Observation/Visitation Clause Samples

The Observation/Visitation clause establishes the right of one party to observe or visit certain activities, locations, or processes related to the agreement. Typically, this clause allows a party—such as a client, regulator, or auditor—to access facilities, review operations, or monitor compliance with contractual obligations, often with advance notice and subject to reasonable restrictions. Its core function is to provide transparency and oversight, helping ensure that the other party is meeting its obligations and that any issues can be identified and addressed promptly.
Observation/Visitation. The employee, if assigned teaching duties, shall be notified at least two (2) weeks in advance of the date, time, and place of any direct classroom observation or visitation made in connection with the employee's annual evaluation. If the employee determines that this date is not appropriate because of the scheduled class activities, the employee may suggest a more appropriate date. Classroom visitation without prior notice, for non-evaluative purposes, may be made with permission of the employee.
Observation/Visitation. Observation visitations normally will be for periods of sixty (60) minutes; however, the period of time of an observation visitation may be shortened or lengthened by the mutual agreement of the unit member and the evaluator. In that the purpose of evaluation is the improvement of instruction, positive instructional features observed during the observation visitation should receive as much, if not more, emphasis than negative features. The evaluator should complete the evaluation forms during or immediately following the observation visitation.
Observation/Visitation. (1) When a faculty member or a chair/supervisor requests a direct classroom observation, the chair/supervisor shall notify the faculty member at least two (2) weeks in advance of a two (2) week period within which classroom observation/visitation(s) may occur in connection with the faculty member’s annual evaluation. Upon receipt of this notification, the faculty member shall advise his/her chair/supervisor regarding any day and time that classroom observation/visitation is not appropriate because of the nature of the class activities scheduled for that day and may suggest a more appropriate date. (2) If the chair/supervisor does not choose to observe/visit the faculty member’s classroom on a date suggested by the faculty member, the chair/supervisor may as an alternative notify the faculty member at least two weeks in advance of an alternative two (2) week period within which the classroom observation/visitation (s) will occur. (3) A written report of the observation/visitation shall be submitted to the faculty member within two (2) weeks of the observation/visitation. If the observation/visitation involves a course that was assigned to the faculty member with less than four (4) weeks’ notice, that fact shall be noted in the report. The faculty member may submit a written reply which shall be attached to the report. (4) If the faculty member believes the classes observed were not indicative of the faculty member’s performance, the faculty member may submit a written request within one (1) week after receiving the report requesting that the chair/supervisor revisit within the next two (2) weeks. A faculty member’s request for a chair/supervisor revisit may only be submitted once per semester. If a revisit occurs, a written report of the revisit shall be submitted to the faculty member within two (2) weeks of the revisit. Observation/Visitation. The observation visitations shall take place within twenty (20) workdays of the pre-observation conference. (a) The chair shall notify a faculty member at least fifteen (15) days in advance of the date and time of any direct classroom observation(s) or visitation(s). If the faculty member determines that this date is not appropriate because of the nature of the class activities scheduled for that day, the faculty member may suggest a more appropriate date or dates. (b) Notwithstanding the above, if the chair has received a complaint or other information that gives rise to immediate concerns about the conduct of the class, the chair may observe or visit the class at any time without notice to the faculty member. (c) A written report of the observation/visitation shall be submitted to the faculty member within two (2) weeks of the observation/visitation. The faculty member shall be offered the opportunity to discuss the report with the evaluator prior to its being finalized and placed in the employee’s evaluation file and may submit a written reply, which shall be attached to the report. If the course involved was assigned to the faculty member with less than six (6) weeks’ notice, the report shall include this information.
Observation/Visitation. All formal observations and evaluations shall be consistent with the terms of this Agreement. i. A pre-observation conference will occur prior to the 1st observation by mutual agreement of the unit member and the evaluator. A pre- observation conference may occur prior to the 2nd or subsequent observation at the request of either the unit member or the evaluator. ii. The first observation will be scheduled by the evaluator with the unit member and will occur prior to Winter Break. iii. A second observation and any subsequent observation, if any, will be scheduled by the evaluator with the unit member and will occur between the 1st observation and May 1. iv. The classroom observation(s) will be a minimum period of thirty (30) consecutive minutes for each observation. Evaluators will use the Evaluation Rubric for all observations, which shall be signed by the Evaluator and the Unit Member. Observations of classroom performance may not be conducted the day prior to Thanksgiving, Christmas, or spring break. When the unit member has had an extended absence of one (1) week or more, an observation may be conducted on or after the third (3rd) school day following his/her return. v. Observations will be reduced to writing and presented to the unit member within ten (10) school days of the classroom visit for the unit member’s perusal and signature, except when extenuating circumstances require a longer period, and be returned to the evaluator in a timely manner. vi. A post-observation conference will be held as mutually agreed by the unit member and the evaluator
Observation/Visitation. The evaluator or the evaluator’s representative may conduct classroom observation/visitation in connection with the employee’s evaluation. If such classroom observations/visitations are conducted, no fewer than two observations/visitations shall be completed during the evaluation period. a. Absent immediate concerns described below, the evaluator shall notify the employee at least two days in advance of the date and time of any direct classroom observation or visitation. If the employee determines this date is not appropriate because of the nature of the scheduled class activities, the employee may suggest a more appropriate date. b. If the evaluator has received a complaint or other information that gives rise to immediate concerns about the conduct of the class, the evaluator or the evaluator’s representative may observe or visit the class at any time without notice to the employee. c. Observation/visitation of online classroom settings is permitted at any time. d. A written report of the observation/visitation shall be submitted to the employee, if the employee requests a report, within two weeks of the observation/visitation. If the observation/visitation involves a course that was assigned to the employee with less than six weeks’ notice, such change shall be noted in the report. The employee shall be offered the opportunity to discuss the evaluation with the evaluator prior to its being finalized and placed in the employee’s evaluation file and may submit a written reply within thirty days of receipt, which shall be attached to the report.
