CRIMINAL JUSTICE INFORMATION SERVICES. (CJIS) DSM is providing CJIS compliant IT services in its Florida Data Centers. These services are subject to the CJIS Security Addendum, a uniform agreement approved by the US Attorney General that helps to ensure the security and confidentiality of CJI required by the CJIS Security Policy. It also commits the hosting entity to maintain a security program consistent with federal and state laws, regulations, and standards, and limits the use of CJI to the purposes for which a government agency provided it. Law enforcement and other government agencies in the United States must ensure that their use of IT services, including Cloud, for the transmission, storage, or processing of CJI complies with the CJIS Security Policy, which establishes minimum security requirements and controls to safeguard CJI. In order to comply with CJIS Security Policies DSM will restrict physical access to the CJIS facilities to Customers and Vendors subject to the completion of Awareness training and background checks.

CRIMINAL JUSTICE INFORMATION SERVICES. If applicable, the Grantee and all applicable employees and/or subcontractors must be in compliance with all applicable data security rules and regulations. Grantee must maintain an overall understanding and provide the current level of compliance with Federal Bureau of Investigation’s Criminal Justice Information Services (FBI CJIS) Security Policy 5.4, and related security policy(ies) or its successor version(s), including the CJIS Security Addendum, attached as Exhibit A, and the CJIS Security Addendum Certification, attached as Exhibit B, as well as the Minnesota Bureau of Criminal Apprehension’s Minnesota Justice Information Services (BCA MNJIS) security requirements outlined in FBI CJIS requirements document(s) and BCA Security Policy 5050, or its successor version(s). If applicable, Exhibit A and Exhibit B will be completed by Grantee. HIPAA Compliance If applicable, the Grantee agrees to comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA, public law #104-191) and its amendments. The Grantee also agrees to comply with the HIPAA Privacy requirements, the HIPAA Standards for Electronic Transactions, the HIPAA Security requirements, the HIPAA Enforcement Rule, the HIPAA Breach Notification requirements, and any other applicable HIPAA laws, standards and requirements now or as they become law, including any future guidance issued by the Secretary of Health and Human Services. Because the Grantee's function or service, described in Section 1, Grantee Duties, will involve the disclosure of Protected Health Information (PHI) by the County, or the creation, use or disclosure of PHI by the Grantee on behalf of the County, the County (Covered Entity) is required to enter into a separate Business Associate Agreement (BAA) with the Grantee (Business Associate). The BAA ensures that the Grantee's performance under this contract (the Covered Agreement) complies with the privacy and security requirements under HIPAA and the Health Information Technology for Economic and Clinical Health Act of 2009 (HITECH ACT). Consequently, the Grantee agrees to the terms and conditions of the BAA, attached hereto and incorporated herein by reference as Exhibit 1, and the parties further agree that the electronic approval of this contract also constitutes approval of the BAA.

CRIMINAL JUSTICE INFORMATION SERVICES. MFJ shall comply with County’s security procedures that are in effect during the term of this Agreement regarding the security of County’s criminal history record information. Specifically, every MFJ agent, employee, contractor, or subcontractor who will have access to CHRI pursuant to this Agreement shall complete execute and comply with the CJIS’s Security Addendum, which is attached hereto as “Appendix A-2” and incorporated herein for all purposes.

  • Handling Sensitive Personal Information and Breach Notification A. As part of its contract with HHSC Contractor may receive or create sensitive personal information, as section 521.002 of the Business and Commerce Code defines that phrase. Contractor must use appropriate safeguards to protect this sensitive personal information. These safeguards must include maintaining the sensitive personal information in a form that is unusable, unreadable, or indecipherable to unauthorized persons. Contractor may consult the “Guidance to Render Unsecured Protected Health Information Unusable, Unreadable, or Indecipherable to Unauthorized Individuals” issued by the U.S. Department of Health and Human Services to determine ways to meet this standard.
