UNION PRESIDENT’S LEAVE. The Corporation agrees to grant a leave of absence with pay, benefits and accumulation of seniority to the elected Union President of CUPE Local 1263 for the term of office. It is further understood that the individual continues to be covered under the provisions of the collective agreement during this period of time. The granting of such leave of absence is conditional upon the elected Union President being an employee of the Regional Municipality of Niagara. The Parties agree that the Union shall be responsible for reimbursing the Corporation seventy-five (75%), within 30 days of the date of invoice, for wages and benefits. The Union further concurs with the method of recording such time on a form prescribed by the Corporation.

The Union will further reimburse the Corporation fifty percent (50%) for President’s vacation entitlement and sick leave credits for each year of the President’s leave (i.e. 9 days). The Parties further agree that it is the Union’s responsibility to provide and ensure Workers’ Safety and Insurance Board coverage or equivalent coverage for the President during the President’s leave of absence. Notwithstanding any other clause in the collective agreement, the Union President’s full-time position shall be posted as a temporary position and remain as such during the President’s elected term of office
UNION PRESIDENT’S LEAVE. An employee elected to the 35 hour per week position of President of the Union shall be granted a leave of absence from their position for up to one (1) year, at the request of the Union. The Union’s request for such a leave will be made in writing and submitted to the Director of Human Resources prior to June 1st of each year. Where an employee who has been granted leave and is re-elected to the position of President of the Union for an additional term or terms, additional leave of absence shall be granted on an annual basis, on further request of the Union. The Board shall pay the President of the Union full salary and benefits (including pension, health insurance benefits, group life, JEIS, LTD and EAP), and the President shall accumulate vacation, sick leave and seniority during this leave based on 35 hours per week. Vacation accrued during the leave shall be at no cost to the Employer. The Board shall provide the Union with a detailed breakdown of salary and benefit premium costs every month, and upon receipt the Union shall reimburse such costs excluding the employer’s contribution to the Municipal Pension Plan. A person returning to their positions with the Board from a leave of absence as President of the Union at the end of the term of leave shall be returned to the position held prior to the leave as President, where such position still exists. Where such position does not exist, the District shall offer the person returning from the leave available positions within the District comparable to the position held by the President prior to the commencement of leave. If the President vacates the position of President before the one year leave expires, they will be returned to their position previously held with the Employer where practicable. If not practicable, the employee will be offered a comparable position for the duration of the leave. For the purpose of sick leave entitlement, the President shall be deemed to be in the employ of the Board and Article 16 shall apply, subject to the following:

  • President’s Leave The Employer shall authorize a leave of absence with pay for the President of the Association. The leave of absence with pay shall be taken for a two-year period beginning two (2) weeks after written notice by the Association to the Bureau of Employee Relations and the newly-elected President’s agency. During such leave of absence with pay, the President shall continue to receive and retain all of his/her wages, rights, benefits, and seniority as a state employee except that all leave accumulation shall be frozen for the duration of the leave of absence. Upon returning from the leave of absence, the President shall resume earning leave at the rates appropriate to his/her service at the time of return. The Employer agrees that there shall be no action taken with respect to the President or the President’s state position prior to or following his/her return from the leave of absence because of his/her legal union activities. The Association agrees to reimburse the Employer for the full cost of the wages and benefits for the President, and to indemnify the Employer against any and all liabilities associated with the leave of absence, including but not limited to workers' compensation.

  • Union Leave (a) Upon receiving a written request at least one (1) week in advance from the Union, the Company will grant leave of absence for not more than two (2) employees at any one time to attend Union conferences, conventions, or workshops, providing that the combined leaves of absence will not exceed forty (40) working days in any one (1) calendar year.   • Union Leaves Employees on Union Leaves will be treated as provided in Article 18 (Q) while working on Union leave.

  • Vice President In the absence of the President or in the event of the President’s inability to act, the Vice President, if any (or in the event there be more than one Vice President, the Vice Presidents in the order designated by the Directors, or in the absence of any designation, then in the order of their election), shall perform the duties of the President, and when so acting, shall have all the powers of and be subject to all the restrictions upon the President. The Vice Presidents, if any, shall perform such other duties and have such other powers as the Board may from time to time prescribe.

  • Leave, President, O.N.A Upon application in writing by the Association on behalf of the nurse to the Hospital, a leave of absence shall be granted to such nurse elected to the office of President of the Ontario Nurses' Association for a period of up to three (3) consecutive two (2) year terms. Notwithstanding Article 10.04, there shall be no loss of service or seniority for a nurse during such leave of absence. During such leave of absence, the nurse's salary and applicable benefits shall be maintained by the Hospital and the Association agrees to reimburse the Hospital in the amount of the full cost of such salary and applicable benefits. It is understood, however, that during such leave the nurse shall be deemed to be an employee of the Ontario Nurses' Association. The nurse agrees to notify the Hospital of her or his intention to return to work at least two (2) weeks prior to the date of such return.

  • Training Leave An employee appointed or elected as an accredited representative of the union shall, upon application in writing to the employer, be granted up to 5 days leave with pay each calendar year (non-cumulative) to attend appropriate courses: • Such courses shall be designed and structured with the objective of promoting good industrial relations within the building and construction industry. • Consultation may take place between the parties in the furtherance of this objective Accredited representative of the union shall mean a job xxxxxxx recognised by the employer. The application shall contain the following details: • The name of the employee seeking leave • The period of time for which the leave is sought (including dates and daily commencing and finishing times) and • The title, general description and structure of the course to be attended and the location of where the course is to be conducted. The employer shall advise the union within seven clear working days (Monday to Friday) of receiving the application as to whether or not the application for leave has been approved. The time of taking leave shall be arranged so as to minimise any adverse effect on the employer’s operations. The onus shall rest with the employer to demonstrate an inability to grant leave when an eligible employee is otherwise entitled. An employer shall not be liable for any additional expenses associated with an employee’s attendance at a course, other than the payment of ordinary time earnings for such absence. For the purposes of this clause ordinary time earnings shall be defined as the relevant award classification rate, shift work loadings plus over-award payments. Leave rights granted in accordance with this clause will not result in additional payment for alternative time off to the extent that the course coincides with an employee’s day off in the 19 day month work cycle. An employee on request by their employer shall provide proof of their attendance at any course within 7 days. If an employee fails to provide such proof the employer may deduct any amount already paid for attendance from the week’s pay or any monies due to the employee. Where an employee is sick during a period when leave under this provision has been granted proof of attendance at the course is not required for that period and the employee shall receive payment in accordance with personal leave provisions. Leave of absence granted in accordance with this clause shall count for all purposes of employment.
