Discipline and Discharge Grievances. (a) If an employee believes he/she has been unjustly disciplined, suspended or discharged, such employee and/or shop xxxxxxx may present a written grievance to the appropriate Manager within 15 calendar days of the action taken by the Employer. The employee's grievance shall be initiated at Step 2 of the grievance procedure as set out in this article.
(b) When an employee has been disciplined, the employee and the Union shall be provided with a copy of the discipline notice to be placed on the employee's personnel file. If the employee is required to sign, acknowledging receipt of the discipline notice, it is agreed that the employee's signature only confirms receipt of the notice and not acceptance of the validity of the action taken by the Employer.
Discipline and Discharge Grievances. 1. A discipline or discharge grievance under this Subsection is defined as any dispute between the Company and a Flight Attendant regarding that Flight Attendant's discharge from employment with the Company or discipline issued to that Flight Attendant. Discipline under this Subsection is defined as any derogatory report or action by the Company, which may result in a loss of pay, discharge from employment, and/or form the basis for further discipline. A Flight Attendant will not be disciplined or discharged without just cause.
2. Discipline or Discharge grievances must be filed with the Director of Inflight, or her/his designee, within fourteen (14) calendar days of the Flight Attendant's receipt of notice of discipline or discharge from the Company. The affected Flight Attendant or the Association may file a grievance.
Discipline and Discharge Grievances. 1. The Company will provide the Flight Attendant with written notice of discipline, including a short, concise statement of the reason(s) therefore. Such notice will be delivered to the Flight Attendant in person, by certified mail, return receipt requested, or by other commercial delivery service with tracking capability. Copies of the written notice will be issued to the MEC Grievance Chair via email, but the inadvertent failure to provide such notice will not prejudice the disciplinary action.
2. A Flight Attendant who is disciplined, or a union representative acting on her/his behalf, may appeal the Company’s decision by filing a written grievance with the General Manager, Inflight, or her/his designee. Delivery of the grievance will be in person or by mail. Such grievance must be received by the General Manager, Inflight, or her/his designee, no later than fourteen (14) calendar days following the Flight Attendant’s receipt of the Company’s written notice of discipline.

Discipline and Discharge Grievances. Grievances arising from the suspension or discharge of an employee will be filed at Step 2 in accordance with Clause 8.4.

Discipline and Discharge Grievances. Employee who alleges that disciplinary action was without just cause may file a grievance under the provisions of Article 18. It is understood that a Graduate Employee’s right under this Agreement to grieve disciplinary action applies only to the Graduate Employee’s performance and conduct as an employee. Graduate Employees dismissed from their work assignment must be provided written notification describing the reason for the termination. Graduate Employees may not grieve under this Agreement decisions to impose sanctions for academic reasons or violations of the Student Conduct Code.

Discipline and Discharge Grievances. An employee who has been discharged shall be given a reasonable opportunity to meet with his/her Union Xxxxxxx before leaving the Employer’s premises. If necessary, because of the circumstances giving rise to his/her discharge, an employee may be sent to meet the Union Xxxxxxx at a location off of the Employer’s premises.

A pilot may protest the Company’s action(s) imposing discipline or dismissal by filing a grievance and a request for a hearing of the matter in writing within thirty (30) days of the pilot’s receipt of the written notification of such action. The grievance shall be addressed to the pilot’s Flight Department supervisor, with a copy provided to the Vice President-Flight and the President of the Association or his/her designee.
b. A pilot may be held out of service with pay by the Company, pending an investigation, hearing, appeal, or Substance Abuse Professional evaluation after a confirmed positive breath alcohol test, provided that if the pilot is charged with insubordination, criminal charges or verified positive drug test results, the pilot may be held out of service without pay. If, in the case of criminal charges or verified positive drug tests, the charges are subsequently not pursued or proven, s/he will be returned to duty without a loss of seniority, shall be paid for any time or earnings lost which the pilot would have received but for the withhold from service, and the Company shall ensure that all personnel and other records so reflect that fact.
