MISCONDUCT DEFINED. Misconduct is any violation of the student code of conduct and behavior expectation policies. The following is a list of some violations of the student code of conduct. This list does not limit the responsibility of the principal to maintain an orderly instructional environment. The administrators or designees are responsible for dealing with all student conduct, and therefore can discipline students for inappropriate acts not described in this handbook.

MISCONDUCT DEFINED. Misconduct is any violation of the student code of conduct and behavior expectation policies. The following is a list of some violations of the student code of conduct. This list does not limit the responsibility of the principal to maintain an orderly instructional environment. The administrators or designees are responsible for dealing with all student conduct, and therefore can discipline students for inappropriate acts not described in this handbook. CLASSROOM MANAGEMENT Disrupting the classroom environment interferes with the basic mission of our school, to provide an academic education. Each classroom teacher will have expectations and consequences designed to help students learn and help them behave in a responsible, respectful and safe manner. Tools teachers may use are varied but include such actions as conferencing with the student, calling home, assigning the student to the LRC, etc. DANGEROUS WEAPONS Students are not to carry or store any dangerous weapons on school property, including a school bus. This includes jewelry or tools that present a danger to others. FIGHTING/ROUGHHOUSING Students are to refrain from any fighting or roughhousing. Any physical altercation, including wrestling or shoving between students will be considered fighting/roughhousing. Only in extreme circumstances will self defense be considered as an acceptable reason to fight. FIREARMS Students shall not carry or store any firearm or ammunition on school property, including a school bus.
MISCONDUCT DEFINED. Niedzinski shall not be entitled to severance pay if the Council terminates his employment because of Niedzinski’s conviction for embezzlement of City funds; violation of the City Charter, City ordinances including the Ethics Ordinance, relative to Niedzinski’s duties and responsibilities as City Manager, or other law regarding public officers; a violation of this Agreement; conviction of a felony, misdemeanor resulting in a term of incarceration or any crime involving moral turpitude; intentional insubordination regarding a directive legally approved by Council; or other behavior that demonstrates a deliberate violation or disregard of Niedzinski’s duties and obligations to the Council and/or the City’s interests or otherwise deviates from a standard of behavior which a city can reasonably expect of a public officer.

The commission of any of the following acts (as they are defined below) is prohibited on school property and at a school function. ● Level 1 Offenses: Disorderly conduct, disruptive conduct, loitering, other misconduct, and parking violations. ● Level 2 Offenses: Dress Code violation, insubordination, cheating, forgery, harassment, reckless endangerment, and violation of Technology/Internet policy. ● Level 3 Offenses: Destruction of school property, smoking/vaping, possession of/under the influence of drug/alcohol/illegal substance/material, fighting, and sexual harassment. ● Level 4 Offenses: Acts of violence, arson, bomb threat, extortion, false alarm, possession of explosives/weapons, threatening another person, trespassing, and vandalism. Detentions must be completed within 3 (three) days of receiving the write up. Any student not serving their detention will receive In School Suspension for each violation.

Misconduct at a school function The Principal shall be responsible for enforcing the conduct required by this Code at school functions on or off campus, and may designate other school employees or agents to take action consistent with this Code. When an individual is committing prohibited conduct that, in the judgment of the Principal or his or her designee, does not pose any immediate threat of injury to persons or property, the individual shall be informed that the conduct is prohibited and asked to stop such conduct. The school official shall also warn the individual of the consequences for failing to stop. If the person refuses to stop engaging in the prohibited conduct, or if the person’s conduct poses an immediate threat of injury to persons or property, the individual shall be immediately removed from school property or the school function. Students and staff who violate this Code while at a school function shall be subject to immediate ejection from the school function. If necessary, local law enforcement authorities will be contacted to assist in removing the person. The school may initiate disciplinary action against any student or staff member, as appropriate.   • Indemnification by Customer Customer shall indemnify, defend and hold harmless MSIL and its affiliates from and against any loss, liability, damage, cost or expense (including attorneys' and accountants' fees and expenses incurred in the defense of any demands, claims or lawsuits) actually and reasonably incurred arising from any act, omission, conduct, or activity undertaken by MSIL on behalf of Customer, including, without limitation, any demands, claims or lawsuits initiated by a limited partner (or assignee thereof); provided that (i) MSIL has determined, in good faith, that the act, omission, conduct, or activity giving rise to the claim for indemnification was in the best interests of the Customer, and (ii) the act, omission, conduct or activity that was the basis for such loss, liability, damage, cost or expense was not the result of misconduct or negligence. Notwithstanding the foregoing, no indemnification of MSIL or its affiliates by Customer shall be permitted for any losses, liabilities or expenses arising from or out of any alleged violation of federal or state securities laws unless (i) there has been a successful adjudication on the merits of each count involving alleged securities law violations as to the particular indemnitee, or (ii) such claims have been dismissed with prejudice on the merits by a court of competent jurisdiction as to the particular indemnitee, or (iii) a court of competent jurisdiction approves a settlement of the claims against the particular indemnitee and finds that indemnification of the settlement and related costs should be made, provided with regard to such court approval, the indemnitee must apprise the court of the position of the SEC and the positions of the respective securities administrators of Massachusetts, Missouri, Tennessee and/or those other states and jurisdictions in which the plaintiffs claim that they were offered or sold Units, with respect to indemnification for securities laws violations before seeking court approval for indemnification. Furthermore, in any action or proceeding brought by a limited partner in the right of Customer to which MSIL or any affiliate thereof is a party defendant, any such person shall be indemnified only to the extent and subject to the conditions specified in the Delaware Revised Uniform Limited Partnership Act, as amended, and this Section 2. The Customer shall make advances to MSIL or its affiliates hereunder only if: (i) the demand, claim lawsuit or legal action relates to the performance of duties or services by such persons to Customer; (ii) such demand, claim lawsuit or legal action is not initiated by a limited partner; and (iii) such advances are repaid, with interest at the legal rate under Delaware law, if the person receiving such advance is ultimately found not to be entitled to indemnification hereunder.

  • Indemnification by Subcontractors To the fullest extent permitted by law, an Interconnection Party that uses a subcontractor to carry out any of the Interconnection Party’s obligations under this Appendix 2 shall require each of its subcontractors to indemnify, hold harmless and defend each other Interconnection Party, its representatives and assigns from and against any and all claims and/or liability for damage to property, injury to or death of any person, including the employees of any Interconnection Party or of any Affiliate of any Interconnection Party, or any other liability incurred by the other Interconnection Party or any of its Affiliates, including all expenses, legal or otherwise, to the extent caused by any act or omission, negligent or otherwise, by such subcontractor and/or its officers, directors, employees, agents and assigns, that arises out of or is connected with the operation of the facilities of either Interconnected Entity described in this Appendix 2; provided, however, that no Interconnection Party or Affiliate thereof shall be entitled to indemnity under this Section 18.3 in respect of any injury, loss, or damage to the extent that such loss, injury, or damage results from the negligence or willful misconduct of the Interconnection Party or Affiliate seeking indemnity.

  • Intellectual Property Indemnification by Vendor Procedures Related to Indemnification. In the event that an indemnity obligation arises, Vendor shall pay all amounts set forth in Section 13 and 14 above (including any settlements) and – if it has accepted its indemnity obligation without qualification – control the legal defense to such claim or cause of action, including without limitation attorney selection, strategy, discovery, trial, appeal, and settlement, and TIPS shall, at Vendor’s cost and expense (with respect to reasonable out of pocket costs and expenses incurred by TIPS which shall be reimbursed to TIPS by Vendor), provide all commercially reasonable assistance requested by Vendor.   • Access to Protected Information If BA maintains a designated record set on behalf of CE, BA shall make Protected Information maintained by BA or its agents or subcontractors in Designated Record Sets available to CE for inspection and copying within five (5) days of a request by CE to enable CE to fulfill its obligations under state law [Health and Safety Code Section 123110] and the Privacy Rule, including, but not limited to, 45 C.F.R. Section 164.524 [45 C.F.R. Section 164.504(e)(2)(ii)(E)]. If BA maintains Protected Information in electronic format, BA shall provide such information in electronic format as necessary to enable CE to fulfill its obligations under the HITECH Act and HIPAA Regulations, including, but not limited to, 42 U.S.C.
