Exclusions to Coverage. This Plan does not cover: • Damage to your product caused by accident (unless you have purchased the optional SPS P3 and it’s a covered event), abuse, neglect, intentional physical damage, misuse (including faulty installation, repair, or maintenance by anyone other than an authorized service provider), unauthorized modification, viruses and/or spyware (unless you have the Vi-Spy Coverage), performance failures due to not maintaining firmware updates, extreme environment (including extreme temperature or humidity), external condensation, mold, immersion/submersion in liquid (e.g. pool, bathtub, etc.), lightning, fire, flood, insect infestation, rodents, war, terrorism, computer software related failures, Acts of God or other external causes. • Products that have been lost or stolen (this Plan only covers products that are returned to us in their entirety); cosmetic damage to your product including but not limited to scratches, dents and broken plastic on parts, that does not otherwise affect its functionality or materially impair your use. • Products with a serial number that have been altered, defaced or removed; problems caused by a device that is not your product, including equipment purchased at the same time as your product; controllers, consumable parts, such as batteries, unless expressly provided for herein; damage to, or loss of any software or data residing or recorded in your product (when providing repair or replacement service, we will use reasonable efforts to reinstall your product’s original software configuration and subsequent update releases, but will not provide any recovery or transfer of software or data contained on the serviced unit not originally included in your product). • Failures or parts and/or labor costs incurred as a result of a manufacturer’s recall; fees or costs related to third-party contracts, consequential or incidental damages, including but not limited to loss of use, loss of business, loss of profits, loss of data, downtime, charges for time and effort, “no problem found” diagnoses, or failures that occurred prior to the purchase of this Plan. • Products used for commercial purposes, unless expressly stated on your purchase receipt that this is a Commercial Plan. • Personal items left in the product (you are responsible for removing all personal items from the product before service is performed); parts and services covered under your product’s manufacturer’s warranty; remote control reprogramming; damage due to co...
Exclusions to Coverage. Summit Homes does not assume responsibility for any of the following, all of which are excluded from coverage under this Limited Warranty: A. This Limited Warranty does not cover minor visible defects which occur more than fifteen (15) days after issuance of a final certificate of occupancy, including but not limited to minor surface irregularities in flooring, doors, dry wall, cabinets, countertops, siding, appliances, plumbing fixtures, windows and missing items such as light fixtures, light bulbs, window screens, window glass, and mirrors. Summit Homes will assume that a minor surface defect or missing item occurred more than fifteen (15) days after the issuance of a final certificate of occupancy unless the visible surface defect or missing item was noted on Summit Blue Silverthorne, LLC’s punch list or otherwise disclosed to Summit Homes within fifteen (15) days. All such items are excluded from this Limited Warranty except as set forth herein. B. Summit Homes has no warranty liability for any defects in appliances and other manufactured items which are covered by manufacturers’ warranties. Summit Homes will assign all such warranties to Summit Blue Silverthorne, LLC, and Summit Blue Silverthorne, LLC or Initial Purchaser will follow the procedures of the manufacturers’ warranty, including the completion of the manufacturer’s warranty registration cards. Summit Homes agrees that it will provide Summit Blue Silverthorne, LLC or Initial Purchaser with reasonable assistance in dealing with manufacturer’s representatives in connection with any warranty claim if Summit Blue Silverthorne, LLC or Initial Purchaser so requests. C. This Limited Warranty does not apply to any damage or defect which is caused by moving into the home, ordinary wear and tear, unreasonable or unauthorized use by Summit Blue Silverthorne, LLC or Initial Purchaser, including lack of proper or timely maintenance, or the failure on the part of Summit Blue Silverthorne, LLC or Initial Purchaser to take any reasonable or necessary corrective action to prevent damage. D. This Limited Warranty does not apply to minor defects which are the result of characteristics common to the materials used and which are commonly considered minor maintenance items, such as but not limited to, cracking, fading, warping, checking, cracks due to the drying and curing of wood, siding, plaster, caulking or similar materials, and the expansion or contraction of materials in walls, ceilings, floors, doors, and ...

Exclusions to Coverage. Notwithstanding anything to the contrary in this Agreement, the following items are not covered under any SystemShield™ Package and are not eligible for coverage or reimbursement under any SystemShield™ Package:
Exclusions to Coverage. (These exclusions apply unless specifically covered under the Product Specific Coverages for your Plan) • Furniture items that are covered by the manufacturer’s warranty, repairer’s warranty, or any other warranty in effect. Any and all pre-existing conditions that occur prior to the effective date of this Plan. Defects that are subject to manu- facturer’s recall. • General soiling, which is defined as a gradual buildup of dirt, dust, body oils, perspiration, or any other accumulated stains, that cannot be attributed to a single occurrence. • Indentations from writing on wood surface or any type of surface abrasion; fin- ish scorching and heat damage. Loss of silvering of glass or mirror components; scratches of any type; all accessories. • 100% silk, non-colorfast material or wall-to-wall carpeting. • Human and pet bodily fluid stains bodily fluid stains caused by incontinent individuals or pets. Repeated pet bodily fluid stains, which are considered pre- ventable occurrences. • Perspiration, body oils, and hair oils. • Damage that does not clearly penetrate through upholstery including but not limited to scratches and scuff marks. • Plastic or metal parts, such as hinges and drawer slides • Accidental gouges on wood surfaces that do not clearly penetrate through the clear-coat finish exposing the bare wood including but not limited to scratches. • Ballpoint pen ink, crayon or lipstick marks of more than 6 inches in length are considered preventable and will not be covered. • Mold and mildew stains due to atmospheric causes. • Defects or damage caused by topical treatments. Use of any unauthorized cleaning products or methods. • Stains or liquid rings, unless specifically covered under this Plan, caused by substances such as medication (including vitamins), dyes, paints, acids, cor- rosives, chemicals, bleaches, glue, candle wax, adhesives, gum, crayon, ink (except ballpoint pen ink), marker, dirt or other soil, pollen, tree sap, rust, nail polish, nail polish remover, cosmetics, hair treatments including hair gel, hair spray, mousse, or other like substances. • Odors; accumulated or long term multiple stains and unknown stains, color loss and fading. Normal wear and tear, including damage of this type cannot be attributed to a single relatable accident. • Unless specifically covered under this Plan, the Plan does not apply to any other surfaces including parachute cloth, “X” coded fabrics, draperies, area rugs, carpets, box springs, mattresses, nubuck, s...

Exclusions to Coverage. This Plan does not cover: (i) damage to your product caused by accident, abuse, neglect, intentional physical damage, misuse (including faulty installation, repair, or maintenance by anyone other than an authorized service provider), unauthorized modification, viruses, extreme environment (including extreme temperature or humidity), external condensation, lightning, static electricity, fire, flood, insect infestation, rodents, Acts of God or other external causes; (ii) products that have been lost or stolen. Exclusions to Coverage. This Plan does not cover:  ADH Exclusions: gaming consoles, accessories that fall from elevated heights such as decks, balconies, or out of windows, units that have been run over or that fall from moving vehicles, damage from liquid immersion/submersion or any other secondary damage or using the product in a manner the manufacturer did not intend is not covered.
