Witness Points. Contractor shall provide Owner with a list of witness points for all Major Equipment no later than thirty (30) Days’ after execution of the relevant Subcontract and Owner shall notify Contractor which of the witness points it wishes its personnel to witness. Contractor shall provide Owner with at least fifteen (15) Days prior written notice of the actual scheduled date of each of the tests Owner has indicated it wishes to witness. Contractor shall cooperate with Owner if Owner elects to witness any additional tests, and Contractor acknowledges that Owner shall have the right to witness all tests being performed in connection with the Work. Notwithstanding Owner’s rights to witness tests, Owner shall not interrupt or interfere with any test or require changes while witnessing such tests; provided however, if Owner observes testing that, in Owner’s reasonable opinion, raises a safety concern or could cause damage to Major Equipment, then Owner has the right (but not the obligation) to notify Contractor and Contractor shall promptly respond after such notification to rectify any issues.

Witness Points. No later than [***] ([***]) Days after NTP, Contractor shall submit to Owner for its approval a proposed list of witness points for each item of the Work. Contractor shall modify such list of witness points based on any additional or different witness points Owner desires. After Owner’s approval of the witness points, Contractor shall provide Owner with at [***] ([***]) Days’ prior notice of the actual scheduled date of each of the tests relating to such witness points at the Site and [***] ([***]) Days’ prior notice of the actual scheduled date of each of the tests relating to such witness points. Notwithstanding such right to witness tests, Owner, Lender, and Independent Engineer shall not interrupt or interfere with any test or require changes while witnessing such tests (unless such interruption relates to safety). Contractor shall cooperate with Owner, Lender and Independent Engineer if Owner, Lender or Independent Engineer elects to witness any additional tests, and Contractor acknowledges that Owner, Lender and Independent Engineer shall have the right to witness all tests being performed in connection with the Work. Owner’s, Lender’s and Independent Engineer’s right of inspection as set forth herein applies only to its witnessing of witness points for Work and shall not be construed to imply a limitation on Owner’s, Lender’s or Independent Engineer’s right to inspect any portion on the Work (including Equipment) at any time in its sole discretion and in accordance with this Agreement.

Contractor shall cooperate with Owner if Owner or its Lenders’ representatives elect to witness any additional tests, and Contractor acknowledges that Owner and its Lenders’ representatives shall have the right to witness all tests being performed in connection with the Work. Owner’s rights of inspection (and the rights given to the Lenders’ representatives) as set forth herein apply only to their witnessing of witness points for Equipment and shall not be construed to imply a limitation on Owner’s right to inspect any portion on the Work (including Equipment) at any time in accordance with this Agreement.
Witness Points. The Quality Management System Plan shall set forth a list of agreed witness points for Concessionaire and the Department to witness certain portions of the DB Work. At least fourteen (14) days in advance of any witness point, Contractor shall provide Concessionaire and the Department with a preliminary notice thereof, and Contractor shall provide a final notice no later than five (5) days in advance of any witness point. Contractor shall not proceed past an established witness point prior to the date specified therefor in the advance notice unless Concessionaire has witnessed the activity and Contractor is in compliance with its obligations under Section 2.1.9 or Concessionaire has failed to witness or inspect the DB Work on the date scheduled, in which case Concessionaire will be deemed to have waived its right to witness such activity and Contractor shall be entitled to proceed with the DB Work. Concessionaire’s failure to view a witness point shall not be cause for a Concessionaire-Caused Delay.

Witness Points. (a) Witness Points are defined points in the process of completing the Work where the CTA may review, witness, inspect or undertake tests on any component, method or process, and are identified in the Project Requirements. (b) In addition to identifying in the Schedule pursuant to Section 8.2, the Contractor shall provide 24 hours notification for Witness Points. The CTA can choose not to participate, and CTA approval is not required to proceed with the work process after a Witness Point, provided that notice was provided. (c) The CTA reserves the right to direct the Contractor to remove any work installed if the Contractor fails to provide the required notice to the CTA for any Witness Point, at no cost to the CTA and with no additional Contract Time provided.

Notwithstanding such right to witness tests, Owner, Lender, and Independent Engineer shall not interrupt or interfere with any test or require changes while witnessing such tests (unless such interruption relates to safety). Contractor shall cooperate with Owner, Lender and Independent Engineer if Owner, Lender, or Independent Engineer elects to witness any additional tests, and Contractor acknowledges that Owner, Lender, and Independent Engineer shall have the right to witness all tests being performed in connection with the Work. Witness Points. The Buyer reserves the right to designate selected manufacturing, inspection, and/or test operations as “witness” points. The Supplier shall provide the Buyer with five (5) working days notice in advance of reaching such witness points during the manufacturing and test cycle of each item.
