Conditions of Services. Xxxxxx will measure every boat upon arrival. The length is determined by the expression “over all”. If those dimensions do not correspond to the dimensions specified in the documentation of the ship, rates will be applied for the measures done by Xxxxxx. Any abuse related to the information specified for the dimensions of the vessel will be calculated as compensation for the difference. The additional amount of such compensation shall be equal to the difference between the fees charged for the actual dimensions of the ship and the fee charged for the dimensions of the boat in the documents of the vessel. When the vessel’s arrival at berth, Xxxxxx will make for vessels registered outside EU an inventory list with the inventory and other items from the vessel. The Berth user have to report every change in the inventury list to the Marina. The inventory list will be signed by Xxxxxx and the Berth user. If the Berth user or his authorized person want to do some work or repairs on the boat in Marina are required to previously inform the Marina. The Berth user not authorized to start repairs without written consentby the Marina. Xxxxxx is not obliged to be arany damage to property and is not responsibl efor repairs to thev essel done by the client. Xxxxxxxx authorized tomove the vessel of theclientto a new berthwithout the consent ofthe client. The Berth user is obliged to inform the Marina of anya bsence from the marina for a period longer than one day. Xxxxxx is authorized to temporarilycede the berth to other clients during thea bsence of the Client’s boat from the marina without the priorapproval of the Berth user. During any events, including but not limited to the boat show, in Marina, Xxxxxx reserves the right to change places for mooring of all vessels within the Marine. Before, during and after such events, the ma- rina has the right, in its sole discretion and without prior written notice, move and accommodate vessels to other appropriate berths. Xxxxxxxx obliged to guard the boat. Berth user is not allowed without permission from the Marina to do commercial activity (charter and similar) within and on the piers of the marina.
Conditions of Services. Coverage is not provided for the reimbursement of respite, day care, or educational services and is not used to reimburse a parent for participating in the treatment program. Conditions of Services. (a) Administrator shall perform the Services with due diligence and efficiency, and shall exercise such skill and care in accordance with recognized professional standards.
(b) Manager shall furnish to the Administrator such information, documentation and reports relating to the Services as the Administrator may from time to time reasonably request. Administrator shall maintain and make available to Manager upon reasonable notice and at reasonable times for inspection and copying true and accurate records of its activities in connection with its performance of this Agreement.
(c) Any information, documentation, reports, drawings, proposals, marketing plans or other documents prepared and furnished by Manager are strictly for the use of the Administrator in furtherance of the expressed objective of the Agreement. Unless specifically otherwise agreed upon the information contained in such documents is proprietary to Manager, and Manager grants a limited license to the Administrator for such purpose only. It is agreed that neither the Administrator nor any affiliate or agent shall copy, publish or otherwise disseminate or use any such documents or their contents to any other party or for any other purpose without the prior written permission of Manager.
(d) Manager hereby agrees that it will make available to Administrator upon its request, at its own expense, on a timely basis and at all reasonable times, all relevant documentation, equipment, employees and consultants of Manager to the extent required or desirable for the performance of the Services.
(e) Notwithstanding any other provision contained in this Agreement, in no event shall Administrator be liable for any special, indirect, incidental or consequential damages, such as but not limited to any loss of anticipated profits or revenue, loss of use, non-operation or increased expense of operation of any aircraft or other equipment or facility, cost of capital, claims of customers, or failure or delay in achieving anticipated profits or product or in consummating any transaction. The above limitation does not apply if and to the extent that Manager demonstrates that damage has primarily resulted from gross negligence or willful misconduct of Administrator as a company.
(f) Manager shall release, defend, hold harmless and indemnify Administrator and its employees, officers, directors, agents and subcontractors from and against all claims, losses, damages and judgments, including costs and expenses incide...
Conditions of Services. Pet Owner hereby agrees to the following conditions of Service:
a. If the Pet has had a communicable condition in the last 30 days, a veterinarian certification of health must be provided to the Company;
b. If the Pet is a dog: (i) the dog must be at least 16 weeks (4 months) of age; (ii) the dog must be current on Rabies, Distemper/ Parvo combination (XXXX), and Bordetella vaccinations as specified in the Pet Profile; (iii) the dog shall be kept current on the aforementioned vaccinations and verification of such vaccinations shall be made available to the Company upon request; (iv) the Canine Influenza vaccination is recommended for dogs that are frequently boarded or travel on a frequent basis; (v) year-round flea, tick, and heartworm prevention is required for all dogs;
c. If Pet is a cat: (i) the cat must be current on all Rabies, FVRCP, and FELV vaccinations as specified in the Pet Profile; (ii) the cat must be current on the aforementioned vaccinations and verification of such vaccinations shall be made available to the Company upon request; (iii) year-round flea, tick, and heartworm prevention is required for all cats;
d. Any Pet that requires special attention due to age, medical conditions, or any other restriction, will be assessed by a lodging manager and may incur additional fees as determined by the Company;
e. Pet Owner authorizes the Company to perform the following services for the Pet, if necessary, and Pet Owner further agrees to pay the Company if any of the following services are performed: (i) trimming excessively long toenails; (ii) providing the Pet with a flea bath treatment if fleas and/or ticks are detected; (iii) providing the Pet with food if Pet Owner does not bring an adequate supply of food for the Pet during day care or lodging.
Conditions of Services. Rowan shall not be required to perform any Services that would conflict with its obligations under Section 8(a). Rowan may provide any Service required under this Agreement through its employees or through any of its Affiliates or their employees, or through any agents, contractors or other independent third parties of Rowan or its Affiliates. Era shall provide reasonable cooperation as reasonably necessary from time to time for the performance of Services by Rowan, including timely issuance of any approvals reasonably required hereunder, timely decisions, and written policy guidelines. At Era’s sole expense, Era shall provide working accommodations and equipment to Persons performing Services at Era facilities on behalf of Rowan that are customary and appropriate in connection with Services provided by such Persons.
Conditions of Services. Oregon REALTORS® and the Board agree to the following conditions of services:
(a) Contact for Professional Standards Administration shall be limited to the Association Executive, President, or an appointed Professional Standards liaison.
(b) Professional Standards Administration and activities shall be provided virtually. If an in-person hearing is deemed necessary by the President of the Board, the Board will cover travel expenses of the administrator and the hearing panel.
(c) Professional Standards Administration where a multi-board (or regional) enforcement agreement exists shall require each signatory board to enter this Agreement.
(d) The Board agrees to adopt the Oregon REALTORS® Professional Standards Administration Enforcement policies that conforms the Code of Ethics and Arbitration Manual to comply with local policy and state law.
(e) The Board agrees to adopt Oregon REALTORS® Citation Policy and Schedule of Fines; Oregon REALTORS® policy will supersede The Board’s Citation Policy and Schedule of Fines previously used, if applicable; The Board will inform their members of the Citation Policy and Schedule of Fines.
Conditions of Services. MEDCARE agrees to abide by all the requirements and standards of the Emergency Medical Services Act, Chapter 773, Texas Health and Safety Code, insofar as the same is applicable to MICU ambulance service to be provided by MEDCARE to the CITY under the provisions of this Contract. MEDCARE agrees to:
1. Provide three (3) MICU ambulances 24 hours a day, 7 days a week within the City of Mission at all times.
2. In the event both MICU ambulances are on calls simultaneously, an additional MICU ambulance will be posted at a central station within the CITY when available. Additionally, MEDCARE reserves the right to deploy its Paramedic Advance Responder following the utilization of the CITY'S three (3) assigned units, or upon demand as a result of system wide paramedic unavailability.
3. Be responsible for all hiring of field personnel, dispatching, billing and collections.
4. Save, indemnify and hold harmless the CITY, its officers, agents and employees from any claim, suit, damage, judgment, or attorney's fees incurred by its arising out of or in any way related to any claim against CITY or its employees which arises out of providing the ambulance services outlined in the Contract.
5. Cooperate with and respond to the Ambulance Advisory Board and the Fire Chief, Emergency Management Coordinator or designee on matters related to ambulance service and patient care.
6. Provide reports to the CITY, including the type of run, response time, deposition of patients and any unusual circumstances upon request.
7. Provide emergency ambulance services at a reasonable cost to the citizens of the City based on the usual and customary rate schedule. The proposed average user fee is attached as Exhibit A.
8. Produce an average response time of ten (10) minutes or less on 92% of all priority-1 defined life threatening emergency requests, as determined by the Dispatcher in strict accordance with approved telephone protocols originating within the primary area of responsibility set out herein
9. Produce an average response time of (15) minutes or less on 90% of all priority -2, those defined as non-life threating requests as determined by the Dispatcher in strict accordance with approved telephone protocols originating within the primary area of responsibility set out herein.
10. Notify the Police or Fire Department of the CITY Immediately upon observance of any unusual circumstances in conducting an ambulance run, either emergency or non-emergency.

You are required to provide accurate and correct personal information while registering to use the services rendered by GOSHOPE and You agree to keep it up-to-date. We have the right to verify the Information provided by You in reasonable circumstances if required.
Conditions of Services. OAR and the Board agree to the following conditions of services;
(a) Contact for Professional Standards Administration shall be limited to the Executive Officer, President, Grievance Committee chairman, or the Professional Standards Committee chairmen of the Board.
(b) Professional Standards Administration shall be provided at the OAR office.
(c) Location for hearings shall be determined by the Professional Standards Administrator after consultation with the Professional Standards Committee chair.
(d) Professional Standards Administration where a regional enforcement agreement exists shall require each signatory board to enter this Agreement.
(e) The board is responsible for providing to OAR a list of committee members serving on the boards Grievance and Professional Standards Committee.
(f) The board must establish a minimum of at least 10 members to serve on each of these committees or participate in a multi-board (or regional) professional standards agreement with other associations or with the state association.
