Promotion Outside the Bargaining Unit. Any employee promoted to a position outside the bargaining unit shall be on a trial period for a period of three (3) calendar months. If an employee is not successful in their new position, or decides to return within the bargaining unit, same will be allowed within the three (3) month period. The employee shall then return to the bargaining unit without loss of seniority, benefits, etc.
Promotion Outside the Bargaining Unit. If a regular employee is promoted or transferred to a position outside the certification and is found to be unsatisfactory or the employee finds the position to be unsatisfactory, the employee shall be returned to her or his previously held classification without loss of seniority and accrued benefits and shall be slotted at the wage rate to which she or he would have been entitled had the promotion not occurred. These terms and conditions apply for a period of ninety (90) working days from the date she or he commences work in the new position. By mutual agreement between the Union and the Employer, this period may be extended to one hundred and twenty working days.
Promotion Outside the Bargaining Unit. An employee who is transferred or promoted to a position outside the bargaining unit may return to her former position within three (3) months from her last day of work in it on the condition that such employee has paid to the Union the equivalent of three (3) months union dues within fifteen (15) days from her date of promotion or transfer. The Union will promptly confirm to the Employer, in writing, that an employee has made her payment to the Union as described at a) above. For purposes of seniority, an employee who returns to her former job within the bargaining unit as provided in this article is treated as if she had never left.
Promotion Outside the Bargaining Unit. An who accepts a management position accumulates his seniority during a period of ninety (90) calendar days from the first day in the management position. During this period the may return to his position within the bargaining unit. At the end of this period, the loses his seniority and all rights and advantages provided for in this Agreement.

However, the *Professional Agreement should state “applicants from technical or CNA bargaining unit…” *Technical Agreement should state “applicants from professional or CNA bargaining unit…” Employer wishes to reassure the Union that it recognizes the desirability of promoting from within the bargaining unit to higher level positions and expects to follow the policy whenever appropriate. The parties recognize that the Employer’s decisions in this regard are not subject to the grievance and arbitration provisions of this Agreement. When such positions are posted, they will be posted on the Personnel bulletin board.
Promotion Outside the Bargaining Unit. The parties recognize that promotions to positions outside the bargaining unit are not appropriately a subject of collective bargaining. However, the Employer wishes to reassure the Union that it recognizes the desirability of promoting from within the bargaining unit to higher level positions and expects to follow that policy whenever appropriate. The parties recognize that the Employer’s decisions in this regard are not subject to the grievance and arbitration provisions of this Agreement. When such positions are posted, they will be posted on the Human Resources bulletin board.
Promotion Outside the Bargaining Unit. 10-1 Owner-Operators/Employees who accept a position with the Company not subject to this Collective Agreement will retain their seniority after such appointment for a one hundred and eighty (180) calendar day period only. If returned for any reason or if they voluntarily request reinstatement to their former position, the time served in the exempt position shall be included in their seniority rating. Such Owner-Operators/Employees shall forfeit any and all recourse to the Grievance Procedure as outlined in this Agreement should he subsequently be discharged in said position beyond the jurisdiction of this Agreement. This Article is to be applied only once for any Owner-Operator/Employee during the term of this Agreement, unless the parties agree otherwise.
Promotion Outside the Bargaining Unit. A bargaining unit member in good standing who promotes to a City position outside the bargaining unit shall continue to accrue seniority with the bargaining unit for a period of six (6) months and may be returned or may elect to return within six (6) months of said promotion to his/her original position in the bargaining unit, without loss of seniority. Where a regular City employee is promoted into the bargaining unit, they will be subject to the sixty (60) day promotional period defined in “Article 11- Permanent Vacancies” rather than the six (6) month probationary period of new employees.
Promotion Outside the Bargaining Unit. An employee in a classification represented by the Union who has been in the past, or will be in the future, promoted to a position outside the bargaining unit, may return to the bargaining unit in the same position from which employee left without loss of seniority for a trial period of ninety (90) calendar days. This provision shall not preclude the Employer, during this initial ninety (90) day trial period, from demoting the employee to employee’s former position if, in the opinion of the Employer, the employee is not performing satisfactorily. In this case, the employee will return to employee’s former position and seniority status. After completion of the initial ninety (90) day trial period, a promoted employee no longer in the bargaining unit may regain seniority status in the bargaining unit if there is an open position which employee has previously held prior to employee’s promotion. Upon return to the bargaining unit, the employee shall maintain the classification seniority he/she held prior to the promotion to the non-bargaining unit position. All vacancies created by promotions outside the bargaining unit shall be of a provisional status during the initial ninety (90) day trial period. Upon completion of the ninety (90) day trial period, all provisional appointments shall become permanent.
