Contractor Assurances. Unless exempted, Contractor hereby certifies that:
Contractor Assurances. In addition to the Funding Assurances, the security deposit and any other payment or performance required under this Agreement, Lessee shall at least two weeks before the commencement of any construction work by Lessee under this Agreement having an estimated cost of more than Thirty Thousand Dollars ($30,000) provide to Lessor evidence of the following assurances in favor of Lessee that Xxxxxx’s contractors will timely and properly complete and pay all suppliers and subcontractors for the work completed (the “Contractor Assurances’’) as follows;
Contractor Assurances. The following provisions are binding upon the prime contractor who must also include these provisions in every subcontract, so that such provisions will be binding upon each subcontractor:
Contractor Assurances. 1. XXXXXXXXXX agrees to employ and train the participant enrolled in the TSE Program in the skills necessary to become a regular full time unsubsidized employee in the occupation specified on Exhibit “A” of this Agreement. XXXXXXXXXX assures that participant/trainee(s) has been hired for a position presumed to be permanent, subject to trainee's overall performance, the employer's needs and personnel practices.
2. CONTRACTOR shall select an applicant from persons referred by the INTERMEDIARY, the COUNTY or authorized agent. The CONTRACTOR retains the right to select or reject trainees(s) from the persons referred. Accordingly, the CONTRACTOR absolves INTERMEDIARY, the COUNTY or authorized agent of responsibility in the final selection of any trainee and agrees to indemnify and hold South Bay Workforce Investment Board, Inc./South Bay One-Stop Business & Career Center harmless from the selection of any trainee(s).
3. CONTRACTOR assures that it will comply with Title VI of the Civil Rights Act of 1964 (P.L. 88-352), with the regulations at 29CFR Parts 31, 32, and 34, and with all other applicable federal and State laws, rules, and regulations, including U.S. Executive Order 11246, as amended by U.S. Executive Order 11375 and supplemented by 45 CFR Part 60, which provides that no individual shall on the grounds of race, creed, color, handicap, national origin, sex, age, political affiliation or beliefs be excluded from participation. The CONTRACTOR further assures not to employ legally-prohibited discriminatory practices of any kind and to take positive measures to assure that equal employment opportunities, including recruitment, employment, training, and promotion in all job classifications, are made available without regard to race, color, religion, sex, age, national origin, physical or mental handicap, marital status, or political affiliation as required by Federal and State laws and regulations and by the State Welfare and Institutions.

Contractor Assurances. The Contractor agrees to maintain the TIDs and sell and deliver TIDs, components and enhancements in conformity with the terms of this Contract and any applicable requirements set forth in the Operating Manual. From and after the effective date of this Contract, and unless and until otherwise notified in writing by the Supervisor, the Contractor shall continue to provide the all services which it was providing under the Previous Contract at the time such Previous Contract expired.
Contractor Assurances. Contractor hereby assures the Agency that it does not request Disenrollment for reasons other than those permitted under the Contract. See: 42 C.F.R. § 438.56(b)(3); 42 C.F.R. § 457.1201(m); 42 C.F.R. § 457.1212. {From CMSC B.5.06}.
Contractor Assurances. The Arena Group shall contractually obligate the General Contractor to provide the following assurances to protect the City and the Arena Group during and after construction: (i) procedures to ensure payment to and performance by the General Contractor's subcontractors, including payment and performance bonds to be furnished by those subcontractors if required by the Arena Group, (ii) indemnification (which shall include commitments to defend and hold harmless) consistent with indemnification provisions customarily provided by prime contractors for City-owned construction projects with a scope similar to that of the Arena Complex, and (iii) insurance, including, but not limited to, commercial liability, all-risks builders risks, workers compensation, errors and omissions/professional liability insurance for any engineering or design work (if applicable), auto liability and excess umbrella coverage, each in form and substance not less than is customary for a City-owned construction project with a scope similar to that of the Arena Complex. Each such indemnity and insurance policy shall name both the City and the Arena Group, and the Arena Group's affiliates, as joint indemnitees and as additional insureds, as the case may be. The City may from time to time request in writing that the Arena Group furnish to the City evidence of the insurance provided by the General Contractor.
Contractor Assurances. Contractor gives assurances that:
1. The services will be performed exclusively by Contractor and that Contractor shall not be under the direction and control of The College;
2. Contractor is responsible for obtaining all assumed business registrations or professional occupation licenses required by state law or local government ordinances;
3. Contractor will furnish the necessary tools or equipment;
4. Contractor has the authority to hire and fire employees to perform labor services;
5. Payment for the labor or services is made upon completion of the performance of specific portions of the project or is made on the basis of an annual or periodic retainer;
6. The individual or business entity providing labor or services is registered under ORS Chapter 701, if the individual or business entity provides labor or services for which such registration is required;
7. Federal and state income tax returns in the name of the business or a business Schedule C or farm Schedule F, as part of the personal income tax return, were filed for the previous year if the provider performed labor or services as an independent Contractor in the previous year;
8. Labor or services are performed by an independently established business. (Meets four of six requirements below)
a. labor or services are primarily carried out at a location separate from the residence of the individual who performs the labor or services, or in specific portion of the residence which is set aside as the location of the business;
b. commercial advertising or business cards are purchased for the business, or individual has trade association membership;
