Trade Union Rights and Representation. An employee elected as a union delegate shall upon notification by the union to the company be recognised as the accredited representative of the union. The delegate will be allowed all time during working hours to submit to the company matters affecting employees. A delegate will be given access on site, to a telephone and all meetings and administrative facilities necessary for the performance of his/her duties. To assist with the monitoring of this agreement and to facilitate communication and effective trade union representation the company agrees to be paid 2 hour meeting of employees if required by the Union within each twelve-month period during the life of the agreement at an agreed time and venue. No work will be scheduled during such meetings. Additional meetings may be convened by agreement. The company agrees to the payment to the union and the deduction of union fees from employees pay upon authorisation of an employee(s). At the onset of renegotiations (three months prior to the expiry of this agreement) employees will be eligible to attend a union meeting during ordinary hours of work with pay, at an agreed venue and time, to discuss claims that may be applicable to their next enterprise agreement. No work will be scheduled during such meetings.

Trade Union Rights and Representation. Clauses 11.1 and 11.2 of this Agreement outline the rights for Employee representatives and Union Delegates when assisting Employees. For clarity, each Employee has the right to determine whether they wish to be represented or not. Such representatives (or individual Employees) are entitled to the protections of Division 4 of Part 3-1 of the Fair Work Act in relation to their involvement in lawful industrial activities.

Payment in lieu of notice may be made by agreement; (x) Union members employed by the Company have the right to be represented by their Union in the consultation, disciplinary and dispute resolution arrangements in this Agreement, where they so choose; ...

The company agrees to facilitate the deduction of union fees from employees upon receiving authorisation from employee(s). At the onset of renegotiations for a new agreement (three months prior to the expiry of this agreement) employees or their representative(s)/delegate(s) will be eligible to attend a convened union meeting during ordinary hours with pay, providing such meeting is at a mutually agreed time and venue. The purpose of such meeting will discuss claims that may be applicable to the next negotiated enterprise agreement. No work will be scheduled during such meetings.
