EMPLOYEES OTHER THAN UNION MEMBERS. Employees who are excluded from the bargaining unit shall not perform routine store work. However, this condition does not apply to Store Managers in stores of less than volume, and Assistant Managers in stores of less than volume. This Article will not be interpreted in such a way as to restrict the performance of routine store work by such employees of the Company in connection with new store openings. This exemption will apply prior to the opening of the store and during the week of the opening. The appointment of Assistant Store Managers will be limited as follows: One (1) Assistant Store Manager in stores of and over, open no more than four (4) evenings per week. One (1) Assistant Store Manager in stores open three (3) or four (4) evenings per week. One (1) Assistant Store Manager in stores open five (5) or six (6) evenings per week and under volume.

Up to three (3) Assistant Store Managers in stores that are open for customer shopping (24) hours per day. The Company agrees that for each violation of this Clause it will pay a penalty of one hundred ($100) dollars to the Regional Cancer Research Centre in the name of the Union. No Store Managers or Assistant Store Managers will perform routine store work under this Clause while bargaining unit employees are laid-off in the seniority area concerned. This Article will not be interpreted in such a way as to restrict the performance of routine store work by such employees of the Company in connection with new store openings. This exemption will apply prior to the opening of the store and during the week of the opening.
EMPLOYEES OTHER THAN UNION MEMBERS. (a) The Employer agrees that employees who are not members of the bargaining unit, other than Store Managers in stores whose volume is less than weekly, No Frills Managers and Regional Cashier Specialists, will not perform bargaining unit work except during the three weeks prior to and the one week subsequent to (Bakery, Produce, Meat and Service Department Specialists, two weeks prior to and the three weeks subsequent to; No Frills stores three weeks subsequent to) the week of a new store, unless prior arrangements have been made between the Employer and the Local Union President or Business Representative. Such employees of the Employer shall restrict activities which are considered to be bargaining unit work as outlined above, except for the purpose of product inspection and instruction. It is understood that Store Managers in stores whose volume is less than weekly and No Frills Managers shall restrict activities which are considered to be bargaining unit work to one hour prior to store opening, during store opening hours and one hour after store closing. It is that while other persons who are not employees of the Employer (except Price who shall only check prices) from time to time perform work in the Employer’s stores , the Employer agrees that there will be no extension in this work performance beyond current practices. This provision shall not restrict the Company from leasing space within the store perimeters to a Company whose business relates to the offering of financial services. With the exception of representatives from Sales or their subsequent successors, no representative of supplying companies shall perform any routine store work except as provided for in Article below. Sales representatives are only permitted to assist members of the bargaining unit in the building of special promotional displays. The Union Office and the store stewards affected will be given advance notice of all special promotional displays. The Employer agrees that for any proven violation of the provisions of this Article it will pay a penalty of one hundred and fifty dollars to the Union.
EMPLOYEES OTHER THAN UNION MEMBERS. 13.01 (a) Persons who are not members of the bargaining unit and who perform work normally performed by members of the bargaining unit, shall not do so to any extent so as to displace a part time employee. Notwithstanding the above, during any renovations or relines any member outside the unit may do any work required.
EMPLOYEES OTHER THAN UNION MEMBERS. 11.01 The performance of routine manual store work by full-time employees who are not members of the Union and whose main duties do not include the performance of routine manual store work to the extent that it results in the understaffing of a store or department, shall be considered a grievance. Notwithstanding the foregoing, Specialists / Merchandisers may work in the store assisting with new line-ups and relines. This will not cause a reduction in hours or loss of shifts of bargaining unit members.

SUPPLIERS' REPRESENTATIVES as set out below, no Suppliers' Representative shall perform any routine manual store work. Company agrees that for each individual violation of this clause it will pay a penalty of fifty dollars to the United Appeal in the area in the name of the employees. Exceptions:
