Conditions of Taking Leave. (i) Where a Teacher has become entitled to long service leave in respect of the Teacher's service with the school, the school shall give to the Teacher and the Teacher shall take the leave as soon as practicable having regard to the needs of the school provided always that unless the school otherwise agrees the Teacher shall give not less than two school termsnotice of the Teacher's wish to take leave and further provided that the school shall give the Teacher not less than two school terms' notice of any requirement that such leave be taken. (ii) Where long service leave is taken so that it commences on the first day after a period of pupil vacation, which falls between school terms, and concludes on the last day prior to a period of pupil vacation which falls between school terms, such long service leave shall be exclusive of the pupil vacation periods occurring prior to, within and following the period of long service leave. A period of long service leave taken wholly within one term shall also be exclusive of pupil vacation periods adjacent to the period of leave, if the taking of long service leave of less than one term has been approved by the school. (iii) Where a Teacher requests and is granted up to one week's leave without pay to be taken in addition to long service leave such that the total period of leave is in accordance with clause 12.3(d)(ii) the conditions of that clause shall apply, provided nothing in this paragraph shall affect the provisions of clause 10.6. (iv) A Teacher may request to take long service leave at half pay and the School may approve such request. Where such request is granted, any period of non- term time falling within the period of leave (but not adjacent to the period of leave) will be paid at half pay. Provided however that in the case of the school summer non term time, the payment shall be calculated in accordance with the provisions of clause 10.7 Teachers Whose Hours Have Varied and clause 10.3 Calculation of Payments, as if the period of leave on half pay were a period of part-time work. (v) A Teacher may request to take long service leave in a short block of one week or more and it is up to the School’s discretion whether to approve the leave. (vi) Where long service leave is not taken in full term periods or in accordance with clause 12.3(d)(ii) it will be inclusive of pupil vacations, other than the four weeks of annual leave at the commencement of the school summer vacation. Conditions of Taking Leave. (a) It is the intention of the parties that the number of days of long service leave accrued by the Teacher can be taken at the Teacher’s current FTE when the long service leave is taken. For example, a Teacher works full-time for their first ten years of employment and then reduces to 2.5 days per week (0.5 FTE) for the next five years of their employment. Conditions of Taking Leave. (a) It is the intention of the parties that the number of days of long service leave accrued by the Teacher can be taken at the Teacher’s current FTE when the long service leave is taken. For example, a Teacher works full-time for their first ten years of employment and then reduces to 2.5 days per week (0.5 FTE) for the next five years of their employment. The Teacher would accrue 65 days of long service leave for their first ten years of service and then 25 days of long service leave over their next five years of service, a total of 90 days long service leave. If the Teacher works 2.5 days per week (0.5 FTE) at the time they commence leave, the Teacher would be entitled to take their 90 days of long service leave over 36 weeks. (b) Where a Teacher has become entitled to long service leave in respect of the Teacher’s service with an Employer, the Employer will give to the Teacher and the Teacher will take the leave as soon as practicable, having regard to the needs of the Employer, provided always that unless the Employer otherwise agrees, the Teacher will give not less than two school terms notice of the Teacher’s wish to take leave, and further provided that the Employer will give the Teacher not less than two school terms’ notice of any requirement that such leave be taken. (c) A Teacher may request and be granted leave without pay to be taken in addition to long service leave such that the total period of leave comprises a complete school term. (d) Long service leave will be exclusive of pupil vacation periods adjacent to or within the period of leave. Provided however that in the case only of a Teacher who wishes to take a short block of long service leave immediately before or immediately after a pupil vacation period but not in accordance with subclause 15.10

(c) Where long service leave is taken in full term periods it will be not be inclusive of the pupil vacations preceding and subsequent to that term. Where long service leave is not taken in full term periods or in accordance with clause 17.3(b) it will be inclusive of pupil vacations. (d) Where a teacher is entitled to an amount of long service leave which is in excess of a school term the teacher may elect not to take that part of the long service leave which is in excess of a term [the deferred leave], until such time as the teacher accumulates further entitlements which when taken together with the deferred leave enables long service leave to be taken for a whole term.
Conditions of Taking Leave. (a) In accordance with the LSL Act an Employee entitled to long service leave will be granted such leave: (i) as soon as practicable, having regard to the needs of the School, after the Employee becomes entitled to the leave; or (ii) if the School and Employee agree in writing to postpone the taking of the leave - at another time or times. (b) Long service leave will generally be taken in blocks of at least one School term. However, a School may agree to allow an Employee to take long service leave in smaller blocks, including single days, subject to the operational needs of the School. (c) The School will give the Employee at least 1 months’ notice of any requirement to take leave unless the Employee agrees to a shorter period.

A teacher should give adequate notice of his/her wish to take leave, to allow for replacement staff to be employed, if applicable. The employer shall give the teacher not less than two school termsnotice of any requirement that Long Service Leave is to be taken by the teacher. (b) A teacher may request and be granted leave without pay to be taken in addition to long service leave such that the total period of leave comprises a complete school term. (c) Where a teacher is entitled to an amount of long service leave which is in excess of a school term the teacher may elect not to take that part of the long service leave which is in excess of a term (the deferred leave), until such time as the teacher accumulates further entitlements which when taken together with the deferred leave enables long service leave to be taken for a whole term. (d) Long service leave will not include student vacation periods that might fall within the period of leave.

Conditions of Taking Leave. The general conditions of taking leave are in accordance with the State or Territory legislation of the primary location of work for an Employee, or the conditions of an Employee’s entitlements under the National Employment Standards under the Act where they are more advantageous than the state or territory legislation of the primary location of work for an Employee.
Conditions of Taking Leave. (1) The general conditions of taking leave are in accordance with the Long Service Leave Act (NSW) 1955. In addition to the conditions in the Act, the following will apply pursuant to this agreement: (i) Where an employee has become entitled to long service leave in respect of the employee's service with RIDBC, the employee shall take the leave as soon as practicable having regard to the needs of RIDBC provided always that unless RIDBC otherwise agrees the employee shall give not less than one term’s notice of the employee's wish to take leave and further provided that RIDBC shall give the employee not less than one term’s notice of any requirement that such leave be taken.
