Constraints on how the Contractor. Provides the Service The Supervisor or the end user need to be assured that all requested work was executed in accordance with the scope and that the report’s, invoices, certificates and accompanying documentation is handed over to him before signing off the Task Order. The Start and Completion date must be agreed upon prior to signing the Task Order. Late completion may result in penalty clause being applied as per contract document. Original tax invoices must be submitted to the contract owner containing all the relevant mentioned above. On completion of each task, the Tax Invoice with a copy of the Task Order, Completion Certificate and the Completion certificate attachment must be submitted to the contract owner. Any deviation from the planned work must be adjusted on the Tax Invoice. The Contractor must ensure that his invoice is according to the exact work completed on site. No work may be claimed that has not been completed. If work is claimed which is not complete this will be seen as a fraudulent claim which may lead to termination of the contract. The Contractor will submit the claim as per agreed upon date as per the NEC Payment Certificate format attached to this contract, supporting Xxxx of Quantities. The contract number must be clearly visible on the Tax Invoice. The contract owner will assess Payment certificates on actual work completed. Any possible issues regarding the claim will be addressed by the contract owner to the Contractor. On acceptance of the Payment Certificate by the contract owner, the Contractor submits his invoice as agreed upon with the contract owner. Payment will take place as per the Eskom Procurement’s Invoice Payment Processes.

The site is not available for occupation by the Contractor until 02 May 2022. All works must be complete by 30 September 2022, preferably earlier to extend regrowth period for any vegetation re-establishment. All ‘in river’ work areas must be suitably bunded to form secure, fully enclosed, dry working area. Access to the Bridgetown Xxxx site includes a designated public bridleway and via a private riparian field. Use of banks-persons to accompany movements of machinery is required when transporting machinery across the public bridleway, and appropriate signage put in place. Site machinery and power tools are not to be used outside of the hours 9:00am - 18:00hrs. Recreational radios are not permitted whereby they can be heard outside of any machinery cabins further than 20 metres away. Please respect the desires of the riparian owners and keep disturbance to a minimum where practicable for patrons of the caravan park and campsite. There must be continual flow of river water permitted to the mill leat. The mill leat is supplied by licenced abstraction and therefore must not be allowed to run dry. If dewatering activities to provide safe dry working areas risks blocking the river flow to the leat, mitigation must be considered e.g. over-pumping with an appropriately sized water pump. The appointed contractor has to provide a safe method of work for entering the site and secure suitable working areas. The site is, as far as practical, to be left in an ‘as found’ condition, or suitably repaired so as to return to ‘as found’ condition in a reasonable timeframe e.g. levelled and appropriately seeded for regrowth. 10 Contract Data Works Information

It is the Contractor’s own responsibility to get authorized in terms of the Eskom Plant Safety Regulations. The Contractor must be fully authorized within 2 months after the contract placement. Constraints on the sequence and timing of work exist due to other contractors also performing work on the same plant. The Contractor will liaise and plan with these contractors for access.

Access to the Craigshill Wood site is via a private forestry track; all access to and from the site is to be in close liaison with WRT. The appointed contractor has to provide a safe method of work for entering the site and secure suitable working areas. State what the use of the works is intended to be at their Completion as defined in Clause 11.2(1). A Programme shall be submitted with the tender response. A Xxxxx chart programme is required to indicate the sequencing of the works and the inter-relationship of the activities and periods for planning, mobilisation and design.   • Responsibility of the Contractor The Contractor shall be responsible for the quality, technical accuracy, and the coordination of all deliverables and other services furnished by the Contractor under this Contract.   • INDEPENDENT CAPACITY OF THE CONTRACTOR The parties intend that an independent contractor relationship will be created by this contract.
