Personal Contracts. (a) Each tenured member of the National Ballet Orchestra shall receive a personal contract (see Appendix A) and tentative schedule for the following contract year by April 1st. Non-tenured members of the National Ballet Orchestra shall receive a personal contract and schedule no later than sixty (60) days before the first scheduled service following the end of the musician's first full year. When required, the date for issuing the personal contract will be agreed among the National Ballet, Orchestra Committee, and TMA on a case-by-case basis. The contract shall specify if the position is Touring [Article 8 (a) and 8 (c)], Toronto only [Article 8 (a)], or Augmenting [Article 8 (b)]. The twelve-month book-form schedule, including a contact list for the National Ballet Orchestra, shall be mailed to Orchestra members by July 1.

At the time of notification of their hours of work for the following year, paraprofessionals will sign a form stating whether they accept or reject these hours and return it to the board office. Language to be included on this form: "Either party has the right to terminate the job position giving two (2) weeks notice" Notification of employment for the following school year will take place by July 15th.

Any individual contract or agreement between a Contractor and an employee which sets out terms and conditions of employment in variance with the terms and conditions of employment contained in this Agreement shall be null and void in respect of employees covered by this Appendix while they are employed under this Agreement.

Personal Contracts. Musicians’ personal contracts shall specify their ranking (X-0, X-0, or A- 3), position in the section (except string section seating), instrument(s) to be played, and compensation. No later than May 1, the following information shall be provided to each musician for the following season:
1. His/her personal contract, including a warning of impending jeopardy status if the musician has not yet played the required number of services during the current season,
2. A tentative schedule of rehearsals and concerts planned for the season,
3. A tentative rehearsal order,
4. A tentative list of programs (as known) with publisher’s and composer’s instrumentation for each piece, and
5. A specific schedule (Initial Service Offer) of at least 75% of his/her contracted services for the following season. However the employer may not offer personal contracts to musicians until the Master Agreement with the AFM has been ratified. Upon receipt of a personal contract, the musician shall return said contract, signed, to the employer by June 1 or within two weeks, whichever is later. After this time any unaccepted position may be declared open for audition. The employer shall make all reasonable effort to ensure that the individual contracts are actually delivered to the named individuals in person or shall obtain verbal or written confirmation of receipt. The date of such delivery or confirmation of receipt shall determine the acceptance period. The employer shall acknowledge the receipt of the signed contract from each musician, keep one copy and file another copy with the AFM within two weeks after receiving the signed contract. The Society shall issue a final rehearsal and concert schedule for the coming season no later than July 1. Notification by the Society to the musicians and by the musicians to the Society should be in writing.

A. Salaries retroactive to July 1, 2013.
B. Paraprofessionals will be paid twice a month. Each paraprofessional’s yearly pay will be determined by multiplying the hourly rate of pay by the scheduled hours per day by the number of days scheduled to work within the 184-day calendar. Two (2) in- service days will be included in the scheduled number of work days. Paraprofessionals are to report to their respective building principals for in-service training and/or assignment.
C. Paraprofessionals scheduled to work will not be docked for snow/weather-related closings. In case of delayed openings or early dismissals, paraprofessionals scheduled to work will receive full pay for these days. Any docking will be applied to contract pay as they occur.
D. Overtime must be approved in advance by the building principal or supervisor and will be paid by payroll voucher as supplemental pay on a monthly basis.
E. Overtime - If a paraprofessional is asked by their building principal to stay beyond their normal hours of work, they will be reimbursed at their hourly rate of pay.

Personal Contracts. A. Administrators will be employed on a three-year basis with the contract extended annually.
B. Any administrator whose contract renewal status is uncertain or whose contract is not renewed shall receive notification as follows:
1. An administrator who receives notice from the Superintendent by March 1 of the second year of the contract that the administrator’s contract renewal status is uncertain shall, if the contract is not to be renewed, receive final notification of non-renewal by March 1 of the third year of the contract. During the period following the initial notification, an action plan for improvement will be developed between the Superintendent and the Administrator involved.
2. Individual salary contracts shall be returned to the Superintendent no later than March 15. If negotiations are still in progress on March 1, the administrators will indicate in writing their intent to continue as administrators for the ensuing school year with the understanding that individual contracts shall be returned no later than fourteen (14) calendar days after issuance by the Committee. Individual contracts will be consistent with the terms of this agreement.
Personal Contracts. Except as disclosed on Schedule 3.14.(j), the Company has not entered into and is not bound by any contract, agreement, commitment or arrangement for personal services or severance of relationship involving annual payments in excess of $50,000.
Personal Contracts. For the purpose of Probationary and/or Permanent Contracts, the words 'in accordance with the Collective Agreement" be entered place of the actual salary figure.
