USE OF THE WORK. 3.12.1 The Contractor shall confine Construction Equipment, Temporary Work, storage of Products, Owner Supplied Material, waste products and debris, and operations of Contractor Parties to limits indicated by Laws or the Agreement and shall not unreasonably encumber the Site. All Products and Owner Supplied Equipment shall be stored under suitable conditions to prevent damage, deterioration, and contamination.
3.12.2 The Contractor shall not load or permit to be loaded any part of the Work or any part of the Site with a weight or force that shall or could be considered to endanger the safety or integrity of the Work or any part of the Site, individuals and the area adjacent to the Site.
USE OF THE WORK. (a) Project Co shall confine construction machinery and equipment, storage of Products, and operations of employees to limits indicated by Applicable Law or the Contract Documents and shall not unreasonably encumber the Work with Products.
(b) Project Co shall not load or permit to be loaded any part of the Work with a weight or force that will endanger the safety of the Work.
(c) Owner shall have the right to occupy Phases of the Work as set out in the Contract Documents and to enter and occupy the Work in whole or in part for the purpose of placing fittings, furniture and equipment or for other uses, including the intended use of Owner before Substantial Completion of the Work, as provided for in the Construction Schedule. Project Co shall cooperate with Owner, the Owner’s Project Manager and the Consultant, so as to permit Owner to occupy and to place such fittings, furniture and equipment in the most efficient manner possible. Such entry and occupation shall not be considered an acceptance of the Work or in any way relieve Project Co from responsibility to complete this Project Agreement. Subject to Section 11.19(d), Project Co is responsible to ensure the completion of Phases of the Work in accordance with the Phased Occupancy Dates and the Scheduled Substantial Completion Date and that the Phases of the Work are ready for occupancy by Owner in accordance with the Contract Documents including the requirements of paragraphs (b) and (c), and to the extent available, paragraph (d) of Section 1.196 of Schedule 1-Definitions and Interpretation “Substantial Completion”, as applicable to the respective Phase of the Work. Project Co acknowledges that Substantial Completion of the Work is only achieved in respect of the Work as a whole and not in respect of any Phase of the Work.

3.12.4 The Contractor recognizes that part of the Work consists of the renovation of existing buildings and structures or the addition of a structure to an existing building and that the provision of patient care during construction is a priority for the Owner and acknowledges that it has reviewed the Contract Documents referred to in GC 3.12.5 below. The Contractor shall use all methods required to comply with the instructions set out in the Contract Documents including those referred to in GC 3.12.5 during the performance of the Work. USE OF THE WORK. 1. From the date of acceptance of the Work the Person Ordering shall have the right to use, reproduce or further process the Work in compliance with this Contract.
2. The Person Ordering may use the Work for a different purpose only with the consent of the Author.
3. The Person Ordering shall keep and protect the Work against any damage.
4. The Author agrees to refrain from using the Work during the period for which it will be used by the Person Ordering.
USE OF THE WORK. 2.31.1 The Contractor shall confine their apparatus, the storage of products and the operations of their employees to limits indicated by laws, ordinances, permits or by instructions of the Engineer/Architect and shall not unreasonably encumber the premises with their products.
2.31.2 The Contractor shall not load or permit to be loaded any part of the Work with a weight or force that will endanger its safety.
2.31.3 Unless otherwise provided, the Contractor shall, at their own expense and without expense to the Owner, make suitable provision to accommodate all traffic, either pedestrian or vehicular, over or around the project upon which work is being performed in a manner satisfactory to the Engineer/Architect.
2.31.4 The Contractor shall provide and maintain at their own expense such fences, barriers, signs, lights and watchmen as may be necessary to prevent avoidable accidents to University Users or to the public generally.
2.31.5 All work shall be executed with the least possible interference with or disturbance to personnel and the Public. The Contractor shall cooperate with the person in charge of the premises. The Contractor shall ascertain from the Owner's representative the hours during which the work shall be performed, conform to the directions of the representative and to the directions of the said representative in determining the order in which the work shall be done.
2.31.6 The Contractor shall carry out all work required to maintain the building services and to provide necessary access for personnel and vehicles whenever new work affects occupied portions of the building.
2.31.7 Before final completion of the work, the Owner shall be entitled to make use of any portion of the work which is completed and fit for use for the installation of equipment, storage and furniture, supplies, etc., and for occupancy, if such can be arranged without interfering with the progress of the work.
USE OF THE WORK. Product is at Owner’s sole risk without liability or legal exposure to any Indemnified Party; provided, however, that any “pass through” warranties regarding equipment or express warranties regarding equipment provided by this Agreement shall remain in effect according to their terms; and
