Road Safety. In the past few years there has been an increase in the number of deaths and injuries on the Dutch roads, including among vulnerable road users like cyclists and pedestrians. We need to curb this trend. We will work with sector organisations, provincial and municipal authorities and enforcement bodies to achieve the objectives set out in the document ‘Verkeersveiligheid: een nationale prioriteit’ (Road safety: a national priority). • We will invest with the provincial authorities in safe road design, particularly on secondary roads. We are also committed to influencing road conduct, and to intelligent enforcement and better registration of the causes of road accidents. • The street lighting on motorways will be switched on again in the evenings and at night if it helps to improve road safety. • Habitual traffic offenders will be dealt with more severely. The system of fines will be changed so that fines for dangerous driving or repeated offences will be increased, and fines for minor offences may be reduced. Goods transport • We will encourage the use of quieter goods trains and the Betuwe line to reduce nuisance in the vicinity of other railway lines. • The inland waterways and the railways can play a major role in limiting a further increase in volume of goods transported by road and reducing harmful emissions. As an incentive to transporting goods by rail, we will bring user charges in line with those levied in our neighbouring countries. For inland shipping, the hours of operation of bridges and locks will be more closely coordinated. • Substantial environmental gains can still be achieved in the maritime and inland shipping sectors. A Green Deal for sustainable maritime and inland shipping and ports will be concluded with the sector. • The government is committed to introducing low emission zones for all European waters in order to ensure a level, more sustainable playing field. • Dutch sea ports are obliged to pay company tax. At the same time, they invest in public infrastructure which, in our neighbouring countries, is provided by the government. A review of infrastructure cost allocation should again bring the Dutch ports onto an equal footing with ports in our neighbouring countries. • In line with the Council of State’s recommendations, businesses in the transport sector will only pay the costs involved in acquiring licences, while the government will be liable for the costs of oversight and enforcement. • We will introduce distance-based road p...
Road Safety. 8. The Borrower shall cause MOTC to (a) ensure that all civil works contracts include contractor’s obligation to comply with road safety measures; and (b) monitor the accident rate and traffic volume after the commencement of the operation of the Project Road.
Road Safety. (a) Employees who are required to drive company vehicles including plant and machinery shall at all times obey road laws, drive in a safe and courteous manner and maintain vehicles in a clean, safe and serviceable condition.

During the periods when the Works are being executed the Developer shall comply with the provisions of the Traffic Signs Regulations and General Directions 1994 (published by the Department of Transport) and any amendment thereto for lighting and signing the Works. Danger or nuisance If at any time it appears to the Inspector that the Works are being carried out in any manner which constitutes or is likely to constitute a danger or nuisance to any person or class of persons or to affect the stability or integrity of any structure or apparatus including the highway or otherwise indicates any deviation from the Specification or the Drawings he may give notice to the Developer or the person nominated in accordance with Clause 5(b) of this Agreement, requiring the immediate cessation of the execution of all or any part of the Works pending agreement between the parties hereto as the appropriate method of proceeding and if such agreement is not reached within 48 hours of the serving of the notice then he may make such arrangements as are necessary for the expeditious completion of the Works or, at his discretion restore the highway to a safe and acceptable condition, and recover his reasonable and proper costs as certified by the Inspector from the Surety or the Developer.

As part of the mid term review of the Investment Program and the Project, the Borrower, each State, and ADB shall review the outcomes of the road safety program, to consolidate the institutional mechanism, financing modalities, and detailed implementing arrangements to further ensure sustainable road safety programs for the roads to be developed under PMGSY and the Investment Program at the national and State levels.

The Beneficiary shall ensure that each Project Executing Agency undertake road safety audits, accompanied by road safety awareness sessions, during the design process, construction, and on existing roads, and shall also ensure that recommendations of the road safety audits are reviewed and promptly incorporated in the design and implemented on existing roads, as appropriate.
