INSTALLATION OF GOODS. (1) Subject as hereinafter provided, the Hirer shall not without the Owner’s prior written consent affix the Goods to any land or buildings such that the Goods are not capable of being removed without material injury to the said land or building or otherwise in a manner that they are or may become fixtures. (2) If the Goods require to be installed or erected in or upon or in any way attached to any premises, the Hirer shall obtain such waivers from the landlord and any mortgagee or chargee of the premises before the Goods are so installed or erected as the Owner may require; and on demand deliver them to the Owner forthwith. (3) Where the Goods are installed or erected in or upon or are in any way attached to premises with prior written consent of the Owner, the Hirer shall not without the prior written consent of the Owner create any mortgage, charge or other encumbrance (legal or equitable) upon such premises or sell, let otherwise dispose of the premises. Any written consent given by the Owner in this sub-clause shall in each and every case be deemed to be given subject to an express condition precedent that the Hirer shall procure that such subsequent mortgage, charge or other encumbrances shall contain on the part of the mortgagee or other person entitled to the benefit thereof a declaration that so long as the Goods remain the property of the Owner the mortgagee or such person as aforesaid shall neither have nor acquire any right whatsoever in respect thereof notwithstanding that the Goods may be or become of the nature of a fixture. (4) Further, any consent under this Clause 8 shall be subject to such conditions as the Owner may reasonably require and in any event deemed subject to a requirement that the Owner’s right to enter and re-possess the Goods and if appropriate to sever them from the premises shall not be prejudiced. (5) As between the Hirer and the Owner, the Hirer shall be responsible for any expenses arising from the affixing of the Goods to any land or building or from the removal by the Hirer or the Owner of the Goods from such land or building (including in either case any damage to such land or building or the Goods) and the Hirer shall effectually indemnify the Owner against any claim made against it in respect thereof.

INSTALLATION OF GOODS. In the event WSECO provides Services to Customer and installs Goods, in conjunction with the provision of the Services, the Goods shall have a manufacturer’s warranty of twelve (12) months, as described above, and an additional WSECO warranty of six (6) months, which WSECO warranty of Goods shall be “added” to the end of the manufacturer’s warranty.

The customer must notify Weighwell within 30 days of receiving the goods that: - They have received the goods. - They require Weighwell to install the goods. - The customer’s premises are ready and fit for installation. 7.2 The customer will, at their own expense and in accordance with the directions from Weighwell, prepare their premises to enable Weighwell to install the goods. The preparation of the premises will include but will not be limited to: - The procurement of all necessary labour, lifting gear, supporting steel work, electricity and other facilities required for installation. - The hire and transportation of test and calibration equipment where necessary. - The provision of all fixed runs of electrical wiring connecting the goods to mains power. - The repair or reconditioning of any existing machinery, plant or equipment which may be used in conjunction with the goods. - The obtaining of all necessary permits and licenses required by all relevant authorities, bodies and governmental departments. 7.3 Weighwell takes no responsibility for the condition of any existing machinery, plant or equipment which may be used in conjunction with any goods, and any effect that such machinery, plant or equipment may have on the goods.
INSTALLATION OF GOODS. 8.1 This paragraph applies if the Supplier is carrying out Installation. 8.2 Unless otherwise agreed by the Parties in writing, the Supplier shall be required to undertake a visit to the Premises and shall: 8.2.1 issue an Installation Report detailing work to be carried out to prepare the Premises for delivery and/or Installation of the Goods. Such work shall not affect the Long Stop Completion Date. If the Supplier does not notify the University of any such work or requirements, the Supplier shall be deemed to have accepted that the Premises are suitable and shall proceed with delivery and Installation of the Goods; or 8.2.2 issue a certificate, stating that the Premises (including, without limitation, the conditions, layout, design and any other factors) are suitable and acceptable for the delivery and/or Installation or use of the Goods and proceed with the delivery and Installation. 8.3 The Supplier shall ensure that the Installation Report contains adequate information in sufficient time to enable the University and/or the Supplier (as applicable) to prepare the Premises for Installation, and enable the University and/or the Supplier (as applicable) to provide: 8.3.1 a suitable supply of electric current and such other mains services as may reasonably be required; 8.3.2 all other required electrical and mechanical items and fittings, as specified by the Supplier in the Installation Report and as may agreed by the University; 8.3.3 such facilities and environmental conditions as specified by the Supplier in the Installation Report and as may agreed by the University; and 8.3.4 access to and from, the Premises and/or the Designated Area for delivery and Installation of the Goods to enable delivery, off-loading and placing in position of the Goods (including, without limitation, appropriate access and egress that enables the Supplier to deliver and remove any equipment, tooling or other facilities required for the purposes of undertaking and completing delivery and Installation of the Goods) which complies with any specific requirements set out in the Installation Report. 8.4 Where the Supplier has issued an Installation Report, the Supplier shall be required to re-examine the Premises upon the notification by the University that any work specified in the Installation Report has been completed (or upon the Supplier completing such work as applicable) and issue a certificate in accordance with paragraph 8.2.2, or apply the provisions of paragraph 8.2.1 as...

After the Factory Acceptance Test the Parties will agree a time and date for the installation. 8.2 If the Supplier’s requirements for installation or the Client Action have not been complied with on the date set for installation resulting in a postponement of the installation date or an extension of the time estimate for the installation, the Client will be liable to pay the Supplier an additional amount for the Supplier’s additional labour costs calculated at the standard hourly rates plus VAT per engineer on site, plus any additional travel and accommodation costs. 8.3 The installation costs as detailed in the specification document are based on Normal Site working hours (8.30am to 6pm). If the Supplier’s installation team are required to work beyond these hours or over a weekend, further charges will apply as detailed in Clause 8.2. 8.4 The Client will arrange a time for the Site Acceptance test to take place no later than 10 days of the Supplier confirming that it has completed the Works.
