Acting Time. The Chief of Police or Deputy Chief in charge of the affected Bureau shall determine when acting time is necessary. When it is necessary to appoint an employee to act in the place of a Sergeant, then the employee in the affected Section or Unit who stands highest on the promotional list to be promoted and who is eligible for promotion to Sergeant shall be given the acting time. In the event there is no list, then the employee in the affected Section or Unit who has the most seniority shall be given the acting time. Acting time shall be paid for the actual number of hours worked at the starting rate of a Sergeant, until such time as the employee has served one thousand and forty (1,040) hours of acting time, after which the employee shall be paid at the full rate of a Sergeant.

Acting Time. If a Deputy Chief is absent for the day (8 hrs.) the Battalion Chief assigned to them or their Bureau shall receive acting pay while the Deputy Chief is absent. Acting pay shall be at the current wage rate for a Deputy Chief. Only Battalion Chiefs off probation are eligible for the acting Deputy assignment.
Acting Time. In Field Operations, the Police Department shall maintain a minimum of two (2) Lieutenants on the 6 x 2, 2 x 10, and the 10 x 6 shifts at all times unless the police department opens a third district station whereupon the police department shall maintain a minimum of three (3) Lieutenants on a 24-hour seven (7) day a week basis. The Police Department shall maintain a minimum of four (4) sergeants on the 6 x 2 shift and five (5) sergeants on the 2 x 10, and the 10 x 6 shifts citywide at all times. Except as noted in this section the Chief of Police or the Deputy Chief in charge of the affected District Station, Division, Section or Unit shall determine when acting time is necessary. As long as the current budgeted staffing levels under section 2109.29 are maintained, the Chief or his designee retains the right, as operational needs dictate, to utilize a police patrolman as an acting Sergeant so long as no recall is created at the patrolman rank. The City agrees to track the use of acting time by police patrolmen and provide the information to the TPCOA on a monthly basis, and, upon request, meet and discuss with the TPCOA any concerns the TPCOA may have regarding any increase or change in acting time assignments. In all circumstances where recall is necessary, the recall shall be awarded to the rank where the vacancy exists. For example, if a vacancy exists at the lieutenant’s rank and making an acting lieutenant would cause recall to be utilized at the sergeant’s rank, then the recall shall be given to the lieutenant’s rank. For the purposes of training, acting time shall be paid when the Command Officer is scheduled to be absent for the entire shift. Acting time shall be paid for the actual number of hours worked. When a Command Officer is in an acting capacity, he shall receive the rate of pay entitled to that rank in which he is acting, commensurate with his years of service. When a Command Officer is in an acting capacity on a holiday, he shall be paid at the holiday rate of pay entitled to that rank in which he is acting. The Sergeant permanently assigned to the Section or Unit where acting time is necessary and who stands highest on the promotional list for the rank of Lieutenant, shall be given the acting time. In the event that no list exists, or there is no permanently assigned Sergeant on the promotional list, then the permanently assigned Sergeant in the Section or Unit who has the greatest seniority in rank shall be given the acting time. Acting Time. Section 30.1: When the appropriate administrative authority determines it necessary to temporarily assign an employee to work in a higher classification, said employee shall be eligible to receive the rate of pay of that classification for the period which he/she was so assigned. Section 30.2: Employees who stand highest on the promotional eligibility list, in the next lower rank, shall be given first preference for the acting time. Acting time shall be paid for the actual number of hours worked in the higher classification. In the event there is no promotional eligibility list, then the employee in the affected section or unit who has the most seniority in the next lower rank, shall be given the acting time. Section 30.3: The individual must be assigned to and must perform functions that are normally performed by the higher classification replaced in order to receive compensation for that time period.
Acting Time. Section 46.1 When the Chief of Police or his designee determines it is necessary to temporarily assign an employee to perform the duties of a position above that which the employee currently holds for periods of more than twenty-eight (28) days, such employee shall be paid the pay rate of the higher classification. Section 46.2 The employee so assigned must be assigned to and perform functions that are normally performed by an occupant of the higher classification in order to receive the higher compensation.
Acting Time. Section 48.1 When the Superintendent or his designee determines it is necessary to temporarily assign an employee to perform the duties of a position above that which the employee currently holds for periods of five (5) consecutive work days or more, such employee shall be paid the pay rate of the higher classification. Acting time is only payable when the employee is working in the higher pay classification/pay grade. Training periods at a higher level shall not be computed when determining acting time.
Acting Time. When the City determines it necessary to temporarily assign an employee to work in a higher non-Bargaining Unit classification, or as a Xxxxxxx/Lead Lineman with two (2) or more employees under their direction, said employee shall be eligible to receive a rate of pay one dollar ($1.00) per hour above that which he usually receives. For the purposes of this Article "temporarily" shall mean for a minimum of four (4) hours and shall mean that the employee is available for call as an Employee acting as a higher authority after working hours on any day that he receives Acting Time pay. Should the employee be called as an Employee acting as a higher authority after working hours while receiving Acting Time pay, he shall be entitled to receive pay for any actual time worked at one and one-half his revised rate of pay which shall include base wage, longevity wage and Acting Time wage.

Filling of vacancies will be by offering to the qualified Member on that shift, who is available and is the highest ranking on the promotional list for the classification being filled.

No disciplinary action involving a suspension in the prior 12 months. C. Recommendation of the patrol supervisors. Officers agreeing to become acting supervisors agree to attend a first-time supervisor school. When there are two (2) or more qualified officers on duty, the Chief or his designee shall appoint the senior officer.
