SHPO a. SHPO shall review FEMA’s determination of the Areas of Potential Effects (APE), National Register eligibility determinations, and FEMA’s effect findings and respond within timeframes set out in Stipulation I.E.2.
b. Upon request, SHPO shall provide FEMA and/or its designee(s) with available information about historic properties (such as access to site files, GIS data, survey information, geographic areas of concern). Only Qualified staff and/or designee(s) shall be afforded access to protected historic property information. FEMA and SHPO may execute a written agreement to memorialize data sharing, and FEMA and SHPO shall execute a written agreement if the Louisiana Department of Culture,
c. SHPO shall identify staff or consultants to assist FEMA staff with their Section 106 responsibilities, and identify, in coordination with FEMA, those activities within the Section 106 review process that SHPO may perform for specific Undertakings as agreed in writing with FEMA.
d. As requested, SHPO staff shall be reasonably available as a resource and for consultation through site visits, written requests, telephone conversations or electronic media. In those instances where consultation with SHPO has occurred, FEMA shall provide a written summary via e-mail or regular mail to SHPO, including any decisions that were reached.
e. SHPO may delegate some or all of its responsibilities under this Agreement to one or more Liaisons to serve as a dedicated point of contact for consultation with FEMA. SHPO shall confer with FEMA about the selection of any Liaisons, the scope of responsibilities delegated and related implementing procedures. SHPO shall formally document these decisions for concurrence by FEMA. Liaisons are not required to be members of SHPO staff.
f. SHPO shall participate in an initial scoping meeting for a Declaration.
g. SHPO may assist local jurisdictions and/or Recipient(s) in the State of Louisiana with advance planning efforts to consider historic properties in the context of homeland security considerations, including disaster preparedness, response, recovery, and mitigation programs for which FEMA funding may be requested.
h. SHPO shall coordinate with FEMA, to identify consulting parties, including any communities, organizations, or individuals that may have an interest in a specific Undertaking and its effects on historic properties.
i. SHPO shall participate in annual reviews convened by FEMA to review the effectiveness of this Agreement in accord...
SHPO. The SHPO shall be responsible for reviewing project documentation in a timely manner and participating in consultation as set forth in this PA.
SHPO a. Will participate in the review of Undertakings pursuant to this Agreement, including all actions delegated by FEMA to another party on its behalf in accordance with Stipulation II.C.
b. Will provide FEMA with access to available information about historic properties in the disaster area, and guidance on related research to the best of SHPO’s ability, including:
i. Records of designated historic properties (including those listed in the National Register and with state-level designation of Recorded Texas Historic Landmark and State Antiquities Landmark (buildings only)) via the Texas Historic Sites Atlas at xxxx://xxxxx.xxx.xxxxx.xx.xx; and restricted archeological site information to qualified professionals via the Texas Archeological Sites Atlas at xxxx://xxxxxx.xxx.xxxxx.xx.xx/;
ii. Historic Properties (including any known historic streets, roads or intersections) listed in or previously determined eligible for the National Register by the SHPO or Keeper of the National Register;
iii. Properties recorded in the THC standing structures and archeological survey site files in Austin, Texas;
iv. Unevaluated or under-evaluated historic properties in the Disaster area; and
v. Geographic areas:
1) where sufficient cultural resource surveys have been conducted, and the survey results;
2) where there are not likely to be Historic Properties; and
3) where surveys have been conducted, but a high potential for unidentified or under-evaluated historic properties remains.
c. Will identify SHPO staff or consultants to assist FEMA with its Section 106 responsibilities, and identify specific activities that SHPO may perform at FEMA’s request.
d. May delegate any of its responsibilities of this Agreement to a liaison(s) who is not a member of its staff. SHPO will consult with FEMA about the selection of the liaison; the scope of responsibilities delegated; and implementing procedures for the duties, actions, and decisions delegated. The delegation must be acceptable to FEMA, and formally documented. FEMA may provide funding for a liaison when applicable.
SHPO. SHPO has authority to enter into this MOU pursuant to La. R.S. 36:201, et. seq. and La. R.S. 25:911, et seq. Further, SHPO has authority to enter into this MOU pursuant to FAST-41, 42 U.S.C. 4370m-2(c)(1)(C) and 42 U.S.C. 4370m-2(c)(3)(C)(i).
SHPO a. SHPO shall review FEMA’s National Register eligibility determinations and FEMA’s effect findings and provide comments within the timeframes required by this Agreement.
b. SHPO may identify staff or consultants to assist FEMA staff with its Section 106 responsibilities, and identify, in coordination with FEMA, specific activities that the SHPO may perform at FEMA’s request for specific projects.
c. SHPO may delegate some or all of his/her responsibilities under this Agreement to Liaison(s). Liaisons are not required to be members of SHPO staff. SHPO shall confer with FEMA about the selection of SHPO Liaisons, the scope of responsibilities delegated, and the implementing procedures related to the actions and decisions delegated. FEMA and SHPO shall formally document their agreement regarding SHPO Liaisons.
d. If, as a result of a specific declared Xxxxxxxx Act major disaster or emergency, SHPO staff is unable to meet the demands of the situation, SHPO will consult with FEMA at the earliest possible time to seek a solution.
e. SHPO shall participate in initial disaster scoping coordination for each declared Xxxxxxxx Act major disaster or emergency.
f. When requested during recovery operations, SHPO staff will be available as resources and for informal consultation through written requests, telephone conversations or electronic media.
SHPO. SHPO will, in accordance with the provisions of Sections II and III, perform the following duties in support of this Agreement:
SHPO. SHPO shall review Project submittals according to the timeframes defined within this PA and participate in consultation, as requested by FRA.
SHPO a. SHPO shall review FEMA’s National Register eligibility determinations and FEMA’s effect findings and provide comments within the timeframes required by this Agreement.
b. If, as a result of a specific declared Disaster, SHPO staff is unable to meet the demands of the situation, SHPO will consult with FEMA at the earliest possible time to seek a solution.
c. FEMA shall invite SHPO to participate in initial disaster scoping coordination for each declared Disaster.
d. When requested during recovery operations, SHPO staff will be available as resources and for informal consultation through written requests, telephone conversations or electronic media.
SHPO a. The SHPO shall review FEMA’s determination of the Areas of Potential Effects (APE), National Register eligibility determinations, and FEMA’s effect findings, and respond within timeframes required by this Agreement.
b. The SHPO maintains and administers the California Historical Resources Information System (XXXXX), which is an inventory of known historical resources in the State of California. This inventory is archived and made available through regional Information Centers (IC’s) located throughout the state.
i. Upon request, the appropriate IC(s) shall provide FEMA with all requested information, unless otherwise precluded by confidentiality restrictions, such as tribal objections. In the case of an Emergency Undertaking (Stipulation II.B.), the information shall be provided on an expedited basis at no charge. For all other Undertakings, the information shall be provided to FEMA or Cal OES (on behalf of FEMA) in accordance with normal XXXXX operating procedures. In both cases, access to and use and sharing of XXXXX inventory information shall be governed by FEMA’s active XXXXX Access and Use Agreement. Alternatively, FEMA or Cal OES may enter into access agreements with specific ICs that specify terms of inventory information provision.
ii. If, as a result of a disaster, an IC(s) is closed or rendered inoperable, FEMA or Cal OES may request records for the affected area(s) directly from the SHPO. The SHPO will make every effort to provide all available information on a timely basis, although note that SHPO information may not include all information held by the IC.
c. The SHPO shall identify staff or consultants to assist FEMA staff with their Section 106 responsibilities, and identify, in coordination with FEMA, those activities within the Section 106 review process that the SHPO may perform for specific Undertakings as agreed in writing with FEMA.
d. As requested, SHPO staff shall be reasonably available as a resource and for consultation through site visits, written requests, telephone conversations or electronic media. In those instances where consultation with the SHPO has occurred, FEMA shall provide a written summary via e-mail or regular mail to the SHPO, including any decisions that were reached.

SHPO. 1. The MS SHPO shall coordinate with USACE, to identify Consulting Parties, including any communities, organizations, or individuals that may have an interest in the Undertaking and its effects on historic properties.
2. The MS XXXX shall consult with USACE regarding USACE’s determination of the Areas of Potential Effects (APE), National Register eligibility, and findings of effect responding within timeframes set out in Stipulation V.
3. On a per Work Item basis, the MS SHPO shall provide, as part of the consultation, available information about historic properties (such as access to site files, GIS data, survey information, geographic areas of concern) for the purposes of addressing effects to historic properties. Only Qualified Staff, per Stipulation VI. shall be afforded access to protected historic property information. USACE and any MS XXXX may execute a written agreement to clarify and memorialize data sharing if it extends beyond any basic fee structure or access schedule.
4. The MS SHPO staff of jurisdiction (Historic Preservation Division staff members or equivalent) shall be reasonably available as a resource and for consultation through site visits, written requests, telephone conversations or electronic media. In those instances where consultation has occurred, USACE shall provide a written summary via e-mail or regular mail to SHPO, including any decisions that were reached.
