Court Appearance Time. Employees who are required to return to make court appearances at a time not contiguous to the beginning or end of their shift, shall be paid a minimum of two (2) hours at time and one- half (1½) for such required court appearances. In the event the employee is held beyond the guaranteed two (2) hour period, he shall be compensated at time and one-half (1½) to the nearest tenth (10th) for the period of time his presence is required by the court. The City reserves the right to implement a system whereby officers shall be required to contact the appropriate court liaison unit on the date of a scheduled court appearance for approval to attend. In the event this program is implemented, the officers shall be compensated for one (1) hour at the overtime rate for each date that a call is made and a court appearance is not required. When an appearance is required, compensation will occur as set forth in the preceding paragraph and the one (1) hour compensation will not result.

During the fiscal years covered by this Memorandum of Understanding court appearance time during regular scheduled days off of employees shall be kept to a minimum insofar as the City is reasonably able to control such court appearance time. Employees who appear in court during their off duty hours shall receive a minimum of four (4) hours pay at the overtime rate. Employees who are scheduled to appear in court during their off duty hours and whose appearance is canceled on the scheduled day of appearance shall receive four (4) hours pay at their straight time hourly rate. In the event it is necessary to obtain evidence immediately prior to the actual court appearance, up to thirty (30) minutes of overtime may be authorized immediately prior to the specified court appearance time. Court overtime shall also include the action time necessary to travel to the designated court location from Hayward Police Department or from the employee’s residence, whichever is closer. Any overtime necessary to obtain evidence and/or travel to the designated court location shall be counted towards satisfying minimum guaranteed overtime compensation. No more than two (2) guaranteed minimums shall be paid in any one day. In the event two (2) or more court appearance times are contiguous or overlap, only one (1) minimum guarantee shall apply. Should actual appearance be required on a case, and the employee is not released in sufficient time to appear for subsequently scheduled cases, the subsequent cases shall not be subject to the minimum guarantee. Guaranteed minimums shall apply only one time per case per day unless a subpoena is issued for a different time of day, and provided that it is neither contiguous to or overlaps the compensable time period of the first subpoena. In order to qualify for minimum guarantees at the time-and-one-half rate, employees must physically respond to the designated court location and must remain there until released by competent authority. In lieu of physically responding to a court location, employees may call to learn if an appearance will actually be required. Employees who are required to appear in any Court or administrative proceedings during off duty hours shall be paid for a minimum of two (2) hours at one and one- half (1 ½) times their regular hourly rate. If the employee spends more than two (2) hours in court, the employee shall be paid the one and one-half (1 ½) times their regular hourly rate for the total hours. The employee agrees to see that all witness fees are paid that the employee is entitled to and the employee agrees to turn such fees over to the City. Failure of the employee to apply for the witness fees shall result in the amount of the witness fee that would have been received being deducted from the applicable pay under the provisions of this section, excluding reimbursement for meal and/or mileage if applicable. The City agrees to provide a City vehicle for the employee to drive directly to and from any required court appearance, unless required to stop at any law enforcement agency.

In the event the Officer is working the 11:00 p.m. to 7:00 a.m. watch, and spends more than five (5) hours in Court, he shall not be required to report to work if scheduled for that same day. However, the time will be charged against his sick leave and he must notify the Watch Commander.

An employee who is required to appear in court in an official capacity, shall be compensated at the rate of 1.5 times the employee’s enhanced hourly rate of pay for time spent in such court appearances when the court appearance does not occur during the employee’s normally scheduled hours of work.

Court Appearance Time. In no event shall an EMPLOYEE receive any form of compensation (including vacation, comp time off, or flex time off) for time the EMPLOYEE appears in court except as provided in this provision. The term court is defined as court related to work purposes only. EMPLOYEES shall not receive compensation for personal court time.
1. An EMPLOYEE shall be compensated at their regular rate of pay for each hour the EMPLOYEE must appear in court while the EMPLOYEE is working their regularly scheduled shift.
2. An EMPLOYEE shall be compensated at time and one-half their regular rate of pay for each hour the EMPLOYEE must appear in court while the EMPLOYEE is not working their regularly scheduled shift (off-duty time). However, an EMPLOYEE shall be compensated at their regular rate of pay for appearances in court if the EMPLOYEE schedules less than three days off (i.e., vacation, comp- time off, or flex-time off) after receiving the subpoena or being ordered to court and the court appearance occurs during such planned time off. In this event, the court appearance will be compensated as provided in provision B, 1 and will constitute time working a regularly scheduled shift.
3. For appearances occurring during off-duty time, a minimum of four (4) hours per appearance will be granted. When the appearance does not require the EMPLOYEE to be physically present (i.e., DMV telephone appearance) a minimum of two (2) hours per appearance will be granted.
a. Time spent responsive to the subpoena or order to appear in excess of the minimums will be compensated at time and one-half the EMPLOYEE’S regular rate of pay.
b. The four (4) hour minimum commences once the employee begins their travel to court, which shall not exceed one and one-half (1½) hours prior to the time indicated on the subpoena or the time the employee is ordered to appear.
c. The court minimum times do not apply if the scheduled appearance is two (2) hours or less from the beginning or end of a regularly scheduled shift. In these cases, the time will be compensated as a shift extension as provided in provision A.
d. In cases where multiple subpoenas are received for the same day, multiple minimum hour blocks will be granted only where there is a break between the end of the first minimum block and the beginning of the second minimum hour block.
