Voluntary Transfers and Assignments. 1. No later than March 1, the Superintendent should furnish a list of known vacancies for the next school year to building principals and the Association president or secretary. 2. Teachers who desire a transfer should file a written request within five (5) days of the posting each year and such request will be valid through the first semester of the next school year. 3. A standardized procedure for interviewing and notifying applicants for transfer shall be established by the Superintendent. 4. Applicants for transfer within the system shall be granted an interview with the principal(s) of the building(s) to which the applicant has requested to be transferred and other District employees deemed appropriate by the Superintendent. Such interview shall be held between March 15 and the last day of the school year. Such consideration shall be given to applicants before new teachers are hired. 5. Requests may be made for position, grade level(s), and/or building. 6. The Superintendent retains the right to assign staff based on the needs of the district. The Superintendent will consider the certification/licensure, qualifications, and evaluations, and seniority of applicants in approving transfer requests, as well as the overall needs of the district. With all other qualifications being equal, final decision will be made by the building administrator and the Superintendent. 7. A teacher who makes a voluntary transfer may not again seek a voluntary transfer for a period of three (3) years, unless extenuating circumstances approved by the Superintendent are present.

Voluntary Transfers and Assignments. The Board recognizes that it is desirable in mak- ing transfers or filling vacancies to consider the interests and aspirations of its teachers. The Board agrees that the screening committee, if one exists, will provide an informal in- terview during the screening process to all teachers that request a transfer, provided the teacher meets the stated requirements of the position. The Principal may grant the trans- fer or choose to continue to screen for applicants and fill the vacancy in accordance with District hiring policies. The final selection will be the best qualified candidate.

No later than June 1st of each school year, the Administration shall post in all school buildings a list of the known vacancies which will occur during the following school year. Vacancies shall be defined as the availability of a position caused by the death, resignation, retirement, promotion, discharge, creation of a new position or transfer. When a vacancy occurs during the school year, the administration shall post the position within 30 days. The administration shall recommend and the school committee shall make an appointment for the position promptly. However, the position shall not be filled until the beginning of the following school year unless the vacancy occurs before October 1st of the school year or the teacher defers until the next school year. Teachers who desire a change in grade and/or subject assignment or who desire to transfer to another building shall file a written statement of such desire with the Superintendent, not later than June 1st. Such statement shall include the grade and/or subject to which the teacher desires to be assigned and the school or schools to which he/she desires to be transferred, in order of preferences. If positions become available after June 1st, reapplication for posted positions will be accepted. A. 3. New reassignments as a result of the elimination of positions covered under this Article shall not be made without giving reasonable notice to the President and affected teachers. A. 4. Except in an emergency situation, vacancies shall be posted in all school buildings two (2) weeks before the position is offered outside the school system. No assignments of new teachers in the school system shall be made until all pending requests for reassignment or transfer have been acted on in those particular areas and/or grades. A. 5. The Superintendent shall make available to the Association requested information pertaining to individual reassignments and/or transfers, if this information does not abridge a teacher's rights or personal wishes.

When a vacancy within a school or administrative unit in any professional position occurs, the administration/Board will make any appropriate adjustments/reassignments that are deemed necessary. The resultant opening will be posted on the District’s web page. 10.2.2. No vacancy shall be filled until the notice has been posted for a reasonable period of time which normally will be five (5) days. The notice will contain the type of vacancy, grade level or subject(s) to be taught, and starting date. 10.2.3. Educators who desire a transfer must submit a request on the approved form by March 15. (See Appendix B). The March 15 date does not apply to vacancies occurring after that date. 10.2.4. The Superintendent shall make available to the Association President any requested information pertaining to individual reassignments and/or transfers. 10.2.5. In the determination of requests for voluntary reassignment and/or transfers, the convenience and wishes of the individual educator will be considered to the extent that they do not conflict with the instructional requirements and the best interest of the school system. If more than one educator has applied for the same position, the seniority, qualifications, and evaluations of the career educators will be considered, as well as the needs of the District. The voluntary reassignment of career and provisional educators will be at the discretion of the District administrator over that school or department.

If an employee’s request for transfer is approved, he/she will be notified in writing. In such cases, every reasonable effort will be made to transfer the employee as soon as possible.

Upon request, teachers shall be notified in writing of the disposition of their requests for transfer including the reasons for disposition.
