Involuntary Transfers or Reassignments. Nothing in this article shall be interpreted as diminishing in any way the Superintendent’s right to transfer or reassign employees for the good of the school system. When an involuntary transfer or reassignment is necessary and when this action is not for disciplinary reasons, SMCPS agrees to consider length of service with SMCPS in determining which employee will be transferred or reassigned. a. Written notice of an involuntary transfer or reassignment will be given to employees as soon as possible. b. An involuntary transfer or reassignment will be made only after a meeting between the employee involved and the appropriate administrator/supervisor, at which time the employee will be notified of the considerations for such transfer and reassignment. If the decision stands following the employee and administrator/supervisor meeting, the final assignment and considerations shall be summarized in writing. c. In the event that an employee objects to the transfer or reassignment at the meeting, upon their written request, the Superintendent will meet with them within a reasonable time of the request.

Involuntary Transfers or Reassignments. A. Where possible, qualified volunteers will be considered for positions prior to making involuntary transfers or reassignments. A teacher being involuntarily transferred or re-assigned will only be placed in a position for which the teacher is certified. A teacher may meet with the Superintendent to discuss an involuntary transfer or re-assignment. B. Any member of the bargaining unit who is being involuntarily reassigned or involuntarily transferred shall be notified in writing of such reassignment or transfer on or before July 15, except in circumstances when the operational needs of the District require the transfer of a teacher. Within fifteen (15) days of notice, such teacher(s) involuntarily reassigned or transferred shall be granted a conference upon request with the local Superintendent and building administrator who shall give reasons for such reassignment or transfer. At such conference, the teacher may be represented by one (1) person of his/her choice. C. The Superintendent shall have the authority to involuntarily transfer provided the teacher is given written notice, reasons, and the opportunity for a conference, as set forth in paragraph b above. No involuntary transfer shall occur during the school year except in emergency situations where the operational needs require a transfer during a school year. D. An involuntary transfer or reassignment shall be defined as a transfer required by the Superintendent to a different building or grade. E. When the Superintendent transfers a teacher to a position in which the teacher is not “highly qualified” to teach, the Superintendent will attempt to assist the teacher in accomplishing the requirements to become highly qualified. F. Upon the last work day of the preceding school year, the building Principal shall notify any teacher, upon request, of his/her assignment for the following year.
Involuntary Transfers or Reassignments. Employees who are transferred to another building or reassigned within the same building must be informed by the responsible administrator or the Assistant Superintendent for Personnel and Planning as to the reason(s) for such a transfer or reassignment. If the transfer or reassignment of an employee is objectionable to the employee, the employee may voice his or her concern in writing to the Assistant Superintendent for Personnel and Planning. The written objection will be placed into the personnel file of the employee as a matter of record and upon the employee’s written request.

An involuntary transfer or reassignment will be made only after a meeting between the teacher involved and the Superintendent, at which time the teacher will be notified in writing of the reasons. No teacher will be transferred or reassigned arbitrarily, capriciously or without rational basis. 3. Members who are required to obtain an update in an area of previous certification and/or secure new certification for assignment by the Superintendent shall be reimbursed for the required tuition necessary to obtain said update or new certification. Such tuition reimbursement shall be based upon the course requirements established by the State Department of Education for said update and/or new certification. Said reimbursement shall be outside the funds allocated for tuition reimbursement established in this agreement.
Involuntary Transfers or Reassignments. 1. Teachers may be involuntarily transferred from a school site to another school site for the following reasons: a. Declining enrollment b. Addition, elimination, or reduction of classes in specific special areas or programs c. Fluctuations in pupil enrollment (an overstaffed or surplus situation may be deemed to exist when the number of teachers present in a given school after the beginning of the school year exceeds the ratio established by Article XIII, Class Size) d. Certification adjustment (a teacher may be transferred if it is determined by the District that his/her assignment is in violation of certification requirements) e. Performance renewal (the District may involuntarily transfer a teacher once per any three (3) year period, in order to improve his/her performance, if deficiencies in performance have been properly reflected in the official written evaluation of the teacher, and the rating administrator has made a good faith effort to properly assist said teacher improve his/her performance through the implementation of a bona fide Remedial Action Plan, as provided for in Article XIV of this Agreement). 2. An involuntary transfer shall not be implemented more than once every three (3) years unless the teacher's credentials do not qualify him/her to teach any other subject offered in the school from which he/she is being transferred. 3. If an involuntary transfer, and upon written request of the teacher, the District shall be responsible for moving the teacher's personal instructional equipment and property from the former work site to the newly assigned work site. The teacher must properly box and label materials to be moved. The District shall complete such move at least one (1) workday before the teacher begins the new assignment. 4. Except for transfer for reasons 1(d) and 1(e) above, when an involuntary transfer is deemed necessary, then the following shall occur: a. Volunteers will be sought before utilizing involuntary transfer b. The teacher(s) under consideration for involuntary transfer shall be notified c. Within five (5) working days of the notification, the bargaining unit member may request and will be granted a meeting with the Superintendent or his/her designee to discuss and consider alternatives to the proposed transfer. Upon written request, the teacher shall receive written reasons for the transfer. Such requests shall be made within five (5) workdays of receipt of the request. d. Classification C – Regular California credential or regular California credential with a Provisional California credential and a Bachelor’s Degree, plus 30 semester units of graduate or upper division work from an accredited teacher training institution, taken after receipt of Bachelor’s Degree or a Master’s Degree or, effective 9/1/02, new hires only with a valid basic credential. Classification D – Regular California credential or regular California credential with a Provisional California credential and a Bachelor’s Degree, plus 45 semester units of graduate or upper division work from an accredited teacher training institution, taken after receipt of Bachelor’s Degree, or a Master’s Degree plus 15 semester units of upper division or graduate work from an accredited teacher training institution taken after the receipt of the Master’s Degree. Involuntary Transfers or Reassignments. 10.5.1 Involuntary transfers or reassignments may be made for the following reasons: ● To balance the staff of the District by considering factors related to the District. ● Educational needs of the students. ● A change of enrollment necessitating transfer of staff. ● Modification of instructional program such as STEAM+ allocation changes. ● Lack of funding and/or declining enrollment. ● To provide an opportunity to evaluate a unit member in a different environment. 10.5.2 When making involuntary transfers, administrators shall take the following factors into consideration in making their final decision: ● Length of service of the unit member in the District, at a particular grade level or assignment, or at a school site. ● Teachers assigned to combination classes. ● Team dynamics and ability to work effectively in collaboration. ● Prior involuntary transfer history. ● Consideration of individual preferences. 10.5.3 Involuntary transfers only: Unit members who are notified that they are to be involuntarily transferred may, within ten (10) days of receipt of the notice of involuntary transfer, request the reasons in writing for the involuntary transfer. The District shall provide the reason(s) in writing within ten (10) days of receipt of the request. 10.5.4 Unit members who are general education classroom teachers shall not be involuntarily transferred or reassigned more than once during two (2) consecutive school years. 10.5.5 Notice shall be given of involuntary transfer or reassignment as soon as possible. 10.5.6 No unit member shall be involuntarily transferred or reassigned arbitrarily or capriciously.
