Transfer to Positions Outside of the Bargaining Unit. An employee who is transferred to a position outside the bargaining unit for a period of up to twelve (12) months, or such longer period of time as may be agreed by the Local Union and the Hospital, shall retain but not accumulate seniority held at the time of the transfer. In the event the employee is returned to a position in the bargaining unit she shall be credited with the seniority held at the time of transfer and resume accumulation from the date of her return to the bargaining unit.

Transfer to Positions Outside of the Bargaining Unit i) A nurse who is transferred to a position outside of the bargaining unit shall continue to accrue seniority for a period of up to three (3) months, and shall not suffer any loss of service or benefits.
Transfer to Positions Outside of the Bargaining Unit. A nurse who is transferred to a position outside of the bargaining unit for a period of up to six (6) months shall retain but not accumulate seniority held at the time of the transfer. In the event the nurse is returned to a position in the bargaining unit the nurse shall be credited with the seniority held at the time of transfer and resume accumulation from the date of the nurses’ return to the bargaining unit. This term may be extended up to a further six (6) months on mutual agreement of the Union, nurse and Employer.

Such transfers must be agreeable to the employee because after six (6) months the employee is deemed to have lost all seniority rights in the bargaining unit. In the event that the employee is returned to their former position in the bargaining unit, the employee shall be credited with the seniority held at the time of the transfer and resume accumulation from the date of return to the bargaining unit. Such six (6) month period may be extended upon agreement of the Union.
