Design Change Sample Clauses
Design Change. (a) “Design Change” is a change in work and/or materials shown in the Sched- ule of Items and described in Plans or specifications that has been mutually agreed to in writing or ordered by Con- tracting Officer. Changes of a minor nature (such as adjustment in horizontal and vertical alignment, that do not ex- ceed specified tolerance, necessary to maintain or balance earthwork quantities substantially as designed) and varia- tion in quantities, as described in F.2.5.1, shall not be considered Design Changes.
Design Change. The School Council may vary the Specifications by giving the Supplier at least 18 months' notice of the variation (or such lesser period as is agreed between the parties).
Design Change. (I) If the planning changes approved by the planning administration authority and the following design changes of the construction drawings and design documents of building project as consented to by design entity affect the quality or use functions of the Commercial House purchased by the Buyer, the Seller shall give a written notice to the Buyer within 10 days after the design examination entity approves such changes:
1. The structure form, type, space dimensions, facing direction and use of the Commercial House; 2. ´;
Design Change. If the Purchaser requests and the Contracting Officer agrees to a design change of a substantial nature to any road, road structure, or bridge required to be constructed or improved under the terms of this contract, or, in the absence of such a request, the Contracting Officer determines that a design change of a substantial nature is needed, the total actual purchase price shall be revised to reflect the estimated increase or decrease in cost from such design change. A design change of a substantial nature is one that would result in a cost adjustment of $2,000 or more.
Design Change. 6.1 The following will apply to the Owner’s requests for amendments to the Design:
(a) revisions to Submittals required by the Owner under the processes described in this Schedule 2 – Review Procedure are not Changes and will be completed at the Design- Builder’s cost, except to the extent that any such requested revision would constitute a change to the Statement of Requirements, in which event:
(i) for a material change to the Statement of Requirements, the terms of Part E - Changes will apply and such revision will not be implemented except under a Change Order or Change Directive issued by the Owner; and
(ii) for other changes to the Statement of Requirements, the parties will agree a process to address such minor changes, together with minor changes proposed by the Design-Builder; and
(b) if and to the extent the Owner requires a variation of any Design included in a Submittal that has previously been assigned a “REVIEWED” comment by the Owner or has been deemed “REVIEWED” pursuant to this Schedule 2 – Review Procedure (other than a variation required to bring the Design into conformity with this Agreement), then such variation will be a Change and the terms of Part E - Changes will apply.
Design Change. (I) If the following design changes of the construction drawings and design documents of the building project affect the quality or use functions of the Commercial House purchased by the Buyer, the Seller shall give a written notice to the Buyer within 10 days after the design examination unit entrusted by the planning administration authority approves such changes:
1. The structure form, type, space dimensions and direction of the Commercial House;
2. Means of heating; 3. N/A ; 4. N/A; 5. N/A. If the Seller fails to notify the Buyer within the specified term, the Buyer is entitled to surrender the house.
(II) The Buyer shall reply in writing whether or not to surrender the house within 15 days from the service of the notice. Otherwise, the Buyer is deemed as accepting such changes.
(III) If the Buyer surrenders the house, the Seller shall refund the house price already paid by the Buyer within 60 days from the service of the notice of surrender, and pay the interest accrued thereupon at the one-year interest rate for time deposits published by the People’s Bank of China. If the Buyer does not surrender the house, the Buyer shall enter into a separate supplementary agreement with the Seller. N/A
Design Change. Less Complex Approval (Established Approval Process; Minimal/No Certification Effort; Low NRE Costs)
Design Change. 16.4.8.1 The Employer has the right to change, add or decrease the Project at any time, with the costs calculated separately; however, such costs must be estimated by the Contractor and shall not take effect unless being confirmed by the Employer.
16.4.8.2 The Contractor may propose for change of the design if it encounters unpredictable conditions or if the reality differs greatly from the design drawings.
16.4.8.3 If the Employer considers it necessary to change the Project, it shall inform the Contractor in writing and the Contractor shall do as required and shall not refuse with other excuses or have objections.
16.4.8.4 Where change of the Project involves increase or decrease of work quantities, the amount of increase or decrease of the works payment shall be calculated based on the increased or decreased work quantities confirmed by the Employer and the unit price attached in the Contract. The reasonable unit price of any increased work shall be negotiated by the Parties.
16.4.8.5 If the change of the Project involves extension or reduction of the construction duration, the Contractor shall file an application as specified and the Employer shall verify the days of the construction duration to be extended or reduced based on the particular conditions.
16.4.8.6 The decision on increase or decrease of project payment and construction duration due to change of the Project shall be incorporated as effective attachments in writing into the Contract after the Parties agree.
16.4.8.7 For the increased works beyond the scope of drawings, if the Contractor refuses to execute such works or if the quotation is not acceptable to the Employer, the Employer has the right to entrust the execution of such works to other contractors. However, the Contractor shall still handle the procedures for completion acceptance and shall not xxxxx the relevant responsibilities.
Design Change. Complex Approval (Resource-Laden Approval Process; Significant Certification Effort; High NRE Costs)
Design Change. Developer has asked the City to approve design changes within the Project Plans for the Parking Garage. In consideration for the City’s approvals, and to reimburse the City for the loss of future parking revenues, Developer agrees to tender to the City, within 30 days of invoice the “ Parking Adjustment Charge .” The Parking Adjustment Charge shall be an amount equal to $25,000 multiplied by the net number of full size parking spaces originally reflected within the Project Plans that are either eliminated or reduced as a result of the approved design change.
