Health & Welfare Trust Fund. 40.1 The Company agrees to have a Health and Welfare Trust Fund for all part-time employees who do not qualify for the existing Company Group Insurance benefits. Health & Welfare Trust Fund. (a) In this addendum, each Employer agrees to pay, as stipulated in Schedules A, B, C, and D for each hour worked by all employees covered by this Agreement. Health & Welfare Trust Fund. Effective May 1, 1994 a contribution of two dol- lars and twenty-five cents ($2.25) per hour for each straight time hour, and three dollars and thirty-eight cents ($3.38) for each overtime hour at time and one-half (1- 1/2), and four dollars and fifty cents ($4.50) for each over- time hour at double time, will be paid by the Employer to the Trustees of the Bricklayers & Masons Welfare Plan. It will not be a breach of this Agreement for the Union to withdraw its members from any job when the Employer has not made the proper payments to the Welfare Plan in accordance with this Agreement. Health & Welfare Trust Fund. It is agreed by the parties hereto that all employers covered by this Agreement shall contribute a sum as listed in Schedule "A-1" herein for each compensable hour of work performed by Drywall Finishers employed by Employers covered by this Agreement, which contribution shall be made to the Employees Painters Health & Welfare Trust in the manner as set forth in the Trust Agreement of said Trust Fund. The details of the Health and Welfare Plan established by this Trust Fund and this Trust Fund itself shall continue to be controlled and administered by a Joint Board of Trustees composed of equal representation of labor and management who are signatory to the Trust Agreement of the aforesaid Trust Fund. Each Trustee appointed by the Union shall be a member of the Union and employed by the Union and each Management trustee shall be a salaried executive or officer of a signatory Employer, or an employee of an Employer association, on behalf of its member employers.
Health & Welfare Trust Fund. Section 1. Each Trust shall maintain a list of active and inactive Employers bound to or signatory to this Agreement. Active employers shall be required to fill out, sign and send in a monthly contribution report form each and every month regardless of whether said employer had any employees for that particular month and shall be liable for the contributions allocable to said hours. Inactive employers shall not be considered inactive until such time as they are no longer maintained on the monthly mailing list for contribution report forms from the Trust. Employers may apply to the trustees of the Trusts for inactive status but shall not become inactive until such time as the trustees of the Trusts, in their sole discretion, accept the Employer’s request for inactivation and delete their name from the mailing list for the monthly contribution report form. The terms of this Article XII shall apply to each and every trust fund referenced in this Agreement.
