Transport and packing. 7.1 Unless indicated in writing by the Other Party to the Supplier, the manner of packing, transport, shipment etc, of goods is a matter completely at the discretion of the Supplier and will be determined with the care which reasonably can be expected from the Supplier, this without prejudice to what is specified about the transport risk in Clause 5.2 of these Conditions. 7.2 Any specific wishes the Other Party may have with regard to packing and/or transport, including relocation within the company or company terrain, will only be performed if the Other Party pays the costs involved. Furthermore, the Supplier is entitled not to honour specific wishes from the Other Party with respect to packing and/or transport which have not previously been explicitly agreed. 7.3 If the invoiced value of the goods delivered is less than an amount to be specified by the Supplier, then the Supplier is entitled to pass on any administrative costs.

As a general rule, when being shipped, the Objects shall be accompanied by a transportation escort or a courier employed by the Lender. In the event of any necessary assembly of the Objects, the Lender will provide a restorer employed by the Lender at the site of the Exhibition at the cost of the Borrower. In the event that preparations for the assembly of the Objects have not been completed at the time that the courier or restorer have arrived, or that necessary display cases do not yet exist, the Borrower shall bear any and all costs associated with the extended stay of the courier or restorer, as the case may be. Reimbursement of travel costs for transportation escort, courier and restorer, as the case may be, shall be subject to Austrian Travel Expense Regulations unless otherwise agreed. The Borrower shall arrange appropriate accommodations for the transportation escort, courier, and restorer for the duration of travel. The length of the travel and the stay for the employee accompanying the Objects shall be one to two days if within Austria, three to four days if within Europe, and four to five days if overseas. Moreover, the length of stay of the courier shall depend upon the length of the trip as well as duties which he/she may have at the exhibition site. The parties to this Agreement shall agree to the foregoing before the courier begins his/her travel. The Borrower bears the costs of the courier’s daily subsistence allowance. Transport and packing. 1) All transport arrangements must be approved at least six weeks in advance by the Registrar at MWM. This should usually be a specialised transport agent. MWM reserves the right to veto the Borrower’s choice of transport agent and to specify the transport agent and conditions for the transport of the loan each and every journey. 2) Crates for objects must be prior approved by MWM Conservation staff. All crates for touring exhibitions must have captive bolts. • Those destined for a venue abroad must also be painted/proofed or branded. • If loaned, paintings must travel in an individual ‘Art market specification’ crate, or equivalent, approved by the MWM. 3) All packing will be prior approved by the MWM to meet museum specifications, at the Borrower’s expense. All crate construction and packing and unpacking must be completed by specialist transport agents, approved by the MWM. The transport agent must pack the object on-site at MWM under the supervision of the relevant Curator or Conservator. Cases must be transported in an air-conditioned vehicle, otherwise they must be delivered 24 hours in advance in order to acclimatise. 4) Loans travelling by road must be carried in a suitably equipped and secure vehicle which is sufficiently large to carry the case in its correct orientation, i.e. all paintings should be carried upright. For all except very short journeys vehicles should be climate-controlled and fitted with air-ride suspension. For particularly fragile objects, air-ride suspension will be needed for all journeys. The loaded vehicle must never be left unattended and there should be two driver/handlers. A mobile telephone or radio communication should be available at all times. Vehicles shall be alarmed. Vehicles must provide appropriate protection against vibration and shock and extremes in relative humidity and temperature. All vehicles used should be fitted with climate control, capable of maintaining between 18 to 22º degrees Celsius. This control equipment is a definite requirement for the following: a) sensitive organic materials b) items with a history of mould activity c) paintings on canvas or panel d) items notified to the Borrower as particularly sensitive e) on occasions where prevailing temperatures exceed/are expected to exceed 26º Celsius, or fall below 15º Celsius f) where the anticipated time in transit exceeds 8 hours 5) Door-to-door transit is required.
