Operator’s StaffThe Operator shall provide the Operation Services through the Staff in accordance with this Agreement. The Operator shall ensure that the Staff are suitably qualified, experienced and competent for the performance of the Operation Services and shall be responsible for selecting, hiring, employing, and assigning the Staff in accordance with this Agreement and obtaining all necessary authorisations relating to them. The Staff shall take instructions from and report to the Plant Manager on all matters relating to the Plant, the Operation Services and the Site, including such reports as identified in Appendix 1, part II.
Operator’s Staff. 6.3.1 All personnel deployed by the Operator will be qualified to perform and shall be appropriately experienced (or be efficiently trained) in the duties that are assigned to them. The Operator will send the resumes of its key personnel to be deployed for the performance of the O&M Services, including any changes to such key personnel from time to time, to the Authority for the Authority’s information and records. Providing such information to the Authority will not absolve the Operator of its obligations and liabilities under this Contract. 6.3.2 The Operator will deploy at its own cost any additional experts required for performing the O&M Services including the experts from the OEM. 6.3.3 All personnel, employees, labour (skilled, semi-skilled and unskilled), Sub-Contractors, and their respective employees, contractors (of the Sub-Contractors), officers, licensees, invitees, agents and representatives engaged in the performance of the Operator’s obligations under this Contract and who are assigned at the Terminal and any other personnel notified to the Authority by the Operator as the personnel acting for or on behalf of the Operator will be the employees of the Operator (“Operator’s Staff”). The working hours, rates of remuneration, and all other matters relating to their employment, subject to requirement of Applicable Law, will be determined solely by the Operator, the Operator will be responsible for all the acts and omissions of the Operator’s Staff in the course of providing the O&M Services, including non- fulfilment of obligations, negligence, Wilful Misconduct and violation of the terms and conditions of this Contract. 6.3.4 The Operator will be solely responsible with respect to the employment policies regulating the Operator’s Staff. 6.3.5 The Operator will be responsible for paying the salaries and all benefits of the Operator’s Staff. There will be no liability on the Authority for the costs of employment during and beyond the Operating Period, unless any of the concerned Operator’s Staff has been retained by the Authority, after the Termination. The Operator shall indemnify the Authority and hold the Authority harmless, for all costs and consequences in respect of any claim that may be made against the Authority in this regard. 6.3.6 The Operator will ensure at all times that sufficient number of the Operator’s Staff are present for providing the O&M Services during the Operating Period. Operator’s StaffThe Operator shall provide the Staff in accordance with this Agreement. As at the Effective Date, the Operator shall provide the Staff set out in Appendix 5. The Operator shall ensure that the Staff are suitably qualified, experienced and competent for the performance of the Operation Services and that they shall have the same level of qualifications, experience and competence for the performance of such Operation Services as staff who provide similar services for the other operations of the Operator and its Affiliates at the Site. The Operator shall be responsible for selecting, hiring, employing and assigning the Staff in accordance with this Agreement and obtaining all necessary authorisations relating to them.
Operator’s Staff. 7.1 The Operator shall forthwith give notice in writing to the Executive Officer & Town Clerk of the identity address and telephone numbers of any person authorised to act for any period as deputy for the Operator 7.2 The Operator (or a competent deputy duly authorised by the Operator to act on his behalf) shall be present at the Location and be available to the Executive Officer & Town Clerk in person at all times during which the Service is provided. The Operator or a competent deputy must wear lapel badges (bearing the words “Premises Supervisor”) at all times so that they can be identified by the Council’s employees and visitors for the purposes of customer safety and the preservation of order. 7.3 The Operator shall ensure that his employees perform their duties in an orderly manner and in as quiet a manner as may reasonably be practicable having regard to the nature of the duties being performed by them 7.4 The Operator shall ensure that his employees observe the security of any secured areas of the Council's premises 7.5 The Operator shall require his employees at all times while engaged in provision of the Service to be properly and presentably dressed in appropriate uniforms or workwear to the satisfaction of the Council 7.6 Where the nature or the place of any duties upon which the Operators employees shall be engaged in the provision of the Service make the wearing of any special or protective clothing or footwear necessary or appropriate the Operator shall provide and shall require his employees to wear such clothing or footwear 7.7 The Operator shall at all times be fully responsible for the payment of all income or other taxes national insurance contributions or levies of any kind relating to or arising out of the employment of any person employed by the Operator and shall fully and promptly indemnify the Council in respect of any liability of the Council in respect thereof 7.8 The Operator shall ensure that his/her employees are paid at an hourly rate in excess of the minimum required in the National Minimum Wage Act 1999 (as amended from time to time by the National Minimum Wage Regulations)
Operator’s Staff. 10.1 Safety of Staff The Operator will be fully responsible and liable for the health and safety of the Operator's Staff and the personal property of the Operator’s Staff, and indemnifies and releases QR to the extent permitted by law from any liability in relation to the Operator's Staff except to the extent that such liability is caused by the wilful default or negligence of QR or QR’s Staff. 10.2 Qualifications of Operator's Staff The Operator must: (a) ensure that all risks associated with Safety Related Work (including the competence of all Operator’s Staff to safely and properly discharge their duties related to the exercise of the Operator’s rights or performance of its obligations under this Agreement) are addressed in the Interface Risk Assessment; (b) ensure that all Operator’s Staff hold and keep current all qualifications and accreditations required under any Law and as specified in Part 2 of Schedule 9 and undertake any additional training from time to time in order to keep current such qualifications and accreditations; (c) meet all costs of any training and/or testing required to meet the requirements of this Clause 10.2; and (d) keep QR advised of the names and position titles of all Operator's Staff engaged in Safety Related Work on the Nominated Network and ensure that all Safety Related Work is performed only by those Operator’s Staff whose details have been provided to QR in accordance with this Clause 10.2 and who satisfy the requirements of this Clause 10.2.

Related to Operator’s Staff

  • Contractor’s Staff 1. The Contractor shall maintain adequate staff to meet the Contractor’s obligations under this Agreement. 2. This staff shall be available to the State for training and meetings which the State may find necessary from time to time.

  • B5 Contractor’s Staff The Authority may, by written notice to the Contractor, refuse to admit onto, or withdraw permission to remain on, the Authority’s Premises:

  • Operators Any and all Operators of the Equipment shall be duly experienced, trained and qualified to operate Equipment of this type. Although We may, from time to time, recommend certain qualified Operators with whom We are familiar, We do not supply Operators. You must supply and employ any Operator who operates the Equipment and that Operator shall be deemed to be Your employee and acting under Your supervision or control for all purposes and shall be covered as an insured on all of Your applicable insurance policies.

  • Supplier’s Staff 3.3.1 Access to the Premises shall be limited to such Staff and the Supplier’s suppliers as are necessary for the Supplier to fulfil its obligations under the Contract. The Supplier shall co-operate with others working on the Premises to such extent as the Authority may reasonably require. 3.3.2 The Authority reserves the right to refuse to admit to, or to withdraw permission to remain on, the Premises:- (a) for any member of the Staff; or (b) for any person employed or engaged by any member of the Staff, whose admission or continued presence would be, in the reasonable opinion of the Authority, undesirable. 3.3.3 At the Authority’s written request, the Supplier shall provide a list of the names and business addresses of all persons who may require admission in connection with the Contract to the Premises, specifying the capacities in which they are concerned with the Contract and giving such other particulars as the Authority may reasonably request. 3.3.4 The Supplier’s Staff, engaged within the boundaries of the Premises, shall comply with such rules, regulations and requirements (including those relating to security arrangements) as may be in force from time to time for the conduct of personnel when at or outside those premises. 3.3.5 If the Supplier fails to comply with Clause 3.3.3 within one (1) Month of the date of the request and in the reasonable opinion of the Authority, such failure may be prejudicial to the interests of the Crown, then the Authority may terminate the Contract, provided always that such termination shall not prejudice or affect any right of action or remedy which shall have accrued or shall thereafter accrue to the Authority. 3.3.6 The decision of the Authority as to whether any person is to be refused access to the Premises and as to whether the Supplier has failed to comply with Clause 3.3.3 shall be final and conclusive.

  • Operator The Optionee shall be the operator for purposes of developing and executing exploration programs.

  • Instructions for Operators This agreement is intended to be provided to an Operator from a LEA. The Operator should fully read the agreement and is requested to complete the below areas of the agreement. Once the Operator accepts the terms of the agreement, the Operator should wet sign the agreement and return it to the LEA. Once the LEA signs the agreement, the LEA should provide a signed copy of the agreement to the Operator.   • Project Staff Contractor shall appoint to the Project Staff: (i) individuals with suitable training and skills to provide the Work, and (ii) sufficient staffing to adequately provide the Work. Contractor shall make commercially reasonable efforts consistent with sound business practices to honor the specific request of the JBE with regard to assignment of its employees. The JBE may require Contractor to remove any personnel from the Project Staff that interact with any personnel of the Judicial Branch Entities or JBE Contractors (including, without limitation, the Contractor Project Manager) upon providing to Contractor a reason (permitted by law) for such removal. Contractor may, with the JBE’s consent, continue to retain such member of the Project Staff in a role that does not interact with any personnel of the Judicial Branch Entities or

  • Operations Fire An “Operations Fire” is a fire caused by Purchaser’s Operations other than a Neg- ligent Fire.

  • Personnel, Office Space, and Facilities of Manager The Manager at its own expense shall furnish or provide and pay the cost of such office space, office equipment, office personnel, and office services as the Manager requires in the performance of its investment advisory and other obligations under this Agreement.

  • Contractor Staff All employees of the Contractor, or of its subcontractors, who perform Project Based IT Consulting Services under the resulting Authorized User Agreement, shall possess the necessary qualifications, training, licenses, and permits as may be required within the jurisdiction where the services specified are to be provided or performed, and shall be legally entitled to work in such jurisdiction. All persons, corporations, or other legal entities that perform Services under the Contract on behalf of Contractor shall, in performing the Services, comply with all applicable Federal, State, and local laws concerning employment in the United States. The following requirements shall apply in addition to the requirements of Appendix B, section 42, Employees, Subcontractors and Agents, unless otherwise agreed to by the Authorized User:
