Leave for Civic Duties. A. Temporary leave will be provided each teacher to serve as a juror or to appear in court as a witness, and will be paid an amount equal to the difference in his/her regular pay and the amount received from the court.
B. A state, city, town, or county employee who is a member of the organized militia of this state or who is a member of the organized or unorganized reserve corps or military forces of the United States and who has been an employee for a period of 6 months shall be given leave of absence with pay for a period of time not to exceed 15 working days in a calendar year for attending regular encampments, training cruises, and similar training programs of the organized militia or of the military forces of the United States. This leave may not be charged against the employee's annual vacation time.
C. Other types of civic duty leave will be granted at the discretion of the Board of Trustees. A teacher may be required to submit proof of required civic duty at the discretion of the Board of Trustees.

Their daily salary rate is to be continued while on jury duty, however, the stipend paid by the court will be deposited at the school business office. The teacher may keep monies remitted by the court for expenses or mileage allowance while performing jury duty.

If a teacher is called to serve on a jury panel or is appointed to an election board, the teacher shall receive his/her daily teaching salary provided the teacher salary exceed such civic compensation. Upon receipt of a copy of the civic compensation, the corporation deduction shall be made on a per diem basis less expenses. All expenses must be documented.

The daily salary rate is to be continued while on jury duty, however, the stipend paid by the court will be deposited with the School Clerk's office. The Principal may keep monies remitted by the court for expenses or mileage allowance while performing jury duty. In no instance shall the School District be required to pay any mileage and/or expenses to the Principal serving on jury duty or as a court witness. The Board also reserves the right to request the court to excuse the Principal from jury duty if the Board deems that he is needed for the proper operation of the School District.

B. The length of leave will vary in accordance with the amount of time required for the civic duty. Any monies paid to the teacher up to a limit of their daily rate (1/188.5) of pay will be returned to the District with the exception of mileage, meals and lodging.

D. Legislative leave shall be available to a teacher who has been elected or appointed as a legislator to the Montana House of Representatives or Senate. The length of the legislative leave shall be commensurate with the legislative session, including any extensions, interim committees, or special sessions that may be imposed. Dur- ing a legislative leave, the teacher shall receive full contract salary from the District, continue to accrue seniority, and receive all fringe benefits to which said teacher is entitled. In return, the teacher on legislative leave agrees to reimburse the District for the greater of: 1) all substitute teacher costs, including salary and benefits, or 2) the total amount of salary and per diem received for legislative service during the leave. In accordance with 2-2-104, Montana Codes Annotated, teachers shall dis- close amounts received from the two separate public employment positions to the Commissioner of Political Practices.
