Your cancelled checks will not be returned to you, but will be imaged and the physical checks will be destroyed shortly after we process your statement. If you have True Blue Online® or True Blue Online® Business banking, you may access electronic images of checks through your online banking. If your account is a business account, you may also receive check images with your statement. You can request copies of the image of your checks or substitute checks in person at one of our branches, or by calling us at 1-888-8CAPFED (0-000-000-0000) and providing us with account number, check number, the amount of the check, and (if known) the date the check was paid. We may charge your account a fee for each copy (including the front and back of the check). We are not responsible for any special or consequential damages under any circumstances for our inability to provide copies of checks. Our liability, if any, will not exceed the face amount of the check in question. You agree to provide us with reasonable proof of any loss. As your agent for collecting checks you deposit with us, we may “truncate” paper checks (i.e. convert them into electronic information or images) and present and return them electronically. We may also truncate paper checks that are dishonored by the drawer’s bank when we represent them. We may reconvert a truncated check into a paper “substitute check” which is the legal equivalent of the original. We may debit your account for truncated or substitute checks or other electronic information or image replacement documents that are replacements for properly payable items.
Check Imaging. Check imaging is a computer-generated image of the front of a check or draft. If your Account includes the ability to have check imaging, your statement will include images of all the checks and drafts presented for payment during your statement cycle. You authorize us to retain and copy at our expense all checks and drafts drawn on your Account. At any time within 7 years after a check or draft is presented, you may obtain a copy of the item upon a written request that sufficiently identifies the requested item. A charge may be imposed for each copy. You agree that by retaining the original check or draft or a copy, we have made the item available to you in a reasonable manner. After a reasonable period of time as determined by us, the original items will be destroyed. If for any reason we cannot provide a copy of an item or satisfy your request by other means, we may be liable for no more than the face amount of the item or your actual damage, whichever is less.

Other than making these images available through OLBS, we will return images of your cancelled or substitute checks with your E-Statement ONLY upon request and subject to a fee (see the Bank’s Fee Schedule). You agree that viewing these images through OLBS is deemed a reasonable manner of making checks or other items available to you for purposes of complying with the requirements of applicable law, including Section 4-406(1) of the New Your State Uniform Commercial Code. Once you receive your statement, you must exercise reasonable care and promptness to examine it and the images available through OLBS in order to discover any unauthorized signature or alteration and you must notify us promptly.

Check Imaging. Check imaging customers receive with their monthly statements electronic images of any checks paid against their accounts, instead of the actual checks. The Bank stores the image of the front and back of checks for seven (7) years during which time copies can be obtained by customers upon request from any of our branches or by calling us at 0-000-000-0000. The Bank stores the actual checks for 90 days from the date of processing, after which they are destroyed. The Bank reserves the right not to image checks that are damaged, written in red ink or are otherwise unclear. In such instances, instead of an imaged check, customers receive information limited to the account number, amount of the check, and the date it was paid.
Check Imaging. Customer will use imaging equipment specified by AB&T to scan paper checks to create an image cash letter file to send to AB&T. Customer agrees to acquire and configure the necessary equipment, compatible workstation operating system, and Internet browser according to the requirements of AB&T, as well as provide sufficiently robust and secure telecommunications services to connect to the third-party web-hosted application system supporting AB&T’s RDC. Customer is responsible for the image quality of all items transmitted to AB&T for processing. In the event that Customer transmits an image of an item that cannot be further processed by AB&T due to the poor quality of the image, as determined by standards generally followed by United States financial institutions, AB&T shall not be responsible for any delay in the processing or presentment of the item. Images captured will be transmitted to AB&T, processed by AB&T, and then sent to the Federal Reserve Bank and/or a correspondent check clearing network, enabling Customer to clear Customer’s periodic check deposits electronically as images, instead of physically transporting the checks to a AB&T office. When necessary, AB&T will prepare “Substitute Checks”, also known as Image Replacement Documents (“IRD”), to facilitate the deposit and collection of Customer’s items. In connection with the use of this process, images received for deposit by the Business Day Cut Off time established by AB&T (see Delivery Specifications in Appendix A) will be treated as same day deposits. Images received for deposit after the cutoff time will be treated as next banking day deposits. Images from Customer transmitted on a non- business day such as Saturday, Sunday, or a Federal holiday observance (see Appendix A) will be processed by AB&T as next business day deposits.
