PHYSICAL FITNESS AND WELLNESS. Section 1. The City will provide a fitness area at each permanent city-owned fire station and maintain all City purchased equipment for those areas. Fitness areas inside the fire stations may be used by bargaining unit employees any time on duty, provided the daily duties and assignments are complete. Section 2. The Fire Chief may administer, at his discretion, an accepted physical abilities test no more than once per year. The test may only be administered with four (4) weeks' notice and may only take place in the months of March, April, May, October, or November.

Physical fitness is the personal responsibility of each Union member. The City and the Union both support and encourage firefighters to be physically active and to be involved in a personal program of regular exercise. Toward that end, Union firefighters shall perform one (1) hour of physical fitness per duty shift and may have a biennial full medical physical
PHYSICAL FITNESS AND WELLNESS. Section 1: The Union and the City agree that the physical fitness of Union members is important to their health and safety. Physical fitness is the personal responsibility of each Union member. The City and the Union both support and encourage firefighters to be physically active and to be involved in a personal program of regular exercise. Toward that end, Union firefighters shall perform one (1) hour of physical fitness per duty shift, and may have an annual body composition analysis, paid for by the City, with the results being confidential to the Union member. Section 2: The City will provide employees with a wellness incentive intended to reward an employee for good attendance. The reward structure is based on the number of hours of sick leave used in a calendar year. Hours of sick leave for a duty related disability will not be considered when calculating this benefit. Duty related disability is defined as those hours of sick leave that are approved by the Department of Labor and Industries for an injury or illness sustained while in the service of the employer. All other hours of sick leave will be considered.
PHYSICAL FITNESS AND WELLNESS. The City will provide health screenings at no cost to the Members in accordance with Appendix A, attached hereto, unless otherwise agreed to by the City and the Union. The Union agrees that it is a condition of continued employment that all Members participate in this screening, except that those screenings available through employee health insurance are voluntary and are only available free in accordance with terms of the employee health insurance. The City recognizes that the Members may, in the course of their duties, be exposed to infectious diseases, such as, but not limited to, tuberculosis, hepatitis B, and the human immunodeficiency virus (HIV), as well as to a variety of known carcinogens. The City agrees to, on an annual basis, provide training to the Members aimed at preventing such exposures in the workplace. The City will make reasonable efforts to prevent such exposures. The City will maintain an accessible reporting system by which Members can document exposures to infectious diseases and/or hazardous substances, and the City will ensure that the Members are encouraged to report exposures to the City's Risk Management division as they become aware of them. The City's Risk Management division will assure all claims are filed with the Missouri Division of Workers' Compensation.
PHYSICAL FITNESS AND WELLNESS. ‌ A. Physical fitness of each and every Association Employee is a top priority in ensuring the most efficient and effective service possible to our citizens, and in accomplishing City's risk management goals and objectives. B. Employees may participate in a voluntary physical fitness/agility test for unit employees as developed by City. The Association shall be permitted input in the development of the program. The determination of the City Manager and Fire Chief shall be final and conclusive in the adoption of said program. C. City agrees to pay each Association member one annual $200.00 physical fitness bonus/reimbursement upon submission of current proof of payment of one annual gym membership fee of $200.00 (or more). In the event the Association member pays for gym membership in a series of installments, member may submit receipts totaling $200.00 for reimbursement. 1. Association members who qualify for the Physical Fitness Bonus must submit a Claim for Payment. 2. Receipt issued by the established physical fitness gymnasium for current individual Association membership must also accompany above Claim for Payment. Reimbursement shall be paid for no more than $200.00 per year. D. City agrees to reimburse Association member's insurance co-pay amount for annual physicals and cancer screenings upon submission of appropriate documentation to the City's Finance Department.

  • Geological and archaeological finds It is expressly agreed that mining, geological or archaeological rights do not form part of this Agreement with the Contractor for the Works, and the Contractor hereby acknowledges that it shall not have any mining rights or interest in the underlying minerals, fossils, antiquities, structures or other remnants or things either of particular geological or archaeological interest and that such rights, interest and property on or under the Site shall vest in and belong to the Authority or the concerned Government Instrumentality. The Contractor shall take all reasonable precautions to prevent its workmen or any other person from removing or damaging such interest or property and shall inform the Authority forthwith of the discovery thereof and comply with such instructions as the concerned Government Instrumentality may reasonably give for the removal of such property. For the avoidance of doubt, it is agreed that any reasonable expenses incurred by the Contractor hereunder shall be reimbursed by the Authority. It is also agreed that the Authority shall procure that the instructions hereunder are issued by the concerned Government Instrumentality within a reasonable period.

  • COVID-19 Vaccine Passports Pursuant to Texas Health and Safety Code, Section 161.0085(c), Contractor certifies that it does not require its customers to provide any documentation certifying the customer’s COVID-19 vaccination or post-transmission recovery on entry to, to gain access to, or to receive service from the Contractor’s business. Contractor acknowledges that such a vaccine or recovery requirement would make Contractor ineligible for a state-funded contract.

  • Library Borrowing privileges available without charge. Upon retirement an employee shall be issued a permanent individual library card.

  • Operator Materials Operator retains all right, title and interest in and to any and all of Operator’s software, materials, tools, forms, documentation, training and implementation materials and intellectual property (“Operator Materials”). Operator grants to the LEA a personal, nonexclusive license to use the Operator Materials for its own non-commercial, incidental use as set forth in the Service Agreement. Operator represents that it has all intellectual property rights necessary to enter into and perform its obligations in this DPA and the Service Agreement, warrants to the District that the District will have use of any intellectual property contemplated by the Service Agreement free and clear of claims of any nature by any third Party including, without limitation, copyright or patent infringement claims, and agrees to indemnify the District for any related claims.
