Qualifications for Use of Sick Leave. A. Sick leave with pay shall be allowed by ISD 196 whenever a teacher’s absence is found to have been due to illness of the teacher or teacher’s child which prevented the teacher’s attendance at school and performance of duties on that day or days. B. For teachers who work 1,480 hours per year (or 1.0 FTE), up to 40 hours per occurrence may be charged to sick leave for absences due to the serious illness of the teacher's: brother, sister, grandparent, grandchild, parent of the teacher's spouse, all in-laws of the same degree, and legal conservatee (with legal documentation). For teachers who work less than 1,480 hours per year (less than 1.0 FTE), up to their FTE multiplied by 40 hours per occurrence may be charged to sick leave for absences due to the serious illness of the teacher’s relatives listed above. C. For teachers who work 1,480 hours per year (or 1.0), up to 56 hours per occurrence may be charged to sick leave for the serious illness of the teacher’s spouse or parent. For teachers who work less than 1,480 hours per year (less than 1.0 FTE), up to their FTE multiplied by 56 hours per occurrence may be charged to sick leave for the serious illness of the teacher’s spouse or parent. D. Teachers who have been employed by ISD 196 for at least twelve (12) months prior to the leave and who worked at least one half of the full time equivalent during those twelve (12) months may use up to 160 hours of sick leave in any twelve (12) month period for the illness or injury of the teacher’s adult child (including stepchild, biological, adopted, and xxxxxx child), spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent, or stepparent for reasonable periods of time as the employee’s attendance may be necessary. This provision is not intended to increase or decrease the amount of time provided for in A through D above except as otherwise required by law. This provision shall be in effect only as required by MN Statute 181.9413. E. Qualifications for Use of Sick Leave. 1. Employees must report their absence and the reason for the absence to the Chief or his/her designee with as much advance notice as possible but no less than one (1) hour prior to the beginning of their scheduled shift. 2. If an employee is sick for three (3) or more consecutive working days, the employee taking such leave shall furnish the Chief with a certificate of illness signed by a licensed physician, if requested. In said certificate, the physician must certify the following: a. The employee was ill during the period of his or her absence; and b. The employee is medically able to return to work. 3. Employees must keep the Employer informed of their condition and anticipated return to work date and must permit the Employer to make such medical inquiry as determined necessary and lawful. Any misuse of sick leave or the making of false reports regarding illness may subject the employee to disciplinary action, including discharge and may also be considered just cause for the loss of all or part of accrued sick leave benefits not to exceed the amount of sick leave determined to have been misused.

B. Up to seven (7) days of sick leave may be charged to sick leave per occurrence for absences due to the serious illness of a CFA’s spouse, parent, brother, sister, grandparent, grandchild, all in-laws of the same degree, and legal conservatee (with legal documentation), and all persons living in the household who rely on the support of the CFA. CFAs who have been employed by ISD 196 for at least twelve (12) months prior to the leave and who worked at least one half of the full time equivalent during those twelve (12) months may use up to 160 hours of sick leave in any twelve (12) month period for the illness or injury of the CFA’s adult child (including stepchild, biological, adopted, and xxxxxx child), spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent, or stepparent for reasonable periods of time as the employee’s attendance may be necessary. This provision is not intended to increase or decrease the amount of time provided for in A and B above except as otherwise required by law. This provision shall be in effect only as required by MN Statute 181.9413. C. CFAs may use sick leave in one-half or full day increments. D.
