Eligibility While on Leave. Employees who are on approved leaves of absence for medical reasons pursuant to the Family Medical Leave Act (FMLA) and/or the California Family Rights Act (CFRA) and whose paid hours in a pay period are less than the required number of hours designated in sub-section (a) above will continue to receive the Medical Premium Subsidy (MPS) for up to six (6) pay periods in any rolling twelve (12) month period. Employees who are on an approved leave of absence without pay shall not be eligible to receive the MPS unless they are on an approved FMLA or CFRA eligible leave of absence. If an employee is no longer eligible for health and dental coverage, the employee will have the option of enrolling in COBRA continuation coverage. An employee who does not return to work in any subsequent year after the employee has received the benefits of this Section shall not be eligible for continuation of the benefits of this Section in the subsequent year. For example, an employee who is off work continuously for two (2) years and has received the benefits of this Section for a total of six (6) pay periods during his/her absence shall not be eligible for the continuation of the benefits of this Section in the next rolling calendar year.

After an employee has exhausted the benefits of this section, the employee will have the option of enrolling in COBRA continuation coverage.
