PEG Set Aside. 5.1.1. In order to ensure universal availability of public, educational and government programming, Franchisee shall provide capacity on its Basic Service tier for up to one (1) dedicated Public Access Channel, one (1) dedicated Educational Access Channel, and up to one (1) dedicated Government Access Channel (collectively, “PEG Channels”). 5.1.2. The programming to be carried on each of the PEG Channels set aside by Franchisee is reflected in Exhibit C attached hereto. The LFA hereby authorizes Franchisee to transmit such programming within and without LFA jurisdictional boundaries. Franchisee specifically reserves the right to make or change channel assignments in its sole discretion. If a PEG Channel provided under this Article is not being utilized by the LFA, Franchisee may utilize such PEG Channel, in its sole discretion, until such time as the LFA elects to utilize the PEG Channel for its intended purpose in accordance with Section 895.4 of the NY PSC rules and regulations. 5.1.3. Franchisee shall provide the technical ability to play back pre- recorded programming provided to Franchisee consistent with this Section. Franchisee shall transmit programming consistent with the dedicated uses of PEG Access Channels. In the event that the LFA determines to use PEG capacity, the LFA shall provide Franchisee with prior written notice of such request in accordance with NY PSC rules and regulations. 5.1.1 Subject to Article 3 hereof, Subscribers within the Freeport School District located within the jurisdictional boundaries of the LFA shall receive the PEG Channels set aside by Franchisee pursuant to this Franchise. 5.1.2 To the extent the Franchisee is providing an Educational Access Channel to Subscribers in the unincorporated areas of the Town of Hempstead residing in the Xxxxxxx Union Free School District pursuant to the Franchisee’s cable franchise agreement with the Town of Hempstead, the Franchisee shall also provide such Educational Access Channel to Subscribers residing in those areas within the jurisdictional boundaries of the LFA that are within the Xxxxxxx Union Free School District. Franchisee shall provide the technical ability to play back pre-recorded programming provided to Franchisee consistent with this Section. Franchisee shall transmit programming consistent with the dedicated uses of PEG Access Channels. Franchisee shall comply at all times with the requirements of Section 895.4 of the NY PSC rules and regulations.
PEG Set Aside. 8.1.1. In order to ensure universal availability of Public, Educational and Government Access programming, Franchisee shall, not later than one hundred eighty (180) days from the Effective Date (or, with respect to any Governmental/Educational Access Channels, such later date as may be agreed upon by the City and Franchisee in the event Franchisee reasonably requests an extension in order to complete necessary work), provide on the Basic Service Tier use of twenty-five (25) access channels in total, as set forth immediately below in Section 8.1.1.1 (each, an “Access Channel”):
PEG Set Aside. 6.1.1. In order to ensure universal availability of public, educational and government programming, Franchisee shall provide, at no charge to the City, up to three (3) video Channels for noncommercial PEG use by the City (the “PEG Channels”). Programming for the City’s PEG Channels shall be determined by the City. Within ten (10) days after the Effective Date the City, shall notify Franchisee in writing of which PEG Channels are active and in use and for informational purposes only whether each such PEG Channel is an Educational Access Channel, a Governmental Access Channel or a Public Access Channel. 6.1.2. All PEG programming shall be carried on Franchisee’s Basic Service Tier. If there is no Basic Service tier, Franchisee shall provide the PEG Channels as part of the lowest cost package offered to Subscribers in accordance with federal law. If Channels are selected only through a menu system, PEG Channels will be displayed as such on the menu. The City’s PEG Channels shall be transmitted to all Subscribers in the Franchise Area. Nothing herein shall prevent Franchisee from transmitting a PEG Channel to Subscribers outside the Franchise Area. Each PEG Channel shall be delivered with transmission quality the same as or better than the transmission quality of non-PEG channels carried on Franchisee’s Basic Service Tier, subject necessary allowances for the quality level in which such PEG Channel programming is received by the Franchisee. 6.1.3. Each PEG Channel shall be transmitted on the System in standard 6 MHz, unscrambled NTSC format so that every Subscriber can receive and display the PEG signals using the same converters and signal equipment that is used for other Basic Service Channels. If capacity on the Cable System dedicated for public, educational or governmental access use is subdivided or compressed resulting in multiple transmission paths, Franchisee will transmit the PEG Channels on its Cable System in this format and will reserve the capacity to provide the required PEG Channels to the City. 6.1.4. If Franchisee makes changes to Franchisee’s Cable System or its technology that require improvements or changes to PEG access facilities and equipment in order to be compatible, Franchisee shall provide any necessary additional headend and distribution facilities or equipment within thirty (30) days so that PEG facilities and equipment may be used as intended with respect to the PEG Channels specified in Subsection 6.1.1, including, among other th...
PEG Set Aside. 6.1.1. In order to ensure universal availability of public, educational and government programming, Franchisee shall provide three (3) HD PEG Access Channels on the Basic Service Tier. The HD PEG Access Channels shall be designated as follows: one (I) dedicated County Government Access Channel, one (I) Government Access Channel dedicated to carrying programming related to towns within the County, and one(\) Education Access Channel dedicated to the Loudoun County Public Schools (collectively, "PEG Channels"). The SD PEG Access Channel dedicated to higher education shall be maintained for the term of the Franchise Agreement, provided, however, that if the Xxxxxx Xxxxx University Channel, or another channel that is (i) operated by a Virginia college or university; (ii) already carried on the Cable System, and (iii) designated by the County as an Educational Access Channel, is provided to the Franchisee in HD format, the Franchisee shall convert the corresponding existing SD PEG Access Channel to HD within six months of the date that the HD programming is provided. PEG Access Channels shall require no equipment other than the equipment used by a Subscriber to receive commercial Cable Services. The County acknowledges that if a Subscriber does not have the equipment necessary to receive commercial Cable Services in HD, the Subscriber will not be able to view PEG Channels in HD without obtaining the appropriate HD equipment and subscribing to a service package that includes HD service. 6.1.2. In addition to the PEG Access Channels in Section 6.1.1, upon one hundred eighty (180) days prior written notice, the County may request one additional HD PEG Access Channel when the cumulative time on all the existing Access Channels combined meets the following standards: at least eighty percent (80%) of the cumulative time of sixty (60) hours per week over a consecutive sixteen (16) week period has been programmed with original, non- character generated, non-commercial, non-duplicative locally produced PEG Access Channel programming. Any upgrade of current return lines or construction of new return lines required to provide the additional PEG Access Channel shall be at the Franchisee's expense. Franchisee reserves the right to pass its costs of upgrading or construction new return lines through to Subscribers in accordance with applicable law. 6.1.3. Franchisee will reserve one (1) additional PEG Channel dedicated exclusively to PEG purposes and will make available such additional PEG Channel pursuant to the following criteria: 6.1.2.1. Either, such additional PEG Channel will be used as a Public Access Channel, or LFA must provide Franchisee written documentation (e.g., programming schedules for the existing PEG Channel(s)) of its need for additional programming capacity that cannot be fulfilled by existing PEG Channel(s). Such need may be demonstrated by the use of the existing PEG Channel(s) for PEG programming within the LFA for at least six
