Health and Safety File. The Contractor’s health and safety file is separate from the Contractor’s health and safety plan. The Contractor’s health and safety file is progressively populated with checks and inspections, as indicated in the Contractor’s health and safety plan. Health and Safety File. The Buyer acknowledges that it has inspected the health and safety file for the Property maintained by the Seller for the purposes of the Construction (Design and Management) Regulations 2007 and that it is aware of the nature and purpose of that file.
Health and Safety File. Subject to clause 9.9.1, following completion of the Tenant’s Works the Tenant shall liaise with the planning supervisor (if any) employed by the Landlord for inter alia the Tenant’s Works as to any necessary updating of the Health and Safety File and supply to such planning supervisor all information, drawings and details of the Tenant’s Works as reasonably required by such planning supervisor and use all reasonable endeavours to ensure that such updating is completed within four weeks of completion of the Tenant’s Works.
Health and Safety File a) The H&S file is a document prepared by the principal contractor containing important project H&S information for use by the owner of the completed structure after construction has been completed.
b) The principal contractor is responsible for producing an H&S file. It contains important project H&S information for use by the owner of the completed structure after construction has been completed. It is essential that the process of compiling the file commences as early as possible to ensure sufficient time to gather the required information.
c) The Principal Contractor must, in terms of Construction Regulation 7(7), keep a Health & Safety File on site at all times that must include all documentation required in terms of the Act and Regulations and must also include a list of all Contractors on site that are accountable to the Principal Contractor and the agreements between the parties and details of work being done. A more detailed list of documents and other legal requirements that must be kept in the Health & Safety File.
d) The contractor must ensure that the client’s format and layout of the H&S file is adhered to. The contractor must identify the responsible person that will prepare the H&S file and who will be responsible for the drafting of as-built drawings. The contractor must establish procedures:
e) The Health and Safety File will remain the property of the Client and/or its Agent on its behalf throughout the period of the project and shall be consolidated and handed over to the Client and/or its Agent on its behalf at the time of completion of the project.
f) The contractor shall establish and maintain on site a health and safety file which contains copies, as relevant of: the following documents which shall be placed in the file prior to commencing with physical construction activities: • copy of the contraction work permit issued in terms of the Construction Regulations 2014; • the contractor’s health and safety policy, signed by the chief executive officer, which outlines the contractor’s objectives and how they will be achieved and implemented by the contractor; • copies of all risk assessments that were conducted. • the notification made to the Provincial Director of Labour, and if relevant, the notification of the person who supplies or contracts or agrees to supply electricity to that electrical installation; • the letters of appointment, as relevant, together with a brief curriculum vita (CV) of: — the construction manager and any ass...

The Contractor’s health and safety file must be available on request and should be handed over to the Supervisor, prior to the Completion Date (Refer Construction Regulations 5(7) and 5(8)).

The Contractor will be required to submit a safety file, the following should be included in the safety file: Contractor's information and organogram, management and supervisors health and safety training, legal appointments, notification of construction work, letter of good standing, statutory appointments, risk assessments, health and safety induction, fall protection plan, certificates of medical fitness, tools and equipment inspections, hazardous chemical substances, certificates of competency, PPE, environmental Management, safety Plan, health and Safety Specifications, emergency plan.
Health and Safety File. The Consultant’s health and safety file is separate from the Consultant’s health and safety plan. The Consultant’s health and safety file is progressively populated with checks and inspections, as indicated in the Consultant’s health and safety plan. Any drawings, designs, materials used, structural integrity testing and any other similar information applicable to the project will be placed on the Consultant’s health and safety file. The Consultant’s health and safety file must be available on request and should be handed over to the Client’s representative, prior to the Completion Date as described in the Construction Regulation 7(1)(e) of the OHSA. Depending on the nature of the service and detail of the information on the Consultant’s health and safety file, e.g. asbestos work where there is a requirement for medical surveillance of workers who will be exposed to asbestos, it is recommended that the Consultant keeps these records for forty years, in terms of Asbestos Regulations 16(f) of the OHSA. Where the Consultant’s employees / workers are exposed to hazardous chemical substances and where a medical surveillance was required, it is recommended that the Consultant keeps these records for thirty years, as stipulated under the Hazardous Chemical Substances Regulations 9(1)(f) of the OHSA. The Consultant ensures that all other medical surveillance requirements in terms of the OHSA, where applicable, comply with for the Consultant and subcontractor organisations. The Consultant’s health and safety file is audited by the Client’s representative or his delegate, to ensure that work is being carried out and the necessary checks and inspections are conducted in accordance with the Consultant’s plan. The minimum contents of a health and safety file are indicated in 32-136[10].
Health and Safety File. 14.8.1 As soon as reasonably practicable after practical completion of the Tenant's Works and in any event within two months of practical completion of the Tenant's Works, the Tenant shall at its own cost supply the Landlord with a complete set of “as-built” scale drawings and the Health and Safety File for the Tenant's Works.
14.8.2 The Tenant shall use reasonable endeavours to ensure that there shall be granted to the Landlord a royalty-free and irrevocable non-exclusive licence to use and copy any information and documents or other materials comprised In the Health and Safety File for the Tenant's Works for any purpose connected with the Premises.
