to cover a route when there is no route time charter work. In this case, the dedicated charter driver may be assigned to perform as a spare driver and will be paid the spare driver rate of pay in accordance with Schedule “A”.
(i) Employees may not switch charters with other employees unless approved by the Company or in the case of an emergency, when the Company cannot be contacted.
Charter Assignments. An employee shall not be considered for a charter, if, due to illness, he or she did not work his or her assigned hours on the day of the charter. Excepted from this provision are prescheduled medical appointments.
Charter Assignments. The Borrower has executed on 6 July 2012 and delivered to the Agent the Charter Assignment in respect of each Vessel.
Charter Assignments. The Borrower will procure that, at any time following the first Drawdown Date, no Ship shall be subject to a time charter for a term which exceeds 12 months unless the Agent has been provided with:
(a) an original of an executed Charter Assignment of that time charter (and of each document required to be delivered by that Charter Assignment);
(b) evidence satisfactory to the Agent of the relevant Guarantor’s due authorisation and execution of that Charter Assignment;
(c) favourable legal opinions from lawyers appointed by the Agent on such matters concerning the laws of the jurisdiction of incorporation of that Guarantor and such other relevant jurisdictions relevant to that time charter and/or that Charter Assignment as the Agent may require; and
(d) documentary evidence that any agent for service of process named in that Charter Assignment has accepted its appointment.
Charter Assignments. If an Owner enters into any Charter, the Borrower shall procure that the relevant Owner executes a Charter Assignment in favour of the Security Trustee.
Charter Assignments. Charters (charters are defined as a special trip for a district sponsored or contracted field trip, athletic event, or special activity) will be offered to drivers who have indicated that they are available for charter assignments. Charter assignments shall be offered to the most senior driver who satisfies the qualifications (if any) for the assignment, whose regular assignment does not conflict with the charter assignment, and who has indicated that he or she is available, rotating through the seniority list as many times as may be necessary. An assignment need not be offered to a driver who is known to be unavailable at the time the assignment is made. The District retains the right to determine the length and timing of charter assignments.
Charter Assignments. At any time during the Security Period, in relation to any charter or other contract of employment of any Ship which is equal to or exceeds 24 months in duration (excluding those entered into prior to the date of this Agreement which have a remaining term of less than 24 months as of the date of this Agreement), the Borrower shall procure that promptly following the Agent’s request the Owner which owns such Ship shall execute and deliver to the Security Trustee a Charter Assignment and shall give notice of such assignment to the charterer concerned and shall endeavour to procure that an acknowledgement of such notice is signed and returned to the Security Trustee.
Charter Assignments. To insure that operators in their proper rotation are given the opportunity to either accept or refuse work, with the basic factor being hours of service as determined by D.O.T. regulations. An operator with a schedule the following day may accept extra work only if this extra work is completed in time allowed scheduled operator to have a minimum of eight hours driving time left for the next day. If, for some unforeseen reason, this work is not completed in time to allow operator to report to work the following day on time (in this case the first for work will pull this operator's card out and continue until scheduled operator can legally return to work). This is not to be considered a miss or a catch. It shall be considered a piece of work. The schedule will only be paid for work performed. A list operator who completes his or her day's work too late to report for work the following day at assigned report time, shall report for duty after his or her eight (8) hours off has been satisfied. At that time the operator's day's work will start and eleven (11) hours later the spread time will end. After reporting, the list person falls into proper list position.
Charter Assignments. If the Borrower enters into any time or consecutive voyage charter in respect of any Ship which exceeds, or which by virtue of any operating extensions may exceed 24 months, the Borrower shall execute in favour of the Security Trustee an assignment of that charter in such form as the Agent may reasonably require.
Charter Assignments. The Facility Agent shall have received a Charter Assignment with respect to any Charter in excess of (or capable of exceeding, by virtue of any optional extension) 12 months over each Vessel (on a commercially reasonable basis if the relevant vessel employment agreement expressly prohibits such assignment);
