Involuntary Reassignments and Transfers a. The District and the Federation recognize that there may be unusual circumstances requiring the involuntary reassignment or transfer of a Faculty Member. Such circumstances may include transfer and/or reassignment to avoid layoff. Such transfers and/or reassignments will not be made in an arbitrary, capricious or discriminatory manner.
Involuntary Reassignments and Transfers. 1. The Parties acknowledge that involuntary assignment changes and transfers may be necessary from time to time. 2. An educator shall not be transferred involuntarily without good cause. 3. USDB shall first consider volunteers from among those affected. USDB may offer a monetary incentive for an educator to transfer when a need arises during the school year. 4. Involuntary reassignments and transfers shall be made in the best interest of both the students and the educators, with priority given to student needs. 5. USDB shall consider an educator’s performance, training, credentials, and length of service with USDB. 6. An educator who is involuntarily transferred or reassigned will have first option to return to the position or location, if qualified. 7. USDB educators who are involuntarily transferred or reassigned shall be notified about open teaching assignments for which they are qualified. 8. USDB educators involuntarily transferred or reassigned shall have preference over educators seeking voluntary reassignment or transfer. 9. The best qualified educator for a particular position shall receive priority, Seniority within USDB may only be considered when other qualifications are substantially equal.
Involuntary Reassignments and Transfers. When involuntary reassignments or transfers are necessary, a member's area of competence, major and/or minor field of study, quality of performance, and the length of service in the Bellingham schools will be considered together with instructional requirements and other factors affecting the best interest of the schools in determining which member is to be reassigned or transferred. An involuntary transfer will be made only after a meeting between the member involved and the Superintendent or his designee, at which time the member will be notified of the reasons for the transfer. In the event that a member objects to the transfer at this meeting, the Superintendent and his designee (or, in the event the Superintendent is unavailable, two designees of the Superintendent) will, at the request of the member, meet with the member and a representative of the Association to discuss this matter. If the member is not satisfied, the member and the Association may bring the matter to the Superintendent under Step Two of the grievance procedure.

(b) In the event a Faculty Member is involuntarily transferred or reassigned as a result, either directly or indirectly, of the layoff process, that Faculty Member shall for two years retain the right of first consideration to return to the position from which transferred or reassigned. It will be the responsibility of the Office of the Vice Chancellor for Human Resources to guarantee that Faculty Members so affected are notified of such vacancies and are assured of the consideration provided by this Section. (c) The President of the Federation shall be notified of the name of any Faculty Member when the District or College proposes to transfer or reassign pursuant to this Section. (d) The reason for the involuntary transfer or reassignment shall be provided in writing, if requested by the Faculty Member being transferred.
Involuntary Reassignments and Transfers. Envision Education may make involuntary transfers or reassignments of a unit member or members reasons related to changes to enrollment, unexpected vacancies or programmatic changes as follows: Envision Education shall determine positions needed by department and/or content area. Envision Education shall meet with the affected unit member(s) and designated Envision United members to discuss the needed changes and collaborate on solutions. Envision Education will try to fill the positions needed by first seeking volunteers by department and/or content area and needed credential. In determining involuntary transfers or reassignments, the needs of the school’s education program and students including, but not limited to, potential for disruption to the educational program or continuity of instruction will be applied.

  • Involuntary Reassignment In the absence of volunteers to fill a vacancy internally, the college may administratively reassign from any overstaffed area that qualified faculty member with the lowest seniority.

  • Assignments and Transfers 18.1 Any assignment by either Party to any entity of any right, obligation or duty, or of any other interest hereunder, in whole or in part, without the prior written consent of the other Party shall be void. The assignee must provide evidence of a Commission approved certification to provide Telecommunications Service in each state that OneTone is entitled to provide Telecommunications Service. After BellSouth’s consent, the Parties shall amend this Agreement to reflect such assignments and shall work cooperatively to implement any changes required due to such assignment. Notwithstanding anything to the contrary in this Section, OneTone shall not be permitted to assign this Agreement in whole or in part to any entity unless either (1) OneTone pays all bills, past due and current, under this Agreement, or (2) OneTone’s assignee expressly assumes liability for payment of such bills. 18.2 In the event that OneTone desires to transfer any services hereunder to another provider of Telecommunications Service, or OneTone desires to assume hereunder any services provisioned by BellSouth to another provider of Telecommunications Service, such transfer of services shall be subject to separately negotiated rates, terms and conditions.
