Delegates and Their Rights. In this clause the expression "delegate" means an Employee who is elected by Employees as the representative of Employees at the workplace or within the Company.

Delegates and Their Rights. Prior to dismissal or transfer two days’ notice shall be given to any delegate. Payment in lieu of notice shall not be given. In the event of a dispute about the decision of the Company to transfer or terminate a delegate (other than for reasons that the termination was harsh, unjust or unreasonable) the delegate shall remain on the job during which time either party may apply to the Australian Industrial Relations Commission (AIRC) in accordance with the dispute resolution procedure of this Agreement and the provisions below. If the delegate chooses, the Union can make the application on behalf of the delegate. The delegate, or the Union if the delegate so chooses, shall, within 3 working days of notifying the Company that it disputes the decision to transfer or terminate the delegate, request the AIRC to deal with the matter The AIRC shall have the powers set out in Clause 18, Dispute Resolution Procedure, of this Agreement including the power to order the reinstatement of the delegate.

A Union Delegate who is a bargaining unit employee and is processing a grievance in accordance with the grievance procedure shall be permitted a reasonable time to assist in the resolution of legitimate employee grievances on the Employer's property without loss of pay. Such time off for processing grievances shall be granted by supervision following a request, but in consideration of any job responsibilities.
