Second Positive Test. If, within twenty-four (24) months of the First Positive Test, and employee “tests positive” for either alcohol or drugs, the employee shall immediately be placed on a ten (10) work day disciplinary suspension, without pay, during which a conference will be held with the employee and he/she shall be given the option at the end of such disciplinary suspension to either immediately:
a. Voluntarily resign his/her employment with the Board; or
b. Be placed on sick leave, if available, or a voluntary medical leave of absence, without pay, during which the employee must immediately enter a Board approved alcohol or drug treatment program. An employee exercising this option shall remain on sick leave or unpaid medical leave of absence only while remaining an active cooperating patient in the program, as certified by the medical facility supervising the program, and may not return to active working status until he/she has been released to return to work by such medical facility and has been retested with a negative test result and certified by the medical facility as fully capable of performing the duties of the employee in a safe manner. Any employee who exercises this option who is either removed from the program by the medical facility supervising the program or who withdraws from the program before being released to return to work by such medical facility shall be deemed to have resigned his/her employment with the Board. An employee who completes the program who is released to return to work, who tests negative before returning to work and who returns to active working status, shall be subject to retesting.
c. In the event the employee refuses to exercise either of the options specified above in (a) or (b), the employee shall be subject to immediate discharge.
Second Positive Test. The Head of Schools will notify parents/guardians of the results of the second test. • Consequence of a second positive drug test is expulsion. Chain of Custody Procedures • All testing procedures and the handling of the results are to be administered with the utmost confidentiality. Only the Head of Schools will be allowed access to the test results. • Samples will be collected and sent to a laboratory designated by Canton Academy for actual testing confirmation. • A chain of custody form will accompany each specimen from the point of origin through the entire testing process in an effort to ensure complete integrity of the specimen. • A third party administrator will set up the collection site, customize result reporting, provide approved testing services, and other services as needed. Handling of Results • All results will be delivered to the Head of Schools. • The Head of Schools will store all positive test results in a location determined by the administration. Only the Head of Schools will have access to this location. • All positive results will be kept for 7 years after said student’s class is eligible for graduation, at which time the positive test results will be destroyed.
Second Positive Test. Results in immediate termination. Be evaluated by an SAP. Complete an SAP-recommended rehabilitation program. Secure written release from the SAP to return to work. Provide a negative “5 panel US DOT” test result as interpreted by an MRO. Sporadic testing for one (1) year following reinstatement.
Second Positive Test. Upon a second positive test at any time dur- ing the student’s school career in Lincoln County, the contracted MRO shall notify the Superintendent’s designee and the stu- dent’s parents. The parent/ guardian will have three (3) calendar days to conference with the MRO to confirm the results of the test. If the parents fail to conference with the MRO, the test will be reported to the Superintendent’s designee as “positive-non- contact.”
Second Positive Test. At any time during three (3) years from the date of suspension in sub-paragraph 1 above, if the employee tests positive, he may be terminated.
Second Positive Test. Thirty (30) day suspension. If the employee does not test clean at the conclusion of the thirty (30) day suspension, the employee will be on leave without pay until he/she tests "clean" pursuant to DOT regulations. The employee will be subject to mandatory counseling and may be tested for drugs and alcohol at any time. Employees will be offered a last chance agreement that provides for termination if the employee subsequently tests positive for drugs or alcohol. Employees who refuse to sign the agreement will be terminated.
Second Positive Test. The director of athletics, head coach, athletic trainer and, if necessary, the team physician will be notified of the positive test result. The director of athletics, head coach and athletic trainer will have a confidential meeting with the student-athlete. The student-athlete has the option to request that one person of his or her choosing may accompany him/her to this meeting. The student-athlete will be required to notify his/her parent(s), and/or legal guardian(s) or spouse, of the second positive test result in the presence of the head coach and the athletic director. The student-athlete will be required to attend a substance abuse treatment program coordinated by the campus Wellness Center. The student-athlete will be suspended from play and /or practice for the minimum of 28 calendar days. The student-athlete will be required to pass a follow-up test prior to play and/or practice and will be subject to unannounced follow-up drug testing through the remainder of his/her playing career at Columbia College. Refusal to participate in the program as set forth above may be treated as a third positive test result.
Second Positive Test. In the second instance of a positive test (0.04 or greater), the employee shall be sent home and recorded in a no pay status for the balance of the day. Effective the next day, the employee shall be suspended without pay for ten (10) workdays. Following a meeting, first with the MRO within seventy-two (72) hours of the positive test and the SAP if recommended, the employee shall enroll in a treatment program, successfully complete
Second Positive Test a. A positive test will be considered a second occurrence if within 2 years of a first positive test, the employee again tests positive for alcohol or drugs.
b. Counseling and rehabilitation will be recommended again.
c. The return-to-work components are the same with a first positive test. d. Ten (10) working days suspension.
