Derogatory Information. The District will not base an evaluation of an employee on derogatory information regarding the employee from parents, students, other employees or members of the public unless or until the employee has been provided such information in writing and given an opportunity to comment thereon. The written information provided to the employee for comment will include notice of the employee's right to comment. The written information and the employee's comment, if any, will be placed in the employee's personnel file.

Derogatory Information. Information of a derogatory nature shall not be entered or 10 filed until after the unit member has been informed of his/her right to review and 11 comment thereon. A unit member shall have the right to enter and have attached to 12 such derogatory statement his/her own comments. Such review shall take place during 13 normal business hours, and the unit member shall be released from duty for this purpose 14 without salary deduction.

If subsequent to the entry of derogatory information into the personnel file, a District investigation determines that the information is inaccurate in a material respect or unsubstantiated, it shall be removed from the file and shall not be used in any decision affecting the discipline, employment status or assignment of the professor. Derogatory information may not be used for any disciplinary action after three years of its placement in the personnel file. Any derogatory material three or more years old shall be sealed and not available for review.

Derogatory Information. 17.2.1 No materials derogatory to a unit member’s conduct, service, character or personality shall be placed in the files unless the unit member has had an opportunity to read the material. Information of a derogatory nature shall not be entered or filed unless and until the employee is given notice and an opportunity to review and comment thereon. 17.2.3 An employee may request the update of his/her file with materials relevant to his/her position such as course work and driving certificates. 17.2.4 No secret file or any materials, record or the like, may be kept on any unit member for any purpose. 17.2.5 Official grievances filed by an employee under the grievance procedures as outlined in this contract shall not be placed in the personnel file of that employee. A separate file shall be maintained for grievances.

Such review shall take place during normal business hours and the unit member shall be released from duty for this purpose without salary reduction. The unit member shall have the right to be accompanied by a designated representative.
